How many warrants lying unexecuted, HC asks police
Chennai: Madras high court has directed the Tamil Nadu director general of police and the Chennai city commissioner of police to file a report on how many cases were pending due to non-execution of Non-Bailable Warrants (NBW) across the state as of July 23. Justice P Velmurugan also instructed the registrar-general of the court to request a status report from the subordinate courts regarding how many cases were pending without executing the NBWs and without filing compliance reports as of July 23. The court issued the order in response to a plea by Jamuna Sivalingam, seeking direction for the Neelankarai police to execute the NBW issued against V Rajarajacholan by the metropolitan magistrate, Fast Track Court-I, Allikulam, dated Dec 18, 2024. ‘NBW-free commissionerate': Rachakonda Police clear all 2,847 pending warrants in 30 days
The Rachakonda Police have executed all 2,847 pending Non-Bailable Warrants (NBWs) in a 30-day operation aimed at bringing the number of such warrants to zero under a drive titled 'NBW-free commissionerate'. The crackdown was launched after the number of pending NBWs rose sharply from 1,088 in January to 2,847 by the end of April, said Police Commissioner G. Sudheer Babu. 'Nine special teams were formed, each comprising one sub-inspector and four constables, to carry out warrant executions division-wise. Additional teams were sent to other states, including Andhra Pradesh, Maharashtra and Rajasthan, to trace the accused who had relocated. Warrants were grouped based on the seriousness of the offence, geography, and period of pendency,' explained the commissioner. A total of 2,024 accused persons were physically produced in court. 'In the remaining 823 cases, police submitted requisitions to courts for proclamation proceedings, notices to sureties, and attachment of property under Sections 82 and 83 of the Criminal Procedure Code and corresponding BNSS provisions,' added the officer. He further explained that among the executed NBWs, 1,408 were long-pending cases issued before 2023. In 52 cases, the accused were found to be deceased. 'Fourteen accused were already in jail, and their warrants were regularised to initiate trial. In 13 cases, the accused had absconded mid-trial, and police re-secured their presence. Four persons were wanted in narcotics-related cases, their arrest is expected to expedite trials in related matters,' said the Commissioner. Going forward, police said they will continue the timely execution of all new NBWs. If warrants cannot be executed, legal steps including proclamations, surety forfeiture, and property attachment will be initiated without delay.

High Court allows Mehul Choksi to withdraw plea against non-bailable warrant
The Bombay High Court on Monday permitted diamantaire Mehul Choksi to withdraw his plea seeking cancellation of a non-bailable warrant (NBW) issued against him by a special court in court initially denied this request, emphasising that Choksi, one of the accused in the PNB scam case, could only avail legal remedies in India if he was physically present in the country. However, the plea, originally filed in 2020, was later allowed to be Vijay Aggarwal, representing Choksi, sought the court's permission to withdraw the plea so that his client could pursue other legal remedies. Aggarwal informed the court that Choksi had been arrested and is currently in a Belgian prison. Justice Madhav Jamdar remarked, "If the petitioner is Mehul Choksi, then he should remain present". Aggarwal further explained that the NBW was executed following a request by the Central Bureau of Investigation (CBI). Consequently, Choksi decided to seek alternative legal remedies. "On the request of the CBI, the warrant was executed. I will therefore take my appropriate remedy under law," Aggarwal prosecution, represented by advocates Amit Munde and A Limousine for the CBI, and Aayush Kedia for the Enforcement Directorate (ED), clarified that NBWs were issued in separate cases by the same Mumbai court. These warrants were related to Choksi's failure to return to India to face investigation and trial in the Punjab National Bank (PNB) bench questioned Aggarwal on the timing of the challenge to the impugned order, which dated back to 2019, asking, "What is the explanation for not coming before that?" Delhi HC rejects anticipatory bail plea of goldsmith accused of misappropriating gold
New Delhi [India], June 20 (ANI): The Delhi High Court on Thursday rejected the anticipatory bail of a goldsmith in a case of alleged misappropriation of part of the gold delivered to him for making jewellery. Economic Offence Wing (EOW) lodged an FIR in 2022. A non-bailable warrant was issued against the accused, who had not joined the investigation. He was declared a proclaimed offender (PO). Justice Ravinder Dudeja rejected the anticipatory bail of Jagdish Das and said that in the light of the cumulative circumstances, the petitioner is not entitled to seek the benefit of pre-arrest/ anticipatory bail. While rejecting the plea, the High Court observed, 'Keeping in view the law and judicial precedents, anticipatory bail shall not be granted to a person who is a proclaimed person under Section 82 CrPC except in exceptional circumstances.' 'The present case does not form an exceptional or extraordinary case where this discretionary power of the Court be used,' Justice Dudeja held in the judgement passed on June 19. The High Court also considered the status report filed by the police, which revealed that despite the orders of the trial Court, he failed to join the investigation and appear before it even after the issuance of NBWs and process under Section 82 CrPC. As per the allegations, the complainant-firm, Taj Exports, purchased 26 Kgs of gold of 24 karats from Yes Bank after paying a total amount of Rs 9,66,80,104. Bank delivered the purchased questioned gold bars through its hired companies to the authorized persons cum employees of alleged company M/s Jewels Creation Private Limited. It is further alleged that the gold bars were handed over to Jagadish Das, the Director of M/s Jewels Creation Private Limited, for making jewellery. It is also alleged that the accused Jagadish Das made jewellery of some gold, but he neither made jewellery of the balance of gold nor returned the same to the complainant, M/s Taj Exports. During the arguements on plea, senior advocate Amit Chaddha appeared for Jagdish Das. He submitted that persons alleged to have received the gold were not the employees of the company of the petitioner. It was submitted that 26 Kg of gold was never delivered to the petitioner. The same was delivered to some other persons, namely Arup Bhuiya and Ranjan Mitra, who are unrelated to the petitioner. Additional Public Prosecutor (APP) referred to the status report and submitted that petitioner is the Director of M/s JD Jewels Creation Pvt Ltd and Arup Bhuiya and Ranjan Mitra are his associates/employees who were appointed by the petitioner to collect bullion on his behalf from the logistic services as apparent from the transactions of gold delivery details in the status report. HC junks Nowhera Shaikh's bail pleas against pending NBWs
1 2 3 Hyderabad: The Telangana high court on Wednesday dismissed petitions filed by Nowhera Shaikh, the prime accused in the Heera Gold investment fraud cases, seeking a stay on three non-bailable warrants (NBWs) issued against her. Justice K Sarath deemed the petitions 'infructuous,' effectively ending her plea for interim relief. The dismissal came a day after sleuths from Hyderabad police's central crime station executed the long-pending NBWs against Nowhera Shaikh in Faridabad, Haryana, on Tuesday. When Nowhera Shaikh's counsel sought directions from the high court following her apprehension, Justice Sarath advised them to approach the concerned trial court for any further relief and subsequently disposed of the petitions. The three NBWs had been pending for several months in connection with separate cases registered by CCS in 2018. The Nampally court had issued the warrants after the Supreme Court cancelled her bail in Oct 2024. Despite the apex court's order, Nowhera Shaikh failed to surrender before the appropriate trial court, prompting enforcement of the warrants.
