Suspect accused of shooting man multiple times in Dayton indicted
Jul. 11—A man accused of shooting another man multiple times and critically injuring him in Dayton was indicted by a grand jury. Joe Phelps Jr., 64, is facing two counts of felonious assault and one count of aggravated robbery in Montgomery County Common Pleas Court. He is scheduled to be arraigned on Tuesday. The charges are connected to a shooting on June 28 in the 4000 block of Middlehurst Lane. Around 1:52 p.m., Dayton police responded to reports of a person shot. When officers arrived they found a man who had been shot multiple times, according to Dayton Municipal Court records. He was taken to Miami Valley Hospital in critical condition. "The person who heard the male calling for help and ultimately called 911 likely saved the victim's life by getting him the medical attention he needed in a timely manner," said Dayton police Sgt. Andrew Zecchini. An investigation led detectives to Phelps. The victim identified Phelps as the person who shot him while stealing items in his home, according to an affidavit. Investigators found evidence of illicit drug sales in the home, Zecchini said.

Joe Turner Phelps, 64, was charged with two counts of felonious assault and one count of aggravated robbery, according to Dayton Municipal Court records. On June 28, Dayton police responded to a shooting in the 4000 block of Middlehurst Lane. Officers arrived to find a man who had been shot several times, according to court documents. He was transported to Miami Valley Hospital in critical condition. "The person who heard the male calling for help and ultimately called 911 likely saved the victim's life by getting him the medical attention he needed in a timely manner," said Dayton police Sgt. Andrew Zecchini. Detectives identified Phelps as the shooter through an investigation. The victim then positively identified Phelps as the person who shot him while stealing items from his home, according to court records. Investigators found evidence of illicit drug sales in the home, Zecchini said. Phelps' bail was set at $500,000 on Thursday.

Harrison Twp. man guilty on all charges in 2023 murder, shooting
Jul. 2—A Harrison Twp. man who was accused of murdering a man and shooting a woman several times has been found guilty on all charges. A jury Shawn Adrian Jackson Sr., 49, guilty of six counts of murder, four counts of felonious assault, two counts of aggravated burglary, two counts of aggravated robbery and one major drug offender count of possession of cocaine. In addition, the court found him guilty of having weapons while under disability. He is currently in the Montgomery County Jail, and is scheduled to be sentenced July 22. The charges stem from a shooting late Dec. 6, 2023. At around 7:45 p.m., police responded to a house in the 700 block of Brooklyn Avenue after a woman called 911 and said she had been shot in the mouth, according to Montgomery County Regional Dispatch Center records. Police found a man shot in the head, later identified as 35-year-old Dominique Battle, and a woman who had been shot multiple times, according to an affidavit filed in Dayton Municipal Court. Battle was pronounced dead at the scene, and medics took the woman to Miami Valley Hospital with critical injuries, Dayton police Lt. Steven Bauer said following the shooting. According to the affidavit, investigators found video showing Jackson walking in and out of the house. "Phone records confirm that the defendant called the victim multiple times before he arrived and walked in," the affidavit read. "The defendant was arrested after the living victim picked him out as the shooter." Jackson denied that he was at the house on the night of the shooting, court records showed. 1 hospitalized after drive-by shooting in Dayton
One person was hospitalized after a drive-by shooting in Dayton early Sunday morning. Woman sentenced to 30 days in crash that killed Northmont senior, injured 5
Jun. 5—A Huber Heights woman was sentenced to 30 days for a crash two years ago that killed a Northmont High School senior and injured five people. Kelsey R. Minor, 20, was ordered to serve 30 days in the Montgomery County Jail and spend five years on probation, according to the Montgomery County Prosecutor's Office. She also must complete 500 hours of community service and had her driver's license suspended for three years. If she violates the terms of her probation, Minor will face nine months to three years in prison. Minor pleaded guilty to one count of aggravated vehicular homicide on May 8. Three counts of vehicular assault were dismissed. The prosecution sought the maximum sentence of three years and a lifetime suspension of her driver's license. In a sentencing memo Assistant Prosecuting Attorney Matthew DeRosa noted Minor was driving 74 miles per hour on Salem Avenue in a 35 miles per hour zone. A blood draw at the hospital also showed Minor had alcohol in her blood, according to the memo. "Her actions constitute the worst form of the offense," DeRosa wrote. "A sentence of 36 months and lifetime license suspension is the only way to protect the community from future criminal acts of defendant and deter her from further criminal action." The defense sought community control sanctions, noting she had no driving violations prior to and after the crash. Attorney Anthony A. Abboud wrote Minor's decisions that night have haunted her. "Kelsey struggled to grapple with the loss of her friend due to her actions that night," a sentencing memo read. "She has carried guilt, remorse and regret to this day. Kelsey understood her choices that night not only impacted her life, but her family's life, her friend's life and most importantly the family of Christopher Gwynne." Minor wrote a letter to Judge Steven K. Dankof saying there isn't a day she doesn't think of the crash. "I never would intentionally hurt anyone," she wrote. "Losing Chris has caused so much pain, depression, regret. I would never want anyone to go through the pain his family and mine have gone through. Around 1:30 a.m. on April 30, 2023, Minor was driving a 2005 Chevrolet Cobalt on Salem Avenue near Harvard Boulevard when she lost control, according to a crash report. The car began to spin and went off the right side of the road before hitting an RTA pole. Minor had five passengers in the car, including four people in the back row. Chris Gwynne, 19, of Englewood, was in the middle of the back seat, and died at the scene. Minor and the other four passengers were transported to Miami Valley Hospital with injuries.
