MACT orders 1.8 cr payout to accident victims' kin
Mumbai: A Motor Accident Claims Tribunal (MACT) has ordered a payout of over Rs 1.4 crore to the family of Mulund-based marketing manager Mehul Thakkar, who died in a car crash in June 2019. The family of another deceased victim, Harshida Davda, will receive around Rs 38 lakh, and Davda's husband, Bharat Davda, was also awarded compensation of around Rs 4.5 lakh for the injuries suffered in the same accident. MACT ruled that Bhauben Thakkar, owner of the vehicle involved, and her insurance company, Reliance General Ins Co Ltd, must jointly pay the compensation. Mehul's wife, who was in the car too, deposed before the tribunal. A criminal case was also registered against the driver for causing death by negligence. The company initially disputed the claim, arguing that the accident didn't happen as described, and that the driver wasn't negligent or didn't have a valid license. "The company has not challenged the chargesheet and there is no substance in the contention raised by the company proving that the driver of the offending vehicle was rash driving at a high speed and was solely responsible for the accident." the tribunal said. Considering the victims' age at the time of death, MACT included their potential future earnings and the family's financial losses due to untimely death for compensation. 24L relief to kin of man killed in '21 road accident
Thane: The Motor Accident Claims Tribunal (MACT) in Thane awarded a compensation of Rs 23.96 lakh to the family of a fabricator who died in a road accident that occurred in Palghar in March 2021. The tribunal held that the rash and negligent driving of a motorcyclist was responsible for the tragic incident. The claimants, which include the widow and three daughters of the deceased, moved the tribunal. The accident took place on the night of March 27, 2021, when the deceased was standing on the correct side of Saphale Tandulwadi Road. A motorcycle, reported to be riding at high speed, struck him. He suffered grievous head injuries and was taken to hospital, where he succumbed to his injuries on April 10, 2021. The case was registered under various sections of the Indian Penal Code and the Motor Vehicles Act. During the proceedings, the insurance company challenged the claim, alleging that the deceased may have been injured by an unknown vehicle and that the rider of the motorcycle in question did not hold a valid driving licence at the time of the accident. It also concluded that the rider was unlicensed, which constituted a breach of the insurance policy terms. The deceased was reported to be self-employed, running a fabrication business. Although his family submitted income tax returns, indicating an annual income of Rs 4,48,220, the tribunal noted the absence of business licences, order records, or other substantive documents. In the absence of such proof, the court assessed his monthly income as Rs 15,000 for the purpose of compensation.

Delhi Police 's crime branch is investigating a major insurance fraud in which policies meant for two-wheelers were issued against three-wheeler and four-wheeler vehicles across the country. The scam came to light after the Motor Accident Claims Tribunal (MACT) began issuing claims notices to the insurance company involved, a TOI report stated. Scam exploited insurance company's e-motor portal The fraudsters allegedly took advantage of the insurance company's e-motor portal and other online tools to issue these fake policies. According to the company's authorised representative, the accused altered customer data, misclassified vehicle types, and provided fake contact information to issue false insurance documents. Additionally, they provided fake, forged policy documents to some customers by changing the category of two-wheelers to that of other vehicles. In many cases, the fraudsters tampered with policy documents, including make, model, premium amount, and policy codes." Payments made through digital channels An internal probe revealed that most transactions—about 74%—were made via UPI, net banking, and credit cards. The payments were credited into the company's account, but were initiated by the accused. Live Events "Further investigation revealed that out of these fraudulent policies, 74% were purchased through transactions via UPI, net banking, credit cards, etc., credited into the company's account by the accused persons," the complainant added. Case registered, crime branch begins probe Following directions from the court, Delhi Police's crime branch registered a case and began its investigation. The company reported financial losses as a result of the scam. "After verifying the copies of insurance policies obtained from the insured persons during the visits and scrutinising the records maintained regarding their respective vehicle insurance policies in the company's system, it was found that the copies of policies possessed by the insured were fabricated," the complainant stated. MACT award 1cr to kin of cop killed in road mishap
Thane: The Motor Accident Claims Tribunal (MACT) in Thane has asked the (MSRTC) to pay a compensation of Rs 1.12 crore to the family of a police constable killed in a road accident in 2022. Tired of too many ads? go ad free now In the order passed on Friday, the MACT, presided over by member R V Mohite, directed the MSRTC to pay the compensation along with an interest at 9 per cent per annum, from the date of the petition until the amount is deposited, within one month from the date of the award. Girish Ashok Harad (30), constable with the Mumbai police, was on way to join night duty on his scooter when a speeding MSRTC bus proceeding from Badlapur side towards Murbad left the road and collided with his vehicle near Sonawale village in Thane district. Harad suffered serious injuries and succumbed while undergoing treatment at a hospital in Kalyan. The Kulgaon police had registered an FIR under various sections of the IPC against the MSRTC bus driver and filed a chargesheet. At the time of the accident, Harad was earning Rs 58,822 per month. The claimants included his wife, minor daughter, parents and unmarried sister, who were dependent on his income. The MSRTC, represented by advocate H P Patil, countered the claim, asserting the accident occurred due to the sole negligence of the deceased. It argued that the bus was on the correct side and the scooter, coming from the opposite direction at high speed, slipped and collided with the bus. The claimants, represented by advocate M A Pendse, presented evidence, including the FIR, spot panchanama, postmortem report, and chargesheet. The tribunal noted the road was wet at the time of the accident. It means it was raining either before the accident or at the time of accident. Thus, the tribunal held contributory negligence of both drivers and assessed negligence of the constable at 20 per cent and of the bus driver to the extent of 80 per cent for the assessment of compensation. The compensation amount included loss of future income at Rs 72,73,728, future prospect - Rs 36,36,864, loss of consortium - Rs 2,00,000, loss of estate - Rs 15,000, funeral expenses - Rs. 15,000, and loss of love and affection - Rs 1,50,000. The tribunal ordered that the constable's wife be given Rs 60.90 lakh, his three-year-old daughter Rs 44 lakh, while his parents were to be given Rs 3 lakh each and his sister Rs 2 lakh. It said Rs 25 lakh of the compensation for the claimant's wife is to be invested in a fixed deposit for five years in a nationalised bank, while the compensation for his daughter is to be invested in a fixed deposit until she attains the age of majority. On July 7, 2012, the Motor Accident Claims Tribunal, Ballari, awarded Rs 5,33,000 with 6 percent annual interest compensation, on the grounds of cover note for insurance policy issued by the insurance company. Both the parties filed appeals seeking higher compensation.
