The Madras High Court has upheld a decision by a public sector bank to cancel the appointment of a candidate due to a poor credit history. The court ruled that financial discipline is crucial in banking jobs and found no fault in the bank's petitioner, who had cleared all stages of recruitment for the post of Circle Based Officer (CBO) at State Bank of India (SBI), including exams, interviews, and medical checks, had his appointment cancelled after the bank found an adverse credit report in his CIBIL to a report on Live Law, the candidate argued that he had no pending dues at the time of the job notification and claimed that his appointment was unfairly revoked. He also alleged discrimination, saying others in similar situations were allowed to join. SBI maintained that Clause 1(E) of the eligibility criteria of its recruitment policy, disqualifies candidates with poor credit histories or defaults in repaying loans or credit card dues. The bank noted that the candidate's CIBIL report showed multiple credit irregularities and more than ten credit enquiries, indicating serious financial bank also alleged that the candidate had failed to fully disclose this history during the application N Mala said the bank had acted prudently. She observed that banking employees handle public money and therefore must maintain strong financial discipline. CHENNAI: The Madras High Court has upheld an order of State Bank of India (SBI) denying a job to a successful candidate on the grounds of financial indiscipline and poor CIBIL (Credit Information Bureau India Limited) score. Justice N Mala recently dismissed the petition filed by the aggrieved candidate, P Karthikeyan, who was appointed to the post of Circle Based Officer (CBO) in 2021, but the appointment order was shortly cancelled. The judge observed the bank took a 'prudent decision' that the candidates with history of default of repayment of loans and adverse CIBIL and other external agencies' report were ineligible. The probable rationale behind the criteria may be that in banking business, the employees deal with public money and therefore financial discipline needs to be strictly maintained. Further, there must be efficiency in handling public money and obviously a person with poor or no financial discipline cannot be trusted with public money, the judge said. The judge rejected the contention of the petitioner that he had repaid the loans and dues before the date of issuance of the appointment order and an NOC was obtained from the lender. The petitioner had applied for the post of CBO as per a notification issued on February 27, 2020. He cleared the examination and interview held on February 16, 2021, while the appointment order was handed over to him a month later. He had also submitted his CIBIL score and explanation for the adverse CIBIL report. But the respondent bank (SBI) cancelled his appointment.

CHENNAI: Amid apprehensions expressed over the likelihood of unseemly events during the PMK's ambitious 'Chithirai Muzhu Nilavu' rally and conference scheduled to be held on May 11, the Madras High Court on Thursday ordered the party to furnish an undertaking to the police for strict adherence to the pre-conditions to ensure no law and order problems are created. A division bench of justices N Mala and G Arul Murugan issued the orders while disposing of a public interest litigation (PIL) petition seeking to deny permission to the PMK's conference to be held at Thiruvidanthai, near Tiruporur. 'The respondent (PMK) shall furnish an undertaking to the North Zone Police IG to the effect that the conditions imposed by the police will scrupulously be adhered to,' the bench said in the order. It also instructed the organisers of the conference to ensure none of the participants carry any arms or ammunitions while attending the event. The bench directed the North Zone IG to strictly monitor the conduct of the conference and deploy additional contingents of the personnel to ensure no law and issues are created during the programme. Further, it granted liberty to government authorities to impose any such conditions that are deemed necessary to regulate participants, apart from the 42 conditions already imposed. The PIL, filed by J Muthukumar of Madambakkam, recalled the widespread violence and large scale damaging of public property during a similar PMK rally in 2013, and sought the court to restrain the officials concerned from granting permission to the rally and conference which coincides with the Chithirai Pournami festival.
