Supreme Court sets 3-month clock for Telangana Speaker to act on defecting MLAs

The Supreme Court on Thursday directed the Speaker of the Telangana Legislative Assembly to decide within three months on disqualification petitions against ten BRS MLAs who joined the ruling Congress party after the 2023 Assembly case stems from a delay of over seven months in acting on disqualification pleas, prompting the Court to step in. The top court warned that leaving such cases unresolved defeats the very purpose of the anti-defection law, famously observing: 'Operation successful, patient dead.'advertisementThe case comes after some MLAs, nicluding Tellam Venkata Rao, Kadiyam Srihari, and Danam Nagender, were elected on BRS tickets but later shifted to the Congress. BRS leaders KT Rama Rao, Padi Kaushik Reddy, and Kuna Pandu Vivekanand, along with BJP MLA Alleti Maheshwar Reddy, challenged the Speaker's inaction in the Telangana High a single-judge bench of the High Court directed the Speaker to fix a schedule for hearing the disqualification pleas within four weeks, the Division Bench later set aside that order, stating the Speaker could take a "reasonable time".The petitioners then approached the Supreme Court, which has now set aside the Division Bench's order and reinstated the Single Bench's direction, further tightening the bench of CJI DY Chandrachud and Justice AG Masih observed that Parliament entrusted disqualification powers to Speakers to avoid delays in courts, but ironically, Speakers themselves are now delaying Court pointed out that no notice had been issued on the disqualification pleas for over seven months — a delay it said cannot be considered 'expeditious' by any stretch, Live Law noted that Speakers act as quasi-judicial authorities under the Tenth Schedule and do not enjoy constitutional immunity while doing so. The Court also reminded that in Kihoto Hollohan, a landmark judgement, judicial review of the Speaker's decisions was permitted in a limited manner, especially when there is Court also barred the MLAs from trying to delay proceedings further and said adverse inference may be drawn if they attempt to do Court urged Parliament to review whether entrusting disqualification decisions to the Speaker continues to serve the purpose of curbing political defections. It stressed that this mechanism must be re-examined if the "very foundation of democracy" is to be safeguarded.'Though we do not possess any advisory jurisdiction it is for Parliament to take a call,' the bench said.- EndsTune InMust Watch IN THIS STORY#Telangana

KCR holds meeting after SC judgement on MLAs disqualification petitions; KTR asks party ranks to work for by-polls

Bharat Rashtra Samithi (BRS) has welcomed the Supreme Court judgement in the case of 10 party MLAs joining the ruling Congress party, asking the Speaker of the Telangana Legislative Assembly to complete the proceedings over the petitions filed seeking disqualification of the 10 MLAs. The 10 BRS MLAs who joined the Congress are Danam Nagender; Kadiyam Srihari; Tellam Venkat Rao; Pocharam Srinivas Reddy; M. Sanjay Kumar; Kale Yadaiah; Bandla Krishnamohan Reddy; T. Prakash Reddy; Arekapudi Gandhi and Gudem Mahipal Reddy. Working president of the party K.T. Rama Rao said in a statement following the verdict on Thursday (July 31, 2025) that the judgement had proved once against that the democratic system was vigilant in the country despite some elected representatives taking the wrong path. He expressed hoped that All India Congress Committee (AICC) leader and Leader of the Opposition in Lok Sabha Rahul Gandhi too would welcome the verdict since it was he — as part of the 'Paanch Nyay' promise made in the Congress party's election manifesto for the Lok Sabha elections — who was vocal for automatic disqualification of elected representatives in case of their defection. In case he was sincere about his commitment towards the promise, he must ensure that the 10 MLAs were disqualified. The BRS leader said there was no need for any further inquiry into matter since the 10 MLAs regularly participated in the ruling party programmes. The BRS would get ready for the by-elections in the 10 constituencies and he asked the party ranks to work for it. The party president and former Chief Minister K. Chandrashekar Rao had meeting with Mr. Rama Rao, T. Harish Rao, G. Jagadish Reddy and others at his Erravelli farmhouse following the Supreme Court judgement. Meanwhile, party Whip in the Assembly K.P. Vivekanand and party general secretary Soma BharAth Kumar said speaking to newspersons that the petitions against the 10 MLAs were pending with the Speaker for about 18 months now. They termed the Supreme Court judgement as historical and said it was a slap for the Chief Minister A. Revanth Reddy who had said in the Assembly that by-elections would be held for 10 seats, when the matter was pending in the Apex Court. The BRS leaders said that any delay in disposing of the disqualification petitions within three months by the Speaker would amount to contempt of court, as stated by the Supreme Court itself in its judgement making it clear that it was for the Speaker who must act on the petitions.

If BJP is genuine, it must legalise BC Reservation Bill: Kadiyam

Hanumakonda: Station Ghanpur MLA Kadiyam Srihari said on Thursday that the government is implementing welfare schemes that are not found anywhere else in the country. Along with additional collector Rohit Singh, he attended the ration card distribution at the tahsildar's office in Lingala Ghanpur mandal headquarters. They distributed ration cards to beneficiaries. Additionally, cheques for Rs 7,98,250 were distributed to 14 beneficiaries from the CM's Relief Fund in the mandal. Srihari demanded that if the BJP truly cares about the BCs, it should immediately provide legal backing to BC reservations. He accused the BRS of misusing power and pushing the State into deep debt. He questioned how many assets KCR, KTR, Harish Rao, and Kavitha had in 2014 and how many they now possess, implying massive accumulation of wealth through misuse of power. He alleged that this is why the entire Kalvakuntla family is entangled in legal cases, with one already jailed and others likely to follow soon. The MLA stated that the dream of ration cards for the public was realised only under the government. In Jangaon district, 9,700 ration cards were sanctioned, and 14,780 new members were added to the list. In the mandal 688 ration cards were sanctioned. He advised those who haven't yet received cards to apply immediately. He emphasised that only under the Congress are the poor getting justice, and praised the distribution of free fine rice as an unprecedented initiative in the country. Srihari accused the Opposition of criticising the government out of desperation. He remarked that those who are incapable of action often talk too much. He highlighted that the government holds record for waiving Rs 2,000 crore in loans in a single financial year. He announced new pensions would soon be sanctioned. He urged people to observe how those who were in power for the last 10 years are now embroiled in legal cases.
