Sivaji Ganesan bungalow case: Financing firm withdraws plea
CHENNAI: The appeal against an order lifting attachment of parts of the T Nagar bungalow of late actor Sivaji Ganesan was withdrawn by the film financing firm Dhanabakkiam Enterprises following an out of court settlement of the money dispute between the firm and the actor's son Ramkumar and grandson Dusshyanth . The counsel for the finance company on Monday requested the first bench of Chief Justice KR Shriram and Justice Sunder Mohan to permit withdrawal of the appeal since an out of court settlement was reached between both parties. Subsequently, the bench disposed of the case. The appeal was filed against the order of the single judge (Justice Abdul Quddhose) passed on April 21, 2025 lifting another order to attach parts of the bungalow extending to 13,310 sq ft out of the sprawling 22 grounds and 440 sq ft bungalow and plot, for default of a loan availed by Ramkumar's son Dusshyanth Ramkumar. Dusshyanth had borrowed Rs 3.74 crore for his company, Eshan Productions, from Dhanabakkiam Enterprises in 2017 for meeting the expenses of production of the movie 'Jagajala Killadi'. When the money was not returned as per the agreement, the lender approached the court and an arbitrator was appointed. On May 5, 2024, he passed an order for payment of Rs 9.02 crore including interest. However, this order was not complied with. Dhanabakkiam Enterprises filed the execution petition seeking orders for attachment of properties as the judgment-debtors owe an outstanding amount of Rs 9.39 crore. However, Ramkumar's brother Prabhu filed an application in the court praying for lifting the attachment on the ground that the former did not have ownership in the bungalow and he was the sole owner. Allowing this application, the court lifted the attachment order.

Sivaji Ganesan's family settles loan dispute over Annai Illam house
Chennai: Actor Sivaji Ganesan's family has informed the Madras high court that they have reached a settlement in his grandson Dushyanth's loan dispute case. As a result, Danabhakiyam Enterprises, which earlier sought to seize Sivaji's 'Annai Illam' residence, has now withdrawn its appeal. Dushyanth borrowed ₹3 crore from Danabhakiyam Enterprises to produce a film titled 'Jagajala Killadi'. The company filed a case in the high court demanding repayment of ₹9 crore, including interest. Based on an HC directive, the matter was taken up for arbitration. The arbitrator, after hearing the case, ordered that all rights to the film 'Jagajala Killadi' be transferred to Danabhakiyam Enterprises. Following this, Danabhakiyam Enterprises filed a petition seeking enforcement of the order and also requested the seizure of 'Annai Illam' residence. Justice Abdul Quddhose, who heard the petition, ordered the seizure of the 'Annai Illam' house. However, actor Prabhu (Sivaji Ganesan's son) filed a petition stating that the house legally belonged to him as it was willed to him by his father, Sivaji Ganesan. He requested that the seizure order be cancelled. Danabhakiyam Enterprises informed the high court that a settlement was reached outside the court and that they wished to withdraw the appeal. The bench accepted the submission and granted permission to withdraw the appeal.

A single judge ruled in their favor, allowing the property to be attached. Actor Prabhu, however, filed a fresh petition asserting that Annai Illam was registered in his name and that his brother Ramkumar had no ownership rights. He urged the court to cancel the order. Madras HC lifts attachment order on Sivaji Ganesan's house
CHENNAI: The Madras High Court has lifted its order to attach parts of the late actor Sivaji Ganesan's bungalow in a loan default case involving his son Ramkumar Ganesan and grandson Dusshyanth Ramkumar. Justice Abdul Quddhose passed the order on Monday while allowing an application filed by Ramkumar's brother and actor Prabhu Ganesan, who claimed full ownership of the property. The court, on February 10, issued the order based on an execution petition filed by Dhanabakkiam Enterprises. The firm had lent Rs 3.74 crore in 2017 to Dusshyanth's company, Eshan Productions, to finance the movie 'Jagajala Killadi'. As the loan was not repaid, the firm approached the court and an arbitrator was appointed. On May 5, 2024, the arbitrator directed payment of Rs 9.02 crore, including interest. The order was not complied with, prompting Dhanabakkiam Enterprises to seek attachment of properties for recovery of Rs 9.39 crore. However, Prabhu approached the court stating that he is the sole owner of the bungalow and that Ramkumar has no share in the property. He submitted documents to support his claim. Following this, the court directed Ramkumar to file an affidavit, in which he confirmed he holds no stake in the bungalow. Going through the documents submitted, Justice Quddhose said, 'For the foregoing reasons, it is clear the applicant (actor Prabhu) is undoubtedly the absolute owner of the attached property and the respondents/judgment debtors do not have any right, title or interest in it.'

Court order to attach Sivaji's house recalled
Chennai: Madras high court on Monday recalled its order attaching house of the late actor Sivaji Ganesan in a case relating to default on a loan by his son, Ram Kumar, and grandson, Dusshyanth. Justice Abdul Quddhose recalled the order while allowing a plea moved by actor Prabhu claiming that his brother doesn't have any stake in their father's T Nagar house, ' Annai Illam '. On March 3, the court passed the attachment order on a plea moved by Dhanabakkiam Enterprises to execute a decree in its favour. According to Dhanabakkiam Enterprises, a loan of 3.75 crore was issued to Eshan Productions, represented by Dusshyant and his wife for producing a film 'Jagajala Killadi'. As Dusshyant failed to repay the loan, arbitration proceedings were initiated . A decree was issued in favour of Dhanabakkiam Enterprises to exploit all rights in connection with the film. Since the film could not be completed, the arbitral decree could not be executed by Dhanabakkiam Enterprises, prompting it to move an execution petition to attach Sivaji's house, in which Dusshyant's father, Ram Kumar, holds a share. It wanted the court to execute the arbitral award dated May 4, 2024. During the course of the hearing, the court was informed that Ram Kumar does not hold any stake in the house, and it wholly belongs to Prabhu.
