In the details, a mother took her son, who was suffering from a pain to hospital, where a doctor examined him. She did not violate accepted medical standards, and no serious errors were made. However, the doctor did not repeat the tests to check for inflammation, did not conduct a CT scan to follow up on such cases, and did not choose the appropriate antibiotic. These errors constituted gross medical negligence, causing the son to suffer from material and moral damages. The mother filed a lawsuit, demanding that the hospital and the treating doctor pay Dhs350 thousand, plus legal interest at a rate of 12 per cent, as well as fees, expenses and charges. The Court explained that the hospital had actual authority over the doctor in terms of supervision and guidance. Furthermore, the report of the Higher Committee for Medical Liability, which was appointed to investigate the case, confirmed presence of error and negligence during the operation. The medical report showed that recognised medical principles had not been followed, as the operation had been performed without taking the necessary precautions. Therefore, the court found that the plaintiff's son deserves compensation for this damage, and estimates it at Dhs75,000 for both material and moral damages.

The school had previously provided education for his son and daughter, but he did not fulfil his financial obligations, the court heard. In particular, an educational establishment initiated legal proceedings against a legal guardian, seeking a court order to mandate the payment of Dhs87,000, along with interest at a rate of 9% per annum, calculated from the date of initiation of legal proceedings until full payment. This directive is to be implemented without delay or restriction. Furthermore, the court ruled that the guardian should be held liable for the legal fees and expenses incurred. The school initiated legal proceedings on the basis that the guardian had enrolled his son and daughter to study there in exchange for the prescribed fees according to the academic level of each of them. The fees due and outstanding from the guardian amounted to Dhs41,491 for his daughter and Dhs40,508 for his son, for a total value of Dhs82. This is the remaining amount after deducting the sum that was partially paid by the guardian. The guardian was asked to settle the outstanding balance amicably, but did not do so. The guardian's failure to pay on time resulted in the request for compensation, which is calculated at Dhs5,000. The total claim thus amounts to Dhs87,000. The guardian's error resulted in material damage to the school. In consideration of the aforementioned, the court possesses discretionary authority to ascertain the compensation due to the educational institution at Dhs2,000, in recognition of the material damages sustained.

Subsequent to this, a criminal case was filed against her, and a ruling was issued convicting her, alleging that her actions caused her moral and material harm. In particular, the complainant initiated legal proceedings against the defendant, seeking a court order for the payment of Dhs150,000 in compensation for the material, moral and psychological harm she suffered as a result of the defendant's actions. Furthermore, the complainant requested that the defendant cover legal expenses, fees and attorneys' fees. The plaintiff initiated legal proceedings on the basis that the defendant had committed an act of defamation against her by means of a social media program. This was constituted by the writing and commenting on photos and videos, and the sending of insulting phrases in private. Consequently, a criminal lawsuit was initiated and a judgment was issued, resulting in her experiencing moral and material harm. This prompted her to file the present lawsuit, accompanied by the specified requests. The Court indicated that the foundation for the defendant's prosecution stemmed from the prior criminal case, wherein it was established that the defendant had committed an act of verbal abuse against the complainant through information technology apparatus, specifically a social media platform. The Court had ruled in absentia, convicting the accused and imposing a fine of Dhs250,000. The court also ordered the confiscation of the devices used in the commission of the crime, the deletion of the information or data, and the payment of the criminal fees. The ruling was rendered final.

A criminal case was subsequently filed and a verdict was issued accordingly. The plaintiff filed a lawsuit against the defendant in which she requested the court to obligate him to pay her Dhs100,000 in compensation for all the material, moral and psychological harms she had befallen plus the incurred fees, expenses and attorney's fees. The plaintiff pleaded that the defendant assaulted her caused her psychological, moral and material harms, which prompted her to file this lawsuit with the aforementioned requests. The court stated that, according to the provisions of Articles 292 and 293/1 of the Civil Transactions Law, any harm to others obligates the perpetrator to pay compensation. The defendant's assault caused the plaintiff moral harms as embodied in pain, grief and sadness, and material harms, which affected her physical safety, the court added. It is established that the court is not to be blamed if it obligated the defendant to pay a total compensation for all the harms that befell the victim, provided that it clarifies the harms for which the compensation order was issued. Based on this, the court estimates the compensation due to the plaintiff for all the harms she suffered at Dhs15,000.

The plaintiff filed a lawsuit in which she requested the court to obligate the defendant to pay Dhs30,000 in compensation for the harm she had befallen as a result of the words he uttered on a social media platforms that tarnished her reputation and caused her serious harm. She also requested the court to obligate the defendant to pay the incurred expenses and lawyer's fees. The court explained that it was established from the previous criminal case that the defendant was charged with insulting the victim with offensive words over the phone and insulting her again in a way that tarnished her reputation by sending the messages indicated in the report to a social media platform. According to the provisions of Articles 292 and 293/1 of the Civil Transactions Law, any harm to others necessitates the perpetrator to pay a compensation, the court said, adding that the defendant's mistake caused the plaintiff moral harm as embodied in pain and grief. Based on the above, the court estimated that the compensation the victim deserves for the trauma she suffered to be Dhs7,000.
