Standoff with DM: Alld HC stays suspension of Kanpur CMO
Lucknow: The Lucknow bench of Allahabad High Court has stayed the suspension of Chief Medical Officer (CMO), Kanpur, Dr Haridutt Nemi, who had been placed under suspension by the state govt following a high-profile bureaucratic standoff with district magistrate Jitendra Pratap Singh.
The court has granted four weeks to the state govt for filing its counter affidavit.
A bench of Justice Manish Mathur passed the order on the writ petition filed by Nemi. The petitioner has challenged the suspension order passed on June 19, 2025 .
Petitioner's counsel LP Mishra argued that the CMO was suspended without initiation of any inquiry or in contemplation of enquiry. It was submitted that even otherwise the allegations as levelled in the impugned order, ex-facie would not result in any major penalty and therefore suspension could not have been resorted to in terms of the UP Govt Servants (Discipline and Appeal) Rules 1999.
In its order, the court observed, "Prima -facie, submissions advanced by the petitioner's counsel have force and require consideration."
