60 days or less: H-1B Workers get deportation notices despite legal status

A growing number of H-1B visa holders in the United States are receiving deportation notices while still within their 60-day legal grace period following job loss, according to multiple immigration law firms. The issue was flagged by Dillon Colucci, a partner at Greenberg Traurig LLP, who wrote in a firm post that some individuals were being served Notices to Appear (NTAs) despite remaining in legal status. His concerns were echoed by attorneys at Reddy Neumann Brown, Murthy Law Firm, Chugh LLP, and others. 'Losing your H-1B job is stressful enough—but now some workers are receiving Notices to Appear (NTAs) even while they're still legally within their 60-day grace period,' said Abhisha Parikh, a US-based immigration lawyer, in a social media post. What's supposed to happen when an H-1B worker loses a job? When employment ends, H-1B workers are allowed to stay in the US for up to 60 days to: • Find a new job and transfer their H-1B • Switch to a different immigration status (such as B-2 visitor) • Leave the US voluntarily within the grace period During this time, they are legally present and not considered out of status. What's happening instead? Several H-1B visa holders are reportedly receiving NTAs even before the 60-day period ends. An NTA is a formal notice initiating deportation proceedings in immigration court. This contradicts US Citizenship and Immigration Services (USCIS) guidance, creates uncertainty for visa holders, and disrupts businesses relying on foreign talent. The development follows a February 28, 2025 policy memorandum from USCIS, which expanded the types of circumstances that may trigger an NTA. The memo, accessed by Business Standard, clarified that Form I-862 (the NTA) outlines allegations and charges against an individual and initiates removal proceedings under section 240 of the Immigration and Nationality Act. USCIS, ICE and CBP all have the authority to issue NTAs. Are rules being changed? While there has been no official change to the grace period rule, the regulation allows the Department of Homeland Security (DHS) to 'eliminate or shorten this 60-day period as a matter of discretion.' Colucci noted that, although this provision existed since 2016, its use was not widespread until recently. He added that USCIS may now be using this discretion more frequently, though this has not been formally acknowledged by the agency. Parikh questioned the move: 'This raises serious questions: Is this a new enforcement tactic or just administrative errors? Either way, it's putting skilled professionals at risk of deportation before they've done anything wrong.' Who is affected? NTAs are being issued in situations where individuals may technically no longer be in nonimmigrant status, even though they have pending applications such as: • Adjustment of status (Form I-485) • Change or extension of status • Employment authorisation (EAD) while waiting for green card processing In some cases, NTAs are issued because an employer notifies USCIS of termination, prompting the agency to consider the person out of status—even if an application is pending. Others may have filed change-of-status applications slightly late, which could also lead to an NTA. According to Murthy Law Firm, an NTA starts the legal process for deportation. It requires the individual to appear before an immigration judge, beginning with a procedural master calendar hearing that may be followed years later by a full hearing. If the individual leaves the US after receiving an NTA but before attending court, it may be considered a self-removal. This can trigger a re-entry ban for several years. Some may choose voluntary departure to avoid harsher penalties. What H-1B workers can do • Act quickly to find a new employer and file an H-1B transfer • Consider switching to another visa category, such as B-2 • Leave the US voluntarily before the grace period ends, if no other option is available If issued an NTA, individuals are advised to contact an immigration attorney immediately. Mistaken NTAs can sometimes be withdrawn or dismissed. 'The system is complicated, but staying informed is your best defence,' Parikh said. 'If you're on an H-1B visa, make sure you know your rights, act fast if you lose your job, and get legal help immediately if you receive an NTA during your grace period.'

