New submission dates set in senior cop's murder trial

IPOH: The High Court today set new dates for submissions in the murder trial of senior police officer Deputy Superintendent Mohd Nazri Abdul Razak, who is charged with killing a Form Five student in 2023. Judge Datuk Bhupindar Singh Gucharan Singh Preet fixed Oct 1 and 2 for the oral hearing of submissions after allowing the defence's application to file a new written submission. The decision was made after the defence team argued that the prosecution had shifted its focus in its legal arguments. "Since the defence wishes to file a new submission after reading the prosecution's submission, I will allow the defence's application. "The defence is to file its new submission within six weeks, and the prosecution is to respond within four weeks. I will set the hearing for the oral submissions on Oct 1 and 2," he said. The court had previously set July 16 to 18 for the submissions. Earlier, lead counsel M. Athimulan, representing Mohd Nazri, told the court that the defence needed to revise its arguments. "Our submissions covered both Section 300(c) and (d) of the Penal Code, but were more concentrated on Section 300(c). However, the prosecution's stand now is that they are relying on Section 300(d). "This creates a need to revise our entire submission. In view of that, we are seeking an adjournment to file this new submission, with the court's indulgence, in about six weeks," he added. Speaking to reporters later, Deputy Public Prosecutor Afzainizam Abdul Aziz clarified that the prosecution had stated from the outset its intention to prove the case under both sections. He said that their written submission focused on Section 300(d), while the defence's submission primarily addressed Section 300(c). "The defence needs to address the arguments under Section 300(d). It is crucial this is argued now to prevent it from becoming a legal issue during a potential appeal," he said, adding that Section 300(d) pertains to the element of knowledge of the offence. The defence team for Mohd Nazri also includes Datuk Mior Faridalathrash Wahid and Aiman Hakim Kamaruzzaman. Deputy Public Prosecutor Nasrul Hadi Abdul Ghani also appeared for the prosecution. In its opening statement last year, the prosecution argued that the accused's actions constituted murder under Section 300(c) and/or Section 300(d) of the Penal Code. Under Section 300(c), the act is done with the intention of causing bodily injury sufficient in the ordinary course of nature to cause death. Under Section 300(d), the person committing the act knows that it is so imminently dangerous that it must, in all probability, cause death or such bodily injury as is likely to cause death, and commits such act without any excuse for incurring the risk. On Dec 18, 2023, Mohd Nazri was charged in the magistrate's court here for the murder of 17-year-old student Muhammad Zaharif Affendi Muhd Zamrie in Jalan Taman Jati 1 near SMK Jati, Meru, between 11.45am and 12.32pm on Dec 15, 2023. He was charged under Section 302 of the Penal Code, which is punishable with death or imprisonment for between 30 and 40 years, with not less than 12 strokes, if found guilty.

SANDAKAN: The marine police, in collaboration with the Malaysian Palm Oil Board (MPOB), arrested four men believed to be involved in the misappropriation of crude palm oil during two separate raids in Sandakan on Thursday. Sabah Region 4 marine police commander ACP Mohd Nazri Ibrahim said the integrated operation began with a raid along Jalan Sandakan-Kinabatangan at 3.30pm, which led to the arrest of four men aged between 20 and 45. "All of them were arrested while transferring crude palm oil from a tanker into another tank for delivery to a separate location. "The second raid was conducted at a premises in Bandar Ramai-Ramai here, where a tanker and several storage tanks containing crude and processed palm oil were found," he said in a statement yesterday. He said the seized goods, comprising about 75,000 litres of crude and processed palm oil, were estimated to be worth RM2.96 million and the case was being investigated under the Malaysian Palm Oil Board Regulations 2005. Meanwhile, Mohd Nazri said Sabah Region 4 marine police had recorded 11 cases so far this year involving 23 arrests and seizures exceeding RM12 million linked to a crude palm oil theft syndicate. He urged the public to channel any information on criminal activities to the Sabah Region 4 marine police Operations Room by calling 088-454 819 or via the official Sabah Region 4 marine police Facebook page. –Bernama

SEMPORNA: Marine Police arrested three men allegedly misappropriating diesel, petrol and cooking oil following raids in Semporna and Labuan. Sabah Region Four Marine Commander, ACP Mohd Nazri Ibrahim said, about 3.40pm on June 10, a police team raided a warehouse in Labuan. Advertisement Further inspection on the warehouse found three Intermediate Bulk Container (IBC) tanks containing diesel and nine IBC tanks containing 8,500kg of cooking oil. 'A total of 2,600 litres of diesel were seized. All the seizures were estimated worth RM370,324. 'The team also detained an individual to assist in investigation,' he said in a statement on Wednesday. Mohd Nazri said about 5.30pm on the same day, Marine Police from Semporna and Lahad Datu seized 153 jerry cans containing petrol and two boats at Kampung Batu in Semporna. Two individuals were detained to assist in investigation while the seizures were estimated worth RM107,738.50. Mohd Nazri added that investigations were carried out under the Control of Supplies Act 1961. Gerik tragedy fallout: Bus firm faces wave of cancellations

KOTA BARU: The bus company involved in the tragic Gerik accident, which claimed the lives of 15 Universiti Pendidikan Sultan Idris (UPSI) students, has reported a significant number of booking cancellations. The company's operations officer, Mohd Nazri Nawi, acknowledged the cancellations, saying that most were for chartered services scheduled in July and August. "We accept these cancellations with an open heart, understanding the situation in light of the recent tragedy," he said when contacted. Despite the cancellations, Mohd Nazri said that the company continued to operate as usual, with domestic bookings proceeding without disruption. "As of today, our company — which operates more than five buses — remains in service. We will continue running the business for as long as we are permitted to do so," he added. He said that, at present, the company had not received any official notification from the authorities regarding the suspension of its operations. "We are still awaiting further instructions," he said. It was reported earlier today that all permits held by the tour bus company involved in the fatal crash in Gerik, Perak, have been revoked with immediate effect due to multiple breaches of permit conditions. Transport Minister Anthony Loke said the company had committed two major offences — leasing its operating permit to a third party and failing to activate the vehicle's GPS tracking system. "The permit holder, based in Kedah, had leased the permit to an operator in Kelantan for RM500 a month," he said. The incident, which occurred early Monday, shocked the nation. A tour bus carrying 42 UPSI students from Jerteh, Terengganu, to Tanjung Malim, Perak, collided with a Perodua Alza multi-purpose vehicle along the East–West Highway (JRTB) near Tasik Banding, Gerik. Fifteen students were killed in the crash.
