Over 200 tribal families in KNP limits lack basic amenities: Adivasi Hakkagula Samanvaya Samithi
Adivasi Hakkugala Samanvaya Samiti on Sunday lamented that tribal families residing within the Kudremukh National Park in Belthangady taluk lack basic amenities, including road connectivity and power supply. Shekhar Laila, convener of the samithi's Belthangady taluk unit, raised the issue at the SC/ST grievances redressal meeting convened by the Mangaluru City Police Commissionerate and Dakshina Kannada District Police here. He said more than 210 tribal Malekudiya families residing in nine villages were deprived of basic amenities in the taluk. Superintendent of Police K. Arun said that he would write to authorities concerned regarding the urgent need for road connectivity and footbridges for the residents. Mr. Laila also raised the issue of 18 Group 'D' staff working on contract basis at the Belthangady taluk hospital receiving salary once in three or four months and not getting even a single day leave in a month. The Superintendent of Police said that he would take up the issue with the District Health Officer. In another instance, seven Koraga families of Atrinje at Sulkeri in Belthangady taluk were deprived of an all-weather connectivity infrastructure, as a bridge was built 21 km away from their habitat. Another participant highlighted the plight of 13 Dalit families residing in Nirde and Ajakala of Balnadu village, Puttur taluk, who continue to lack proper road access to their houses. He said pregnant women, patients, and other residents face immense difficulty. Though the issue was brought to the Deputy Commissioner's notice, no action was taken. Police Commissioner Sudheer Kumar Reddy clarified that any issue concerning SC/ST communities, including harassment or atrocities, may be reported to the nearest police station, which will conduct a preliminary inquiry before transferring the case to the Directorate of Civil Rights Enforcement (DCRE). Those who are in distress can directly approach the DCRE, he added.

DCRE to look into promotion grievances of SC/ST officials
BENGALURU: The Directorate of Civil Rights Enforcement (DCRE) has initiated action to address allegations that Dalit (SC/ST) officials in the state government are being denied promotion opportunities. The move follows a letter from Congress president Mallikarjun Kharge to Chief Minister Siddaramaiah, urging him to address the issue without delay. The matter caused embarrassment for the ruling Congress government as it coincided with the AICC OBC Advisory Council meeting taking place in the state capital. Karnataka State Government SC/ST Employees' Association president D. Chandrashekaraiah had initially submitted a memorandum to the Chief Minister, seeking his intervention. However, after receiving no response, he approached Kharge directly. In his letter dated 6 July, Kharge advised the Chief Minister to resolve the issue to ensure the smooth functioning of the government.

Courts must remain vigilant against weaponisation of criminal laws: Karnataka High Court
Courts must remain vigilant against the weaponisation of criminal law for settling civil disputes as the law, when misused, ceases to be a shield and becomes a sword, said the High Court of Karnataka while quashing a criminal case registered against a man by his business partner by invoking provisions of the SC/ST (Prevention of Atrocities) Act, 1989, to settle a financial dispute. 'The complainant to take revenge or arm twist the petitioner for financial dispute, has made use of the criminal justice system. The subject complaint is a blade of vengeance, cloaked in the garb of law,' the court observed. Justice M. Nagaprasanna made these observations while quashing the criminal proceedings against Vilas Bhormalji Oswal on a complaint lodged by his estranged business partner Somashekara of Bengaluru. Case background Mr. Oswal and Mr. Somashekara were partners in Green Land Infra, a real estate development firm established in 2011, with the former being authorised signatory of the firm and the latter being the managing director. However, certain differences cropped up between them leading to closure of the business in 2016 resulting in unresolved disputes. Meanwhile, Mr. Somashekara, who is a Scheduled Caste (SC), lodged a complaint with the Directorate of Civil Rights Enforcement (DCRE) in April 2021 alleging that Mr. Oswal had made a casteist remark against him in December 2020. However, the DCRE had not acted on the complaint for nearly three years. Interestingly, the DCRE in February, 2024, recorded the statement of Mr. Somashekara and in March 2024 recorded the statements of two witnesses, known to Mr. Somashekara, who stated that they were present when Mr. Oswal allegedly abused the complainant. After recording the statements, the DCRE forwarded the complaint to the Jayanagar police in April 2024 for registering the criminal case. The police, after investigation, filed the charge sheet against Mr. Oswal and a trial court took cognisance of offences against him in June, 2024. However, the HC pointed out that the only allegation against Mr. Oswal in the complaint was that he told Mr. Somashekar at the playground, 'do not show your casteist mindset' and there was no allegation that the petitioner abused Mr. Somashekar by taking the name of his caste or that the so-called abuse was made in front of two persons, who were treated as witnesses after four years. Not in complaint 'The so-called eyewitnesses again are to be held to have been procured later, as there is no narration in the complaint that the incident was witnessed by two eyewitnesses nor the eyewitnesses would say that they accompanied the complainant to the ground,' the court observed while stating that if this case is permitted to proceed on these glaring facts, it would amount to an egregious abuse of legal machinery.

M'luru range to get robust DCRE police stations
Mangaluru: With the Karnataka govt setting up 33 dedicated Directorate of Civil Rights Enforcement (DCRE) police stations across the state to handle cases under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, work is on to strengthen four such stations in the Western Simon CA, DCRE Mangaluru range, said that the range comprising four police stations in Dakshina Kannada, Udupi, Chikkamagaluru, and Uttara Kananda, which report an average of 25-30 atrocity cases every month, is also focusing on improving the conviction rate. Under the direction of ADGP Arun Chakravarthy, efforts are being made to ensure timely legal aid and compensation to victims, along with thorough investigation to ensure justice, he the DCRE in the range currently operates with about 60–70% of its sanctioned constable strength, the department remains hopeful that more senior officers will be appointed soon to bolster its functioning."The DCRE stations will actively reach out to SC/ST communities to raise awareness about the provisions of the act, and will work in coordination with the social welfare department to ensure eligible beneficiaries receive due support," he DCRE staff review all ongoing atrocity cases regularly. "Every day, reports on cases registered under the act are collected from all police stations in the range and submitted to the headquarters in Bengaluru," he dedicated stations now in place, DCRE officers have full authority to investigate all atrocity-related cases, expediting the legal process. While the DCRE earlier focused mainly on cases like fake caste certificates, it now handles a wider range of atrocity cases. Community members can file complaints at the nearest police station, which are then transferred to the DCRE for investigation. In the 2023-24 budget, chief minister Siddaramaiah announced measures to strengthen the functioning of the DCRE.
