Meta, Anthropic win legal battles over AI 'training.' The copyright war is far from over.
Artificial intelligence developers won marginal legal battles this week when federal judges in California ruled that Anthropic ( and Meta (META) could "train" large language models (LLM) on copyrighted books. But the larger war over AI developers' use of protected works is far from over. Dozens of copyright holders have sued developers, arguing that the developers must pay rights holders before allowing generative AI software to interpret their works for profit. Rights holders also argue that the AI output cannot resemble their original works. Rob Rosenberg, an intellectual property lawyer with Telluride Legal Strategies, called Tuesday's ruling siding with AI developer Anthropic a "ground-breaking" precedent, but one that should be viewed as an opening salvo. "Judges are just starting to apply copyright law to AI systems," Rosenberg said, with many cases coming down the pike. In that ruling, California US District Judge William Alsup said that Anthropic legally utilized millions of copyrighted books to train its various LLMs, including its popular chatbot Claude. However, the judge distinguished books that Anthropic paid for from a pirated library of more than 7 million books that it also used to train Claude. As for the stolen materials, the judge said, Anthropic must face the plaintiff authors' claims that it infringed on their copyrights. In a more limited ruling favoring Meta on Wednesday, California US District Judge Vince Chhabria said that a group of 12 authors who sued the tech giant, including stand-up comedian Sarah Silverman, made "wrong arguments" that prevented him from ruling on infringement. According to the authors, Meta used their copyrighted books to train its large language model Llama. The rulings are among the first in the country to address emerging and unsettled questions over how far LLMs can go to rely on protected works. "There is no predicting what's going to come out the other end of those cases," said Courtney Lytle Sarnow, an intellectual property partner with CM Law and adjunct professor at Emory University School of Law. Sarnow and other intellectual property experts said they expect the disputes will end up in appeals to the US Supreme Court. "I think it's premature for Anthropic and others like it to be taking victory laps," said Randolph May, president of the Free State Foundation and former chair of the American Bar Association's Administrative Law and Regulatory Practice section. US copyright law, as defined by the Copyright Act, gives creators of original works an exclusive right to reproductions, distributions, and public performances of their material, according to Sarnow, including some derivative works and sequels to their original creations. Absent a license from the rights holders to use their copyrighted material, all large language models are stealing from authors, she said. But under US law, a certain level of what would otherwise be deemed stealing is, in fact, an exception permitted under the doctrine of "fair use." That doctrine makes it legal to use the material without a license for commentary and critique, to reference it for news reporting and education, and to transform it into something new and distinct that serves a purpose different from the original form. Both Anthropic and Meta argued that training their LLMs on copyrighted material didn't violate the Copyright Act because the models transformed the original authors' content into something new. In his ruling, Judge Alsup reasoned that Anthropic's use of books was "exceedingly transformative" and therefore qualified as fair use under the Copyright Act. Rosenberg and Sarnow said it's too soon to tell how courts will ultimately rule on the issue. In cases where a "transformative" use is being used as a defense, LLM defendants need to show that their use of copyrighted material did not disrupt the market for the authors' original works. Judge Chhabria criticized Alsup's ruling, calling his analysis incomplete for "brushing aside" such market concerns. "Under the fair use doctrine, harm to the market for the copyrighted work is more important than the purpose for which the copies are made," Judge Chhabria said. Anthropic still faces some other big legal challenges. Reddit sued the company earlier in June. The suit alleges Anthropic intentionally scraped Reddit users' personal data without their consent and then put their data to work training Claude. Anthropic is also defending itself against a suit from music publishers, including Universal Music Group (0VD.F), ABKCO, and Concord, alleging that Anthropic infringed on copyrights for Beyoncé, the Rolling Stones, and other artists as it trained Claude on lyrics to more than 500 songs. The company faces more peril in the case where a judge determined it must face claims from authors that it infringed on their copyrights by paying for a pirated library of more than 7 million books. For copyright infringement, willful violations can result in statutory fines up to $150,000 per violation. If Anthropic were found liable for intentionally misusing the 7 million books at issue in its case, the maximum penalties could end up north of $1 billion. Three authors brought the case, requesting that the court grant their request to pursue their claims as a class action. The judge's decision on the class certification request is pending. "The judge did not give Anthropic a free pass," Rosenberg said. Meta wins AI copyright case filed by Sarah Silverman and other authors
