Create Account Lululemon Athletica claims in its lawsuit filed in the U.S. District Court for the Central District of California that Costco has 'unlawfully traded' on its reputation, goodwill and sweat equity by selling unauthorized and unlicensed apparel that uses knockoff, infringing versions of its patents. Lululemon alleges that Costco is known to use manufacturers of popular branded products for its private label Kirkland brand, but that the company and the manufacturers don't tell consumers of the connection between them for many of the Kirkland-branded products. Because of this, Lululemon claims this leads at least some shoppers to believe that Kirkland-branded products are made by the authentic supplier of the 'original' products. Some of the products Lululemon says Costco is making duplicates of include its popular Scuba hoodies, Define jackets, and ABC pants. Lululemon claims one of the duplicates that Costco sells is the Hi-Tec Men's Scuba Full Zip, with the lawsuit showing a screenshot image of Costco's website showing the item priced at $19.97. Costco, based in Issaquah, Washington, did not immediately respond to a request for comment on Tuesday. Lululemon is requesting a jury trial and wants Costco to stop selling the products that it considers to be duplicates. It is also seeking an unspecified amount in monetary damages. Lulemon was in a similar legal dispute with Peloton in 2021. The NWS said that "hot and stagnant conditions will allow ozone to reach the unhealthy for sensitive groups category." It added: "If possible, please help up reduce ozone pollution by limiting driving gas and diesel-powered vehicles until at least 4 p.m." The CDPHE said that people who are "unusually sensitive" to ozone should reduce prolonged or heavy outdoor exercise, and that everyone else should consider reducing outdoor activity. Meanwhile, an air quality alert has also been issued for Atlanta on Thursday. The Georgia Department of Natural Resources' Environmental Protection Division issued a Code Orange alert, meaning outdoor air quality is likely to be unhealthy for certain people. "Children, people who are sensitive to ozone, and people with heart or lung disease should limit prolonged outdoor exertion during the late afternoon or early evening when ozone concentrations are highest," a statement issued by NWS said. What People Are Saying The CDPHE said on its website: "Ground-level ozone is an air pollution problem that impacts the health of all Coloradans. Exposure can cause acute respiratory problems and trigger asthma attacks. During Ozone Action alerts, avoid rigorous outdoor activity during the heat of the day. Prolonged exposure can cause long-lasting damage to your lungs. "You can make a difference by doing your part to improve air quality along Denver's Front Range. Even during periods of wildfire smoke, reducing your personal emissions can help decrease ozone production. Combining or skipping just two car trips a week has a positive impact on our air quality." Jonathan Grigg, professor of pediatric respiratory and environmental medicine at Queen Mary, University of London, told Newsweek previously that there are "very clear links" between inhaling particles and earlier death from both respiratory and cardiovascular diseases. He added: "There are vulnerable groups and classically they are children because they've got an extra issue to do with their lungs developing, whereas our lungs are not developing as adults." Create Account The National Highway Traffic Safety Administration said Dearborn, Michigan-based Ford is recalling 197,432 Mustang Mach E midsize SUVs, model years 2021-2025. The government agency that regulates automobile safety said that the electronic door latches may remain locked after a driver or front seat passenger exits the vehicle and shuts the door, potentially trapping a child or other passenger who is unable to use the interior door releases. The NHTSA said letters notifying owners of the safety risk were scheduled to be sent on June 23. Ford dealerships will fix the problem by updating the vehicles' software, with the remedy expected to be available by late September. Owners may contact Ford customer service at 1-866-436-7332.
