Lawyer Nicholas Olson, who is representing Mr White, told the court that he would be seeking to have the subpoena set aside at a hearing or, failing that, applying for a suppression order over the court material. The second subpoena filed by Mr Latham for Ms Matthews will also be contested, with her lawyer telling Ms Horan that she would be filing an application to have the order set aside later next month. Tech billionaire Richard White has been entangled in court proceedings against one-time prime ministerial hopeful Mark Latham, who has been accused of a sustained pattern of abuse by his former partner. The matter appeared before the Downing Centre Local Court in Sydney on Wednesday, after Mr Latham's ex Nathalie Matthews filed an application for an apprehended violence order. Mr Latham has denied Ms Matthews' claims, saying he had "broken no laws". Ms Matthews, Mr Latham and Mr White were not present for the mention on Wednesday. Mr Latham's legal team, led by his lawyer Zali Burrows, plan to file individual subpoenas against Mr White and Ms Matthews as part of his defence against her application, the court was told. Richard White is the executive director and founder of WiseTech Global, a technology company providing logistic software for transport providers. The subpoenas were opposed by Mr White and Ms Matthews' lawyers. Lawyer Nicholas Olson sought to apply for the subpoena to Mr White to be set aside, or for there to be a suppression order over its contents. Magistrate Susan Horan ordered the parties to submit relevant written material before the matter returns to the court on September 10. Mr White stepped down as WiseTech's chief executive in October after allegations including bullying, misuse of company funds and failing to disclose close personal relationships to the board. A company-ordered review cleared him a month later. Mr Latham sits as an independent in the NSW upper house and has faced calls to resign over sexually explicit messages allegedly sent to his former partner while sitting in the parliament chamber. The state government plans to call for an inquiry into Mr Latham over unrelated alleged abuses of parliamentary privilege in August. The federal Labor caucus has agreed Mr Latham's official portrait will remain in its Canberra party room, but with a caption providing context about the former leader's departure from the party. The words underneath the portrait will read: "In 2017 Mark Latham was expelled from the Australian Labor Party and banned for life. His actions do not accord with Labor values and fail to meet the standards we expect and demand." Mr Latham lost his bid for the nation's top job at the 2004 federal election as former Liberal prime minister John Howard secured a final term. New Zealand captain Tom Latham will miss the opening Test against Zimbabwe with a shoulder injury and Mitch Santner will step in to lead the side, New Zealand Cricket said on the eve of the match beginning in Bulawayo on Wednesday. Latham suffered the injury while fielding during a T20 match for Birmingham in the Vitality Blast earlier this month and has not recovered sufficiently to be included in the playing 11, the NZC said. Latham will stay in Zimbabwe with New Zealand hoping he will be fit for the second test starting on Aug. 7. "It's hugely disappointing for Tom to be missing the first test, as captain but also as an integral part of the team," head coach Rob Walter said. "It's never great when you lose your captain, who's a world-class opening batter and a great team man, but that said we're going to work really hard to have him available for the second Test. "We'll continue to assess and see whether a replacement player is necessary, but at this stage we are hopeful that he'll recover in time." New Zealand have named a new captain for the first Test against Zimbabwe after regular New Zealand skipper Tom Latham was ruled out of the match due to a shoulder injury.
