'Religious Claims Can't Justify Land Grab': Bombay HC Refuses To Recall Demolition Of Illegal Dargah
The court said assertions based on 'mob fury' or 'footfalls of people' cannot lend legitimacy to an illegal structure raised without any municipal permission. The Bombay High Court has refused to grant relief to a trust that sought protection for a structure it claimed was a historic Dargah, reiterating that no religious or charitable claim can override legal ownership and statutory compliance. Dismissing an interim application, a division bench of Justices AS Gadkari and Kamal Khata made it clear that assertions based on 'mob fury" or 'footfalls of people" cannot lend legitimacy to an illegal structure raised without any municipal permission. The application was filed by Gazi Salauddin Rehmatulla Hoole, representing a registered trust, seeking recall of the Court's earlier April 30 order which directed the demolition of a 17,610 sq. ft. structure on land owned by New Shree Swami Samartha Borivade & Anr. The trust claimed the structure was a Dargah dating back to 1882, based on entries in a government gazette, a 1982 sale deed, land records from 1989, and registration under the Charity Commissioner. However, the court noted that none of these documents proved ownership or sanctioned construction. The trust had also failed to produce a single valid municipal permission. 'Such defence cannot give right to an applicant to claim protection or continuation of a thoroughly illegal structure," the bench held. According to the Thane Municipal Corporation (TMC), no permission had ever been granted for any construction on the site. Following dismissal of a civil suit in April 2025 which had challenged ownership of the land, the Corporation had issued a notice asking the trust to produce documents, none were submitted. The High Court criticised the trust for delaying tactics and said the application was an attempt to frustrate its demolition orders. 'This is a classic case of usurpation of the land… we are unable to accept that mere footfalls of people based on an assertion that this is a Dargah can prove that it is a legal structure," court observed. Court also rejected the argument that the trust was denied a hearing. It pointed out that a hearing had already been conducted in January 2025 under the MMC Act, and a subsequent demolition order was passed following due process. The bench further stated that even if the structure appeared in past land records or was referenced in sale deeds, those entries did not establish title, ownership, or legality. 'The applicants have entirely failed in proving they own the land or have permission… even for one square foot," court said. Finding no merit in the plea, court directed the Thane Municipal Corporation to proceed with the demolition and complete it within two weeks from the date of the order's uploading. view comments First Published: July 24, 2025, 17:13 IST Disclaimer: Comments reflect users' views, not News18's. Ajmer Dargah's 'no liability' notice draws flak from Muslim groups
Ajmer dargah AJMER: A public notice issued by the nazim (chief executive officer) of Ajmer Dargah disowning responsibility for accidents caused by dilapidated structures within the shrine complex, has triggered widespread anger among Muslim organisations and the community's religious heads. The notice, dated July 21, was pasted inside Dargah premises, warning devotees to avoid old or structurally weak buildings that may collapse during heavy rains. It stated, "In case of any accident or untoward incident, the individual will be solely responsible. The nazim office will not accept any legal liability." The language and tone of the notice have been condemned by organisations from Delhi to Hyderabad, including the Jamiat Ulama-e-Hind, All India Muslim Council and the Muslim Progressive Front (Rajasthan). Several groups have demanded an immediate withdrawal of the notice and called on the ministry of minority affairs to launch an inquiry into the matter. TOI texted and called Nazim Bilal Khan for a statement, but received no response. The Ajmer Dargah Committee functions under the ministry of minority affairs and the episode has renewed calls for greater accountability, transparency and professional oversight in the management of India's major religious heritage sites. Sohail Khandwani, managing trustee of Haji Ali and Mahim Dargah in Mumbai, who is currently overseeing renovation work at Haji Ali, expressed dismay: "I came across the letter. I was shocked to learn that the nazim hasn't even identified which buildings are structurally unsafe, nor have any warning signs been placed. Simply issuing a letter will spark fear among devotees." The Dargah receives 20,000 devotees on normal days, which jumps up to a lakh on Thursdays and Fridays. Syed Nadeem Hasan Nizami, chief in-charge of Hazrat Nizamuddin Auliya Dargah in Delhi, called the notice a "hallmark of shamelessness and administrative negligence." He said, "Asking devotees to survey the complex, identify weak structures and then decide whether to proceed with ziyarat (visit the shrine) is absurd. What exactly is the Dargah nazim's role then? He should resign. I appeal to PM Narendra Modi to appoint qualified professionals with experience in management, auditing and public safety. " The notice follows incidents of roof collapse and water seepage in at least three mosques within the Dargah complex in the past week.

