NGT takes suo motu cognisance of Express report on garbage crisis in Southeast Delhi
The National Green Tribunal (NGT) has taken suo motu cognisance of a report by The Indian Express on uncollected garbage choking parts of Southeast Delhi, observing that localities such as Shaheen Bagh and Sarita Vihar are facing a 'serious garbage problem' that's affecting the daily lives of residents. A three-member bench led by Chairperson Justice Prakash Shrivastava Wednesday registered the case based on the June 12 report, titled, 'We can smell it even inside our homes: Southeast Delhi localities choke on garbage'. In its order uploaded Thursday, the Tribunal quoted extensively from the news report, which highlighted how delays in municipal decisions have left garbage piling up for days across several colonies. 'The article states that garbage has been left uncollected for many days, causing bad smells and health problems. In Shaheen Bagh, streets that usually have food stalls now smell like rotten trash. The article also mentions that on High Tension Road, also called 40-futta, big garbage piles near homes have many flies around them,' the Tribunal noted in its order. Citing resident complaints, the NGT recorded: 'People say they can't walk outside without covering their faces, and the bad smell comes inside their houses too.' The order attributed the garbage crisis to delays in renewing the Rs 900-crore contract with Dakshin Dilli Swachh Initiatives Limited (DDSIL), the private firm handling waste collection. The contract ended in November 2023 and has only been extended temporarily. The delay, as per the report and noted by the Tribunal, was due to the stalled formation of the MCD Standing Committee, which is needed to approve large financial decisions. The committee — an 18-member body without whose approval no proposals exceeding Rs 5 crore can be cleared — was recently constituted after a delay of two-and-a-half years. 'The article explains that the delay in forming the MCD Standing Committee… is stopping the contract from being renewed or payments being made. Because of this, DDSIL and MCD have stopped collecting garbage,' the NGT said, adding that councillors and officials quoted in the report had pointed to a shortage of working trucks and no viable solution until the Standing Committee is constituted. The Tribunal said the matter 'raises substantial issues relating to compliance with environmental norms and implementation of the provisions of scheduled enactment,' and may attract provisions of The Environment (Protection) Act, 1986, The Solid Waste Management Rules, 2016, The Air (Prevention and Control of Pollution) Act, 1981, and the Delhi Municipal Corporation Act, 1957. The Tribunal has issued notices to the Central Pollution Control Board, Delhi Pollution Control Committee, Municipal Corporation of Delhi, and the District Magistrate of Southeast Delhi, directing them to submit their responses by October 1.

Nominated councillors to get development funds
In a landmark decision, the Delhi Municipal Corporation has approved a proposal to allocate development funds to nominated councillors, commonly referred to as aldermen, putting them on par with elected councillors for the first time in the city's history. Until now, only elected councillors received financial support under the Councillor Local Area Development Fund to carry out civic works in their wards. However, a recent proposal passed by the MCD House has extended the same funding privileges to the ten nominated councillors appointed by the Lieutenant Governor of Delhi. These aldermen, although unelected, have long held the right to attend and speak in corporation meetings and participate in zone-level discussions. However, the absence of funding limited their ability to initiate or oversee developmental work. The newly passed provision now allows nominated councillors to receive equal funding whenever allocations are made to elected members. This move is expected to empower them to address civic issues directly within the Municipal Corporation of Delhi (MCD) areas. Nominated councillor Manoj Jain welcomed the decision, calling it a much-needed and practical step. 'People approach nominated councillors with problems related to parks, street lighting, and broken pavements. Earlier, we could only raise these issues-now we'll be able to solve them,' Jain said. He noted that in areas like Daryaganj, where the elected representative is from the Aam Aadmi Party, several local issues were overlooked. 'I have already secured approval for road and park repairs there through my efforts,' he added. According to the Delhi Municipal Corporation Act, Section 3(3)(b)(i), ten individuals above the age of 25 with special knowledge or experience in municipal affairs are nominated by the Administrator (Lieutenant Governor) to serve as councillors. While these nominated councillors cannot vote in the main corporation meetings, they are allowed to vote in ward committee matters and in elections to the MCD Standing Committee, and can even stand as candidates for that influential body.

