Kota Kinabalu: A jobless man was charged in the Magistrate's Court here with injuring and threatening his younger sister. Insun Habbil, 33, who appeared before Magistrates Marilyn Kelvin and Dzul Elmy Yunus, pleaded not guilty to both charges. Advertisement For the first charge, Insun is accused of causing injury to his sister, Ailinah Habbil, 30, at 8.30am on July 6, at a house in Kampung Padas, Manggatal. The charge under Section 323 of the Penal Code, carries a maximum penalty of one year in jail, a fine of up to RM2,000, or both, on conviction. Magistrate Marilyn fixed Aug 26 for pre-trial case management (ptcm) and released the accused on bail of RM1,700 in two sureties with additional conditions, not to disturb the prosecution witnesses and to report to the nearest Police Station every month. Earlier, Inspector Yusri Basri, proposed bail at RM5,000 in two sureties. On the second charge, Insun is alleged to have criminally threatened Ailinah at the same time and place, with the intention of causing her to fear for her safety. The charge is under Section 506 of the Penal Code, which provides for a sentence of up to seven years in jail, a fine, or both, if convicted. Magistrate Dzul Elmy Yunus set Aug 21 for ptcm and offered Insun on a bail of RM1,600 in two sureties. In a separate case, a laundry worker was charged with having a stolen motorcycle. Mohammad Salleh, 36, claimed trial before Magistrate Marilyn Kelvin to keeping a stolen grey Yamaha 135LC motorcycle, belonging to Mohamad Al Hashemi Hasbullah, at 12.15pm on July 7, in Penampang. The charge under Section 411 of the Penal Code carries a jail term of between six months and five years, a fine, or both, on conviction. Trader fined for obstructing health officer

KOTA KINABALU (June 12): A trader was fined RM3,000, in default four months' jail, by a Magistrate's Court here today for obstructing a Health Ministry officer from performing his duties. Magistrate Marilyn Kelvin imposed the fine on 38-year-old Tee Hong Lim after he pleaded guilty to a charge under Section 186 of the Penal Code. The offence carries a penalty of up to two years' imprisonment, a fine, or both upon conviction. Tee was found guilty of committing the offence at a house in Taman Seri Kepayan on June 1. In an unrelated case, a driver was discharged on a two-year good behaviour bond by another Magistrate's Court here for a charge of causing hurt. Magistrate Wan Farrah Fariza Wan Ghazali issued the order under Section 173A of the Criminal Procedure Code in the case of Mahady Sham, who was accused of injuring the victim at the loading bay of a meal unit at a health institute at 11.46am on May 15, 2024. The court set the bond at RM1,200 with one local surety. Mahady was represented by counsel Mohamad Syazwan Shah Mohamad Ali.
