Day ahead of 'Udaipur Files' release, HC stays it, asks Centre to take call

Representative image NEW DELHI: Delhi high court stayed Thursday the release of 'Udaipur Files' in a rare instance of judicial intervention to pause a movie on the eve of its pan-India opening, reports Abhinav Garg. The film is purportedly based on tailor Kanhaiya Lal's 2022 murder in Udaipur. The court directed Islamic cleric body Jamiat Ulema-i-Hind and other petitioners, which have objected to the movie, to seek a review of its censor certificate. The division bench of Chief Justice D K Upadhyaya and Justice Anish Dayal directed the petitioners to approach the Centre within two days with their grievance. Until the Centre takes a call on their revision plea, the film will not be released, the bench said. Kanhaiya Lal was murdered in June 2022 for allegedly sharing a social media post in support of former BJP functionary Nupur Sharma after her controversial comments on Prophet Mohammed. NIA arrested alleged assassins Mohammad Riyaz and Mohammad Ghous. Their trial is pending. The judges pointed 'that it is not impermissible for this court to exercise extraordinary jurisdiction even in a case where a petitioner has not exhausted its alternative statutory remedies'. 'But having regard to the facts and circumstances of the case… especially the processes to be gone into at the time of grant of certification, we are of the opinion that the petitioner ought to approach the central govt by invoking Section 6 of the (Cinematograph) Act (which deals with revisional powers vested with the central govt),' the high court said. During the hearing, petitioners' senior counsel Kapil Sibal described the film as 'the worst form of hate speech' against a community and an 'imminent threat to public order and harmony'. He told the bench he had watched the film in a private screening, as directed by the court. He cited some instances and dialogues to argue the movie was 'not art but cinematic vandalism' to vilify a community. Among the scenes Sibal highlighted was one showing arrests of Muslim students. In contrast, additional solicitor general Chetan Sharma, representing the Centre, justified the censor board's nod and contended that it was a movie based on a crime, not any community. 'The film cautions people. It is a crime-specific film. We should all live together — that's the theme,' Chetan Sharma argued.

New Delhi: The movie 'Udaipur Files' - based on the gruesome murder of Udaipur tailor Kanhaiya Lal - is in legal soup after several petitions have been filed seeking a stay on its release, due for July 11. The Supreme Court was approached by one of the accused, Mohammad Jawed, seeking an urgent hearing of the case. Jawed is out on bail, and a plea challenging his release is already pending in the Supreme Court. What did the Supreme Court say today? He said that the release might adversely impact a free and fair trial. However, the court noted that the matter is already pending before another bench of the Supreme Court. It asked the accused to approach the court when the court reopens after vacations. While the Supreme Court has refused to stay the release of the movie today, the High Court of Delhi is considering the appeals against the Central Board of Film Certification (CBFC) certificate for the movie. The Delhi High Court on Wednesday directed the producers of the movie to arrange an urgent screening of the movie for all the counsels appearing in the case. A division bench comprising Chief Justice DK Upadhyaya and Justice Anish Dayal was hearing the matter and thus directed lawyers from CBFC, petitioners, to watch the movie today and come to the court again tomorrow with their apprehensions, if any. One of the PILs has been filed by Jamiat Ulama-e-Hind President- Maulana Arshad Madani, contending that the movie disrespects the holy Prophet of Islam and maligns Muslims. Jamiat Ulama-e-Hind has filed pleas in the High Courts of Delhi, Maharashtra, and Gujarat challenging the release of the movie. The Muslim body had argued that the film's trailer includes the controversial statement made by Nupur Sharma, which they said had not only set the entire country on fire but also caused an adverse impact on the friendly relations of our country with other nations. The body claims that the trailer has "objectionable remarks against the Prophet of Islam and his holy wives", which could disturb peace and public order in the country. However, Additional Solicitor General (ASG) Chetan Sharma, appearing for the CBFC and the state, told the Delhi High Court that the offending parts of the movie have been cut out of the film. Senior Advocate Kapil Sibal, appearing for the petitioners and said the makers of the movie have the right to free speech, but the whole tenor of the movie promotes violence. At this point, the High Court suggested that Mr Sibal sit with CBFC counsel ASG Chetan Sharma, watch the film, review the cuts and then come back to the Court. The counsel for the movie producer, however, said that they will watch the film and come tomorrow and again say that particular part is still offensive, drawing rebuke from the Chief Justice of the High Court. "What is this? Can the screening of the movie take away their right to challenge the certificate of the film? What is this?" the Chief Justice remarked. The High Court will take up the matter tomorrow. If convinced, the Delhi High Court can still order a stay in the release of the movie.

New Delhi [India], July 9 (ANI): The Delhi High Court on Wednesday directed a special screening of the controversial film 'Udaipur Files' before ruling on petitions seeking to halt its release, scheduled for July 11. The film, inspired by the 2022 murder of tailor Kanhaiya Lal in Udaipur, has drawn sharp criticism for allegedly stoking communal tensions. The directive came during Tuesday's hearing, where Additional Solicitor General Chetan Sharma, representing the Ministry of Information and Broadcasting and the Central Board of Film Certification (CBFC), informed the court that 40-50 objectionable elements had already been removed from both the trailer and the film. The CBFC had proposed these cuts before certification, and they were duly implemented. A bench comprising Justice Devendra Kumar Upadhyaya and Justice Anish Dayal ordered the screening of the censored version for all counsels, including Senior Advocate Kapil Sibal, who appeared for petitioners Maulana Arshad Madani (President of Jamiat Ulama-i-Hind) and Prashant Tondon. The court asked all parties to return with their observations after the screening, which was scheduled for later that day. The matter will resume on Wednesday. The petitioners argue that the film vilifies a religious community and could incite violence. Sibal emphasised that freedom of expression must not override public order, stating, 'Even if certain scenes have been removed, the theme itself remains disturbing.' The petitions also raise constitutional concerns, alleging violations of Articles 14, 15, and 21, and warn that dramatising unresolved legal matters--such as the Gyanvapi Mosque case--could amount to contempt of court. Critics further accused the film of distorting the facts of the Udaipur murder by suggesting a broader religious conspiracy instead of focusing on the two radicalised individuals involved. Maulana Madani has publicly condemned the film, calling it a threat to India's secular fabric and criticising the CBFC for what he described as a failure in regulatory oversight. (ANI)
