DOJ asks for 1-day sentence for ex-officer in Breonna Taylor shooting

The Department of Justice (DOJ) is seeking a one-day prison sentence, already served, for a Louisville police officer convicted in connection with the raid that resulted in Breonna Taylor's death. Ex-Louisville Metro Police Department Detective Brett Hankison was convicted last year of violating Taylor's civil rights by blindly firing shots into a window and door during the haywire raid. In an atypical sentencing memorandum, submitted Thursday by DOJ civil rights chief Harmeet Dhillon and a senior counselor in the division, the government said that, but for the jury verdict, it 'might proceed differently' in the case. 'Indeed, reasonable minds might disagree as to whether defendant Hankison's conduct constituted a seizure under the Fourth Amendment in the first place,' said Dhillon and senior counsel Robert Keenan, neither of whom is part of the initial prosecution team. 'And reasonable minds certainly might disagree whether, even if Defendant Hankison's conduct did constitute a seizure, a prosecution under this statute should have been brought under these circumstances at all.' Though Hankison faces a maximum sentence of life in prison, the government suggested a sentence of time served — the day he spent being booked and making his initial appearance before a judge — and three years of supervised release would suffice. His sentencing is scheduled for next week. It marks a stunning departure from the Biden administration's efforts to force accountability for the role of racial discrimination in police misconduct. Taylor, who was shot and killed by other officers during the raid, became a face of the Black Lives Matter movement that ignited in 2020 following her death and the police killing of George Floyd. At trial, prosecutors said Hankison acted recklessly and 'violated one of the most fundamental rules of deadly force: If they cannot see the person they're shooting at, they cannot pull the trigger.' The Justice Department argued in its memorandum that federal sentencing guidelines do not fairly apply to Hankison's conviction given the 'unique facts and circumstances' of the case, namely that the ex-detective was convicted on just one count following two other trials. Hankison was acquitted on all three counts he faced during a 2022 trial in Kentucky state court. The first federal trial he faced, in 2023, resulted in a mistrial on both charges against him. And he was convicted on one of those two counts in the subsequent retrial in 2024.

Hankison was found guilty of violating Taylor's rights at the conclusion of a November jury trial. He was acquitted of violating the rights of Taylor's neighbors.

Officers were called Wednesday afternoon to a residence in the Wharf neighborhood 'for a report of an assault,' according to a Metro Police Department statement. An incident report says the victim was a woman, and that no weapon was involved. No arrests were made, though police noted the case was still 'an active criminal investigation.' In a statement, Mills' office confirmed that 'law enforcement was asked to resolve a private matter at Congressman Mills' residence. Congressman Mills vehemently denies any wrongdoing whatsoever, and is confident any investigation will clear this matter quickly.' The case has since prompted an internal MPD inquiry into its handling of the initial complaint. 'Once MPD leadership became aware of this matter there was an immediate review of our initial response to ensure all procedures were followed. MPD's Internal Affairs Bureau is currently investigating,' according to a department statement. Mayor Muriel Bowser, speaking to reporters Friday, would not confirm Mills' involvement in the case. But she did speak about an internal investigation, focused on 'making sure that all of our members did what they were supposed to do according to MPD policy.' Mills, an Army veteran who received a Bronze Star for his service in Iraq, was elected to a second term in Congress last year.

LAS VEGAS (KLAS) — The Spring Mountain corridor in Chinatown is set for a major redevelopment, and visitors at a Saturday food festival discussed the changes and enhancements they hope to see in the area. The issues on the table for the redevelopment plan include public safety, transportation, mobility, and parking. The project, which is set to transform the Spring Mountain corridor in Chinatown, has been in progress for nearly a year. County officials are urging residents to share their thoughts on improvements they want to see from the project, which is in its community preference and alternative options stage. Joseph Bajarillo, who was visiting the area Saturday, hopes for more parking and less safety concern. 'I would also love to walk around Chinatown and feel safe,' Bajarillo said. The Dream Asia Festival, which featured 93 food vendors serving up a variety of flavors from Asian culture, also allowed those in the area to give their input on the continuing project. Minjia Yan, project consultant with Clark County, previewed other enhancements in the works. 'There are talks about a community safety hub or kiosk in addition to enhancing the lighting in areas, too,' Yan said. 'We've been working with the Metro Police Department quite a bit.' Those participating in the Dream Asia Festival said they're pleased to see the progress. Fred Chung, owner of ShareTea, a local beverage company, said he would like to see more law enforcement near his business 'We've had a few things happen over in Shanghai Plaza at our neighboring stores,' Chung said. 'It's such a big property, so even if there's just one security guard, it takes a long time for them to get around, so I'd like to see more.' The finalized plan will be submitted to the county board for approval by the end of the year.
