Dismantlement of homeless encampment on Notre-Dame Street delayed until late August
A homeless encampment along Notre-Dame Street was spared from another eviction on Monday. A judge ruled the encampment cannot be dismantled before Aug. 27 and prohibited the Ministry of Transport (MTQ), which owns the land, from cleaning up the area where the shelter and people's belongings are located. City officials can intervene, however, if the tents and other structures are located less than three metres from the bike path, less than 15 metres from an entrance to Morgan Park or are leaning on a fence. The City of Montreal took note of the decision. 'However, we would like to reiterate that City teams, in close collaboration with community and government partners, are actively continuing their work in the field. Psychosocial support for people experiencing homelessness is being maintained and remains a constant priority,' the city said in an email to Noovo Info. The Clinique juridique itinérante (CJI) obtained a previous injunction on June 30 preventing the MTQ and the City of Montreal from evicting those camping there until at least July 10. During the legal proceedings, lawyers argued that an eviction would cause those living there serious harm and shouldn't be done when shelters are overflowing. Lawyers for the City of Montreal and the MTQ, on the other hand, said there are safety issues associated with the camp, like the building of permanent structures, an increase in the number of tents and frequent interventions by police and the fire department. Notre-Dame St. encampment won't be taken down Thursday
Quebec's Transportation Ministry (MTQ) will not be dismantling the homeless encampment along Notre-Dame Street in Montreal's east end on Thursday, Noovo Info has confirmed. The Clinique juridique itinérante (CJI) obtained another injunction on June 30 preventing the MTQ and the City of Montreal from evicting those camping there until at least July 10. The MTQ told Noovo Info that no dismantling has been planned for that date. The CJI initially filed an emergency motion to prevent the planned dismantling of the camp on June 10. During the legal proceedings, lawyers argued that an eviction would cause those living there serious harm and shouldn't be done when shelters are overflowing. Lawyers for the City of Montreal and the MTQ, on the other hand, said there are safety issues associated with the camp, like the building of permanent structures, an increase in the number of tents and frequent interventions by police and the fire brigade. Court grants delay on dismantling homeless encampment in Montreal's east end
A judge has granted another injunction against the dismantling of a homeless encampment on Notre-Dame Street in Montreal's east end. The removal of the tents will not happen before July 10, when lawyers from the Clinique juridique itinérante (CJI), the city, and the provincial transport ministry will be back in Superior Court. The CJI, which represents the people living in the encampment, had argued that an eviction would cause serious harm and shouldn't be done when shelters are overcrowded. The tents are located along Notre-Dame between Pie-IX Boulevard and St-Clément Street in the city's Mercier–Hochelaga-Maisonneuve borough. Meanwhile, lawyers for the City of Montreal and the Ministry of Transport argued in the legal proceedings that the tents raise safety concerns, including the frequent interventions from the police and fire services. (Graham Hughes / The Canadian Press) The encampment on Notre-Dame Street in Montreal cannot be dismantled for the next 10 days, a Quebec Superior Court judge ruled on Wednesday. In his decision, Judge Babak Barin ordered Quebec's Ministry of Transport and Sustainable Mobility (MTQ) to temporarily 'cease all efforts to evict homeless people living along Notre-Dame Street East.' This comes after the MTQ posted notices on June 5, 'on trees and tents belonging to some 30 marginalized and vulnerable people in Montreal' without prior warning, according to court documents. The messages warned that an eviction and complete cleaning of the area would be carried out by June 10. 'We invite you to gather your personal belongings and leave the site,' the directives stated. 'Please note that after this date, any items left behind will be discarded without further notice.' In response, the Clinique juridique itinérante (CJI) filed an emergency motion to prevent the dismantling, arguing that it would cause serious harm to the campers. It also pointed out that with shelters overflowing, the people would have nowhere to go. Contrarily, lawyers for the City of Montreal and the MTQ stressed that they were concerned about safety, including the accumulation of large structures on the site, like tents, and the frequency of police and firefighter interventions. The Superior Court judge ruled in favour of the CJI and approved the temporary injunction.