Federal Judge Vince Chhabria has ruled in favor of Meta over the 13 book authors, including Sarah Silverman, who sued the company for training its large language model on their published work without obtaining consent. His court has granted summary judgment to Meta, which means the case didn't reach full trial. Chhabria said that Meta didn't violate copyright law after the plaintiffs had failed to show sufficient evidence that the company's use of the authors' work would hurt them financially. In his ruling (PDF), Chhabria admitted that in most cases, it is illegal to feed copyright-protected materials into their large language models without getting permission or paying the copyright owners for the right to use their creations. "...by training generative AI models with copyrighted works, companies are creating something that often will dramatically undermine the market for those works, and thus dramatically undermine the incentive for human beings to create things the old-fashioned way," he wrote. However, the court "must decide cases based on the evidence presented by the parties," he said. For this particular case, the plaintiffs argued that Meta's actions cannot be considered "fair use." They said that that their creations are affected by Meta's use because the company's LLM, Llama, is capable of reproducing small snippets of text from their books. They also said that by using their books for training without consent, Meta had diminished their ability to license their work for LLM training. The judge called both arguments "clear losers." Llama isn't capable of generating enough text straight from the books to matter, he said, and the authors aren't entitled to the "market for licensing their works as AI training data." Chhabria wrote that the argument that Meta copied their books to create a product that has the capability to flood the market with similar works, thereby causing market dilution, could have given the plaintiffs the win. But the plaintiffs barely touched the argument and presented no evidence to show how output from Meta's LLM could dilute the market. Despite his ruling, Chhabria clarified that his decision is limited: It only affects the 13 authors in the lawsuit and "does not stand for the proposition that Meta's use of copyrighted materials to train its language models is lawful." Another judge, William Alsup, also recently sided with Anthropic in a class action lawsuit also brought by a group of authors who accused the company of using their copyrighted work without permission. Alsup provided the writers recourse, though, and allowed them to take Anthropic to court for piracy.

ChatGPT could be silently rewiring your brain as experts urge caution for long-term use
Using ChatGPT on a long-term basis could have negative effects on brain function. That's according to a study led by the Massachusetts Institute of Technology (MIT), which found that using a large language model (LLM) to write multiple essays over a four-month period could hamper cognitive abilities. In the study, 54 participants were divided into three groups. The second group used only a search engine, and the third group used only their own brains, according to a press release from MIT. Then, in the fourth session, the LLM group was asked to write an essay without any tools, and the "brain-only" group was asked to use an LLM for assistance. During each session, the researchers recorded the participants' brain activity using an EEG monitor to assess their "cognitive engagement and cognitive load" and to determine their neural activity, the release stated. Brain Implant Breakthrough Allows Paralyzed Patients To 'Speak' With Their Thoughts The participants also provided their own individual feedback during interviews. Human teachers and an artificial intelligence agent scored the assessments. "EEG analysis presented robust evidence that LLM, search engine and brain-only groups had significantly different neural connectivity patterns, reflecting divergent cognitive strategies," the researchers wrote. Participants showed less brain connectivity when they used the tools to help write their essays, the study found. "The brain‑only group exhibited the strongest, widest‑ranging networks; the search engine group showed intermediate engagement; and LLM assistance elicited the weakest overall coupling," the researchers wrote. In the fourth session, the participants who switched from LLM to brain-only showed "weaker neural connectivity" and less cognitive engagement. The LLM group also had less ability to recall information from the essays they had just written. Those who switched from brain-only to LLM had "higher memory recall" and greater cognitive engagement. Based on these findings, the researchers said there could be a "possible decrease in learning skills" among LLM users. "The use of LLM had a measurable impact on our participants, and while the benefits were initially apparent, as we demonstrated over the course of four sessions … the LLM group's participants performed worse than their counterparts in the brain-only group at all levels: neural, linguistic [and] scoring," they wrote. The findings have been uploaded to Arxiv, a preprint service, but have not yet been peer-reviewed, as the researchers noted that "all conclusions are to be treated with caution and as preliminary." There were also a limited number of participants who were all from the same geographical area. Ai Tool Scans Faces To Predict Biological Age And Cancer Survival "For future work, it will be important to include a larger number of participants coming from diverse backgrounds, like professionals in different areas and age groups, as well as ensure that the study is more gender-balanced," the researchers noted. Only ChatGPT was used in the study; future research could incorporate other LLMs. The EEG technology used to analyze brain connectivity could also have some limitations, as the researchers shared plans to use fMRI (functional magnetic resonance imaging) in future studies. "Our findings are context-dependent and are focused on writing an essay in an educational setting and may not generalize across tasks," they also stated. "Future studies should also consider exploring longitudinal impacts of tool usage on memory retention, creativity and writing fluency." Dr. Harvey Castro, an ER physician and "AI futurist" based in Texas, said he sees this study as a "neuro-wake-up call," especially for younger brains. "ChatGPT can make you 60% faster, but that speed comes at the price of neuro-engagement," Castro, who was not involved in the study, told Fox News Digital. "Brain connectivity collapses from 79 neural links to just 42, and 83% of users can't quote their own essays minutes later. Neuroplasticity research tells us developing brains will feel this hit hardest." In emergency medicine, Castro said, doctors call this "failure to encode."