A Benidorm actress has share some exciting news about a potential new series of the much-loved ITV comedy A much-loved Benidorm star has given fans a glimmer of hope about the return of the cult ITV comedy series. Launching in 2007, the show captivated audiences as it charted the hilarious escapades of Brits basking in the sunshine at the Solana Resort. Over its glittering run, Benidorm scooped up numerous accolades including BAFTAs and NTAs, securing its status as a viewer's delight. ‌ Despite an all-star cast featuring Sheridan Smith, Siobhan Finneran, and Johnny Vegas, the show came to an untimely end after 11 years in 2018, much to devotees' dismay. ‌ Whispers of a revival have been circulating, spurred on by hints from the cast and even creator Derren Litten himself, reports OK!. Sherrie Hewson, renowned for her portrayal of Joyce Temple-Savage, dropped a bombshell during her 'An Evening With Sherrie Hewson' on Sunday (July 6) in Barnsley. She revealed: "I do know ITV have got new scripts and they love them and think they are wonderful." Yet, she tempered expectations by stating: "The problem with Benidorm is that it's probably one of the most expensive shows ever because it's in Spain, we have a Spanish crew, we have a British crew, so it costs a fortune to make." Still, she remains optimistic, adding: "But it's on twice a day every day and those ratings are still as high as they ever were, so I think it will [return]." ‌ Fans loyal to Benidorm may just see their beloved characters gracing the screens once again thanks to ITV's apparent adoration for the new material presented to them. Sherrie hinted at good news: "And I think they [ITV bosses] love the scripts anyway and Derren said he laughed out loud when he wrote them so I don't think there's any question, it's just when." ‌ In other news, Benidorm creator Derren Litten had fans buzzing in April when he announced that he is in negotiations with ITV about a potential revival of the fan-favourite show. During a Facebook Live session reported by The Sun, Derren divulged some tantalising details: "Have I been talking to ITV in the last few months? Yes I have." He continued, giving fans a glimmer of hope: "Have ITV commissioned a special or a series at the moment? No. Might they in the next few weeks [or] couple of months? Yeah they might. They might." Derren concluded, aiming to uplift fans with anticipation: "So I hope that gives you [the fans] some hope, and I hope that gives you some idea of where we are," indicating that the beloved sitcom may soon return to the small screen.

It will be live at the O2, 30th birthday - so it's a party, we're going to party." Sam - who starred in Made in Chelsea - chimmed in: "We're gonna party hard!" Pete - who was a cast member in The Only Way is Essex - agreed: "We are going to party hard. Live at the O2 on Wednesday the 10th of September." A July 2 nonpartisan letter to senior Administration officials from the Information Technology and Innovation Foundation (ITIF), joined by senior policy scholars, strikes a similar theme in calling on the Administration to target foreign governments' non-tariff attacks (NTAs) on America's leading technology companies. The letter recommends a 3-pronged negotiating approach to counteract NTAs. Administration initiatives along the lines suggested by the letter could bestow substantial benefits on U.S. producers, workers, and consumers. The NTA Problem As the letter explains, a new form of trade restriction is emerging that existing legal frameworks fail to address: non-tariff attacks (NTAs). NTAs are a specific type of ACMD that is growing in significance. Unlike traditional tariffs or known non-tariff barriers (NTBs), NTAs are disguised as legitimate domestic policies. Their true purpose is to target leading U.S. technology firms, undermine innovation, extract financial and intellectual assets, and weaken America's strategic position in the global tech race. Three features distinguish NTAs from traditional NTBs: As the U.S. seeks to rebalance trade relations, rolling back these unfair practices should be a top priority in negotiations. The ITIF has documented over 100 cases where U.S. trading partners have adopted policies aimed at limiting American tech firms' operations or siphoning their revenues. The European Union led this effort with its Digital Markets Act (DMA) and Digital Services Act (DSA), which targeted major U.S. firms while largely sparing local competitors. In 2024 alone, regulatory fines on American companies in the EU totaled nearly $6.7 billion. Other countries are following suit: Brazil with similar regulations, India targeting U.S. firms under its data protection law, and Japan restricting dominant U.S. smartphone platforms. Although often framed as consumer protection, privacy, or digital sovereignty, these policies impose selective burdens that disadvantage American firms and empower foreign rivals. They also often harm the enacting countries themselves by disrupting ecosystems that support small and medium-sized businesses dependent on global platforms. These attacks also pose national security risks. U.S. tech firms are vital to innovation and defense sector competitiveness. By diverting investment from R&D, mandating tech transfers, or exposing sensitive capabilities, NTAs erode the strength needed to compete with China's state-led technology push. The consequences are severe: This problem is most pressing in the U.S.-China context. While America applies overt targeted measures like export controls, other nations exploit NTAs to undermine U.S. firms more subtly and effectively. These tactics distort markets far more powerfully than tariffs and shift global leadership toward China just as the U.S. needs unity and strength. Policy Recommendations Addressing NTAs is essential for preserving U.S. technological strength, protecting national interests, and maintaining U.S. leadership in the global digital economy.
