BJP leader Sambit Patra seeks apology from Congress for Emergency-era actions

Jun 28, 2025 05:42 PM IST The BJP on Saturday cited the then prime minister Indira Gandhi's comments questioning the usefulness of the Indian Constitution and her assertion of changing it to hit back at the Congress amid a row over the RSS' stand that the presence of terms like "socialist" and "secular" in the Preamble should be reviewed. Sambit Patra cited reports of the Emergency-era which quoted Indira Gandhi from her press conference and address to convey her critical take on the Constitution.(ANI) BJP spokesperson Sambit Patra said the Congress should not divert from the Emergency-era excesses on people and tender an apology. As the country observed the 50th anniversary of Emergency, it is imperative to discuss the sufferings the then government inflicted on people so that it is never repeated, he told reporters. He cited media reports of that period which quoted Indira Gandhi from her press conference and address to convey her critical take on the Constitution. She once spoke in favour of making basic changes in the Constitution and asked, at another occasion, if it serves democracy. Sweeping amendments were made in the Constitution during the 21-month period of the Emergency when people's fundamental rights were suspended and the executive was given vast powers with little judicial recourse. However, the subsequent Janata Party government undid most of the amendments. RSS general secretary Dattatreya Hosabole's recent demand that the inclusion of terms like socialist and secular to define India in the Constitution's Preamble during the Emergency should be reviewed, has triggered a row with opposition parties claiming that it shows the Hindutva organisation's distrust in the country's guiding document.

NCP (SP) leader Supriya Sule on Saturday called the Indian Constitution a product of extensive debate and asserted that nobody would be allowed to alter it. Sule said that in a democracy, everybody has the right to speak.(PTI) The Lok Sabha MP from Baramati was addressing a press conference in Nagpur. To a query about RSS general secretary Dattatreya Hosabale's recent call for reviewing the words 'socialist' and 'secular' in the preamble of the Constitution, Sule said that in a democracy, everybody has the right to speak. 'He said what he felt,' said Sule. Addressing an event on the 50 years of the Emergency, Hosabale had said, 'The preamble of the Constitution Baba Saheb Ambedkar made never had these words (socialist and secular). During the Emergency, when fundamental rights were suspended, Parliament did not work, the judiciary became lame, then these words were added.' Sule said such controversies remind her of late former BJP leader Arun Jaitley, who used to say that if 'you (media)' stopped spotlighting these incidents, people wouldn't talk about them. 'The Constitution is the result of much discussion and deliberation. We will not let anyone change the Constitution in this country,' she said. Asked about the raging controversy over Hindi for students in primary school, Sule asked, 'Is Hindi compulsory in Gujarat, Tamil Nadu, Kerala, Andhra Pradesh or Telangana? When Hindi is not compulsory everywhere, then why is it being made mandatory in Maharashtra?' The language row erupted after the state government last week issued an amended order stating Hindi will 'generally' be taught as the third language to students in Marathi and English medium schools from Classes 1 to 5. According to the order, if 20 students per grade in a school wish to study any other Indian language, they can opt out of Hindi. If such a demand arises, either a teacher will be appointed, or the language will be taught online. Opposition parties, however, dubbed the move a default imposition of Hindi as a third language.

The Srikakulam district president of the Congress, Ambati Krishna Rao, alleged that the Union government was misusing Central government organisations such as CBI, ED, Income Tax, Election Commission of India and other statutory bodies for its own political gains while ignoring the administration which is supposed to be done in accordance to the guidelines of the Indian Constitution. Along with party leaders, he participated in Samvidhan Bachao Abhiyan organised in Srikakulam on Saturday (June 28, 2025). He alleged that the Election Commission of India turned into a puppet in the hands of the Union government it was evident with huge difference between polled votes and voted counted during Maharashtra elections. He alleged that the ECI has been doing many mistakes intentionally in revision of voters' list in Bihar where Assembly elections would be held very soon. Mr. Krishna Rao has also alleged that the State government was also ignoring rules and regulations in its administration and putting the State in a debt trap. DCC vice presidents K.V.L.S. Eswari, Ijjorothu Ramana and others participated in the protest.

