Saifuddin: Act to be amended to curb MyKad forgery

THE National Registration Act 1959 (Act 78) will be amended to curb MyKad forgery, says Home Minister Datuk Seri Saifuddin Nasution Ismail. He said that the government is finalising the amendments which are scheduled to be tabled in the current parliamentary session. 'The amendments to the act will incorporate provisions for compoundable offences. 'These compoundable offences will be detailed and amended under the National Registration Regulations 1990 once the amendments to the National Registration Act 1959 are approved,' he said in a written parliamentary reply. He was responding to a question from Wan Razali Wan Nor (PN-Kuantan), who asked whether the government has any plans to increase the penalties under the act and reveal the number of forgery cases to date. Saifuddin Nasution said that data from the National Registra­tion Department from 2022 to 2024 showed there were 778,500 cases involving the loss of MyKad due to negligence, 3,422,022 cases involving damage, and 138 cases involving document forgery. 'The government takes the issue of MyKad forgery seriously as it pertains to national security and sovereignty. 'The National Registration Department continuously collaborates with enforcement agencies such as the police, the Immigration Department and the Malaysian Anti-Corruption Commission to combat forgery,' he added. Currently, Regulation 25(1)(e) of the National Registration Regulations provides for imprisonment not exceeding three years or a fine not exceeding RM20,000, or both, for the offence of using a fake identification card.

KUALA LUMPUR: The National Registration Act 1959 (Act 78) will be amended to tackle MyKad forgery, according to Home Minister Datuk Seri Saifuddin Nasution Ismail. He stated that the government is finalising the amendments, which are scheduled to be tabled in the current parliamentary session. "The amendments to the Act will, among other things, include provisions for offences that can be compounded. "These compoundable offences will be detailed and amended under the National Registration Regulations 1990 once the amendments to the National Registration Act 1959 are approved," he said in a written parliamentary reply on Thursday (July 24). He was responding to a question from Wan Razali Wan Nor (PN-Kuantan) regarding whether the government plans to increase penalties under the Act and the total number of forgery cases to date. Saifuddin reported that, according to the National Registration Department, from 2022 to 2024, there were 778,500 cases involving loss due to negligence, 3,422,022 cases involving damage, and 138 cases involving document forgery. "The government takes the issue of MyKad forgery very seriously, as it pertains to national security and sovereignty and can undermine the citizen identity management system. "The National Registration Department continuously collaborates with enforcement agencies such as the police, the Immigration Department, and the Malaysian Anti-Corruption Commission (MACC) to combat document forgery activities," he added. Currently, Regulation 25(1)(e) of the National Registration Regulations provides for a penalty of imprisonment not exceeding three years, a fine not exceeding RM20,000, or both, for the offence of using a fake identification card.

Abdah being taken to court on July 18. – BERNAMApic KUANTAN: A senior citizen has been fined RM6,000 by a Magistrate's Court here for knowingly submitting false information in an application for an identity card, or MyKad. Magistrate Tengku Eliana Tuan Kamaruzaman imposed the fine on Abdah Said, 65, after he pleaded guilty to the charge on Friday (July 18). He paid the fine. Abdah was charged with providing false information when applying for an identity card for a 12-year-old girl by using a birth certificate issued in the name of another child at a counter of the Pahang National Registration Department (NRD) here at 9.49am on Sept 28, 2012. The offence, under Regulation 25(1)(b) of the National Registration Regulations 1990 (Amendment 2007), provides for a maximum jail term of three years or a fine not exceeding RM20,000, or both, if convicted. In mitigation, the unrepresented accused pleaded for leniency as he was unemployed. NRD prosecuting officer Mohammad Yusaini Yunan requested a stern and proportionate punishment, stressing the gravity of the offence, as the accused had used his own daughter's documents for personal gain. He said the punishment should serve as a reminder to the accused and to the public not to hand over documents belonging to Malaysians to foreigners, enabling them to enjoy privileges meant for citizens. – Bernama

KUANTAN: A senior citizen was fined RM6,000 by the magistrate's court here after pleading guilty to providing false information in a MyKad application for a child 13 years ago. Magistrate Tengku Eliana Tuan Kamaruzaman ordered Abdah Said, 65, to serve 10 months' imprisonment should he fail to pay the fine. Abdah was charged with supplying false information during an application for an identification document for a 12-year-old child, using a birth certificate belonging to another individual. The offence took place at the Pahang National Registration Department (NRD) branch at 9.49am on Sept 28, 2012. He was charged under Regulation 25(1)(b) of the National Registration Regulations 1990, which carries a maximum penalty of three years' imprisonment, a fine of up to RM20,000, or both upon conviction. The prosecution was led by Pahang NRD prosecuting officer Mohammad Yusaini Yunan, assisted by Burhanuddin Hamzah. Abdah was unrepresented. In mitigation, Abdah pleaded for leniency, citing that he was unemployed. However, Yusaini urged the court to impose a deterrent sentence, stressing the gravity of the offence, as the accused had used his own daughter's documents for personal gain. "The punishment should serve as a reminder to the accused and to the public not to hand over documents belonging to Malaysian citizens to foreigners, enabling them to enjoy privileges meant for Malaysians," he said. Tengku Eliana imposed a fine of RM6,000, which Abdah subsequently paid.

RANAU: An Indonesian who allegedly worked as a tourist guide was arrested for driving without a valid driver's licence as well as using a fake identity card. A report was made by a member of the Traffic Police that a 21-year-old was using a fake identity card during traffic enforcement duties in Kundasang town. Advertisement The suspect was arrested driving a white Axia. The suspect can be punished under Regulation 25(1)(e) of the National Registration Regulations 1990 (Amendment 2007) which provides for imprisonment not exceeding three years or a maximum fine of RM20,000 or both, if convicted. The suspect is also being investigated under Section 6(1)c of the Immigration Act 1959/63 for failing to produce valid travel documents to Malaysia. The vehicle was seized under Section 60 of the Road Transport Act 1987. The owner of the vehicle will also be subject to court action for allowing individuals who do not have a valid driving licence to drive their vehicle, which is also provided for under Section 26 (1) of the Road Transport Act 1987 which carries a fine of not less than RM300 and not more than RM2,000 or imprisonment for not more than three months or both.