Mosque serves Murugan devotees; rekindles Thirupparankundram's spirit of unity
Madurai: Months after tensions surfaced in Thirupparankundram over claims related to hill ownership and religious practices, the town witnessed a heartening display of communal harmony on Monday. Tired of too many ads? go ad free now As thousands gathered for the Kumbabishekam (consecration) of the Arulmigu Subramaniaswamy Temple, the nearby Hazrat Sultan Sikandar Badusha Dargah association opened its mosque's doors to serve drinking water and food to temple devotees. Volunteers from the Dargah distributed refreshments and offered annadhanam to devotees, who responded with warmth and gratitude. The act stood out as a symbol of Thirupparankundram's enduring social fabric, where both communities have long coexisted. "We didn't do this to prove anything about religious harmony," said M Arif, secretary of the Thirupparankundram Jamath. "We've been doing this for years — during milk pot processions, car festivals, and major temple events. People here never made us feel different, and we've always been proud to contribute." For devotees, the gesture was moving. "This is the kind of unity our children should grow up seeing," said M Shakti, 45, of Avaniyapuram. "Faith doesn't divide us; it brings us together." A Abudahir, a senior member of the Jamath, noted that many Muslim families regularly contribute to annadhanam during temple festivals. "Some even believe donating to such causes brings blessings to their homes. Faith may differ, but goodwill is universal," he said. In a town that recently faced communal friction, the gesture stood as a quiet, powerful reminder: harmony isn't declared — it's lived. MSID:: 122443018 413 |

Bahraich mazar demolition: HC seeks state's response on contempt plea
The Lucknow bench of the Allahabad high court has sought the state government's response on a contempt petition alleging that the Uttar Pradesh government violated an earlier assurance given to the court that no coercive action would be taken against the Dargah Hazrat Sayyed Mohammad Hashim Shah (also known as Lakkad Shah Mazar) situated in Bahraich district. On June 10, UP govt had informed the high court that it had stopped the demolition drive at Lakkad Shah and three other mazars situated in the Murtiha Range forest of Katarniaghat Wildlife division. (For Representation) Justice Brij Raj Singh on June 25 directed the state counsel to seek instructions in light of the allegations made in the contempt plea directing to list the matter as fresh on July 3, 2025. 'Learned counsel for the applicant will serve a copy of the contempt application to the learned Standing Counsel today, who is directed to seek instructions in the matter as there is allegation that there is violation of the undertaking given by the learned Additional Chief Standing Counsel in the order dated 10.06.2025 passed in Writ-C No.5870 of 2025,' the court ordered. The contempt plea moved by the committee of management Dargah claimed that despite the state's categorical submission before the court on June 10, 2025, that the demolition had been stopped and no coercive steps would be taken for the next four weeks, the structure was fully razed on June 13. Earlier, on June 10, the UP government had informed the high court that it had stopped the demolition drive at Lakkad Shah and three other mazars situated in the Murtiha Range forest of Katarniaghat Wildlife division in Bahraich. The state had also assured the court that no further demolition or coercive action would be taken for a period of four weeks. This assurance was recorded by a division bench of Justice Saurabh Lavania and Justice Syed Qamar Hasan Rizvi, which was hearing a petition filed by the managing committee of Waqf No. 108, which oversees the dargah where Urs has reportedly been celebrated since the 16th century. The committee had moved the HC after the forest department initiated the demolition of these mazars, citing encroachment on protected forest land under the Indian Forest Act, 1927. In the contempt plea, the waqf committee has alleged that on June 13, just 3 days after the state's assurance, the police personnel took the caretakers of the mazar and other people into custody and dropped them nearly a kilometre away from the site. The plea further alleges that demolition at the site resumed soon thereafter and that the entire structure was razed and now only the graves are intact. The plea also accuses the authorities of wilful and deliberate breach of the undertaking and flouting the court's direction of maintaining the status quo at the site.