The 64-year-old leader said he will bring a proposal in the Vidhan Sabha to effectuate this and make a demand from Chief Minister Rekha Gupta. 'I will raise the issue in the assembly for buildings under the Delhi government and will meet Prime Minister (Narendra) Modi and Home Minister Amit Shah for the buildings of the central government.' 'Saffron is the colour of God. We want all the buildings in Delhi, including shops, to be painted saffron,' he told ThePrint, adding that in the coming time the whole city will become Ram-maya (drenched in the colour of Lord Ram). Marwah, who was with the Congress before switching to the Bharatiya Janata Party (BJP) in 2022, said the campaign to paint the buildings saffron is related to faith. 'This is my personal campaign. The Kanwar yatra begins from 11 July. The BJP legislator, a member of the Delhi Sikh Gurudwara Management Committee, said the shutting of meat and liquor shops is necessary to uphold the sanctity of the annual pilgrimage. 'We appeal that meat and liquor shops on the designated routes of the Kanwar Yatra are temporarily shut so that its sanctity is maintained and there are no untoward incidents,' reads his letter. ThePrint has seen the copy of the letter. Marwah also wrote to the CM last month for shutting down meat and liquor shops along the Kanwar route. Meanwhile, reviewing the preparation for the Kanwar Yatra, Culture and Tourism Minister Kapil Mishra said Wednesday the Delhi government has decided to shut meat shops on the Kanwar route. 'The decision on meat shops is a decision of the Delhi government and the Municipal Corporation of Delhi (MCD). It has been decided that they will remain shut,' Mishra told the media. But on Thursday, the MCD said there is no provision to shut shops on Kanwar Yatra under the Delhi Municipal Corporation Act, 1957. MCD set to hire new agencies to remove garbage
Residents of at least three zones in the Capital – West, South, and Central – will soon breathe in cleaner air, with the Municipal Corporation of Delhi (MCD) planning to remove piles of garbage and ensure regular sanitation. As part of three Bills passed by the MCD House on Thursday, the civic body proposed hiring new agencies to collect and transport municipal solid waste to the designated MCD dump site or processing facility. A concessionaire will be appointed for seven years, based on the tipping fee model. The move comes after the tender of the previous concessionaire expired almost two years ago. Since then, the MCD has given an extension to the concessionaire. The scope of work will include door-to-door and street-to-street collection of trash; collection and transportation of street sweeping waste and silt from drains of less that 4-ft depth; use of e-rickshaws in areas having narrow lanes, as well as appointing two tippers in each ward in addition to the already existing Fixed Compactor Transfer Station – a machine designed to compact segregated solid waste. In all, 29 Bills were passed by the House on Thursday. Another Bill passed pertained to owners of medium, small and micro enterprises (MSME), operating in industrial areas, obtaining or renewing factory licences while paying property taxes, in line with the government's ease of doing business policy. Additionally, the factory licence fee will be charged at 5% of the property tax, said officials. 'Issuing factory licences by MCD to industries operating in industrial areas established or recognised by the Government of National Capital Territory of Delhi (GNCTD) or Delhi State Industrial and Infrastructure Development Corporation (DSIIDC) is an additional compliance burden,' said the civic body. It added that from now on, the MSME Udyam Registration Certificate or the allotment or lease deed issued by GNCTD or DSIIDC will be treated as a deemed factory licence under the Delhi Municipal Corporation Act, 1957. 'We had an elaborate discussion with representatives of the industrial sector and came to this decision of ending the Inspector Raj system,' said Mayor Raja Iqbal Singh.

MCD planning to simplify process for issuance of factory licences
New Delhi: Under its ease of business model, Municipal Corporation of Delhi is working on policy modifications to streamline the process of obtaining or renewing factory licences and reduce bureaucratic complexities. The decision was taken after rounds of meetings with traders. A joint meeting was also held with the representatives of Laghu Udhyog Bharti (Delhi State) on Tuesday, which was attended by mayor Raja Iqbal Singh and MCD commissioner Ashwani Kumar. According to sources, a draft proposal submitted by the factory licence department suggests that the MSME Udyam registration should be considered equivalent to MCD's permission or licence for micro, small & medium enterprises operating in industrial zones established or acknowledged by Delhi govt or Delhi State Industrial & Infrastructure Development Corporation (DSIIDC). For larger units in these areas, too, the proposal, which will be tabled in a house meeting for approval, has also made the same recommendation. The department has also recommended synchronising the licence fee payment with the annual property tax collection schedule. Previously, following directives from the lieutenant governor and the chief minister, MCD removed the requirement for a no-objection certificate from police for seven trade activities. According to the proposal, while the department issues licences under sections 416-417 of Delhi Municipal Corporation Act, several industrial area associations and industry bodies have underlined the need for reforms to end the licence raj. "Though the abolition of licence will entail an amendment in DMC Act 1957, it will be appropriate to recognise the MSME Udyam registration or lease letter issued by GNCTD or DSIIDC as the factory licence as an interim step," it stated. "Industrial areas are anyway meant for running industries or factories. Further, MCD provides civic services to all areas, not just to industrial areas. So the process for obtaining an MCD licence should be simplified," said traders.