Chief Justice of India (CJI) BR Gavai stressed the importance of the Indian Constitution, stating that it has "defined the boundaries" of the three wings of government--legislature, executive, and judiciary. CJI Gavai highlighted that lawmaking is the responsibility of the legislature and state assemblies, while the executive functions within the framework of the Constitution and the law. Addressing the issue of "judicial activism," the CJI asserted that it is necessary for "upholding" the constitution and rights of the citizens. "Judicial Activism is bound to stay, and it is necessary for the upholding of the Constitution and the upholding of the rights of citizens. At the same time, I am of the view that the Indian Constitution has defined the boundaries of its three wings, whether it is the Legislature, the Executive, or the Judiciary. The work of making laws belongs to the Legislature, whether it is the Parliament or the various State Assemblies. It is expected that the Executive functions according to the Constitution and the law", CJI BR Gavai said while addressing an event in Nagpur on Friday. However, CJI Gavai opined that despite "judicial activism" being bound to stay in the judicial system, it should not be allowed to be converted into judicial adventurism or judicial terrorism. "If the Judiciary tries to interfere in the Executive and Legislative fields in every matter, then I always say, though Judicial Activism is bound to stay, it should not be permitted to be converted into Judicial Adventurism and Judicial Terrorism", BR Gavai said. The Chief Justice further stated that when a law is enacted beyond the authority of Parliament or a State Assembly, and it violates constitutional principles, it is imperative for the judiciary to step in. "When any law is made beyond the authority of Parliament or the Assembly, and it breaches the constitutional principles at that time, the Judiciary can step in", he said.

Paschim Medinipur (West Bengal) [India], June 28 (ANI): Bharatiya Janata Party (BJP) leader Dilip Ghosh on Saturday slammed West Bengal Chief Minister Mamata Banerjee for not taking sufficient action to prevent crimes against women in the state. Ghosh's comments come in the wake of the alleged gangrape case in Kolkata, which has sparked widespread outrage and protests. Speaking to ANI, Dilip Ghosh said, '... Mamata Banerjee does not see such incidents. Crimes against women are increasing in West Bengal, and women are afraid to step out of homes... TMC should at least condemn such acts...' Reacting to Kalyan Banerjee's controversial statement on rape, 'what can be done if a friend rapes his friend,' Ghosh said, 'He should be ashamed. He is a senior leader, lawyer... He should motivate people to protest against such incidents...' 'I am not an advocate into the incident that occurred at the Law College but the accused should be arrested. A few men commit this type of what can be done if a friend rapes his friend. Will the police be there in schools? This was done by students to another student. Who will protect her (victim)? This (South Calcutta Law College) is a government college. Will the police always be there?' Kalyan Banerjee told ANI. A female student was allegedly gang-raped inside a law college in Kolkata's Kasba on Wednesday. The police have arrested all three accused within 24 hours. The three accused, named as Monojit Mishra (31), Zaib Ahmed (19), and Pramit Mukhopadhyay (20), were former students or staff members of the same law college. According to the police, the accused named in the FIR will be produced before the ACJM of Alipore, South 24 Parganas, with a prayer to remand them to Police Custody for a proper investigation into the case. Ghosh backed RSS General Secretary Dattatreya Hosabale's remarks on the Constitution, and said that words like 'socialist' and 'secular' were not part of the original Preamble and will be removed when the time is right. He accused the Congress of insulting the Constitution 50 years ago and said the party. '... The constitution was insulted 50 years ago... Everyone should know about the way Congress, which talks of democracy, ran a bureaucratic rule... Terms like 'socialist' and secularism were not there in the preamble, and it will be removed at the right time, because it is against the theme of our constitution,' Ghosh said. RSS General Secretary Dattatreya Hosabale had questioned the legitimacy of including the terms 'socialist' and 'secular' in the Preamble of the Indian Constitution. (ANI)
