Girl turns hostile & no evidence: Gurgaon man accused of rape walks free
Gurgaon: A man accused of raping a 10-year-old girl in Nov 2022 walked free as the girl and other witnesses turned hostile. The medical report and forensic evidence did not support allegations of rape. While acquitting the accused, a city court observed that "A person is presumed to be innocent until guilt is proved against him beyond all reasonable doubt. The prosecution failed to establish the guilt of the accused." A case was registered in Nov 2022 on the complaint of the minor's mother, alleging her daughter was sexually assaulted by the accused when they were out for work. In the complaint, the woman stated that the girl, along with her siblings, was returning home from the park when a man lured her by promising to give her a melon. However, during the trial, the mother of the victim changed her statement and said the minor was playing in the park when some unknown person misbehaved with her, and they ran away when she raised an alarm. She told the court that the man never committed any sexual act with the minor. The minor also changed her statement, as did the father of the minor. Sanjoy Mondal, a security guard at the park of Sector 17-A, said police had taken his signature on a blank paper, and he was not aware of any sexual assault. Manish Shandilya, counsel for the accused, said the accused never committed any sexual assault upon the victim. The allegations were in no way sustainable in court and were found to be vague during the trial. "The court rightly acquitted the accused, hence justice to the accused and his family, who suffered badly during the period of the case registration and trial," said Shandilya. Additional sessions judge of the fast-track special court under the POCSO Act, Gurgaon, Jasmine Sharma, in her order issued earlier this week, said the child victim, her parents, and Sanjay Mandal have not supported the prosecution version. All four witnesses in unison denied any offence by the accused and have stated that the accused never committed sexual assault upon the victim at any point in time. "An accused is presumed to be an innocent person unless and until guilt is proved against him beyond all the shadow of reasonable doubt," the court observed. "The prosecution has miserably failed to bring home the guilt of the accused," said the court and acquitted the accused of all the charges levelled against him.

Rs 15L via 71 bank transfers: No bail for man accused of rape, blackmail in Gurgaon
Gurgaon: A district court refused to grant bail to a man accused of raping a woman and forcing her to transfer Rs 15 lakh into his account. Gagandeep, originally from Punjab, forced the survivor to transfer money into his account over 71 times. The rape accused extorted the money by threatening to upload her objectionable videos and photos that were taken during the alleged assault. For three years, the accused had sexually assaulted the woman besides blackmailing her, according to the case diary. The woman went to Malaysia, but the exploitation and blackmail continued. On March 11, she lodged a complaint with the city police alleging rape, blackmail and extortion. The accused, in his 40s, was arrested from a hideout in a remote area of Jharkhand on April 20. The counsel for the complainant, Manish Shandilya, said, "If released on bail, he could pressure the witnesses." In her complaint, the survivor had alleged that in 2022, Gagandeep, who was a friend of her brother, met her, and they exchanged their mobile numbers. When he learnt that her husband would come at 7pm, he allegedly brought two small soft drink bottles and gave one bottle laced with sedatives to her to drink. After sometime, as she started feeling dizzy, the accused allegedly assaulted her and fled.
