Kids tortured for mango 'theft'

Two children were tortured by a landlord and his accomplices after they were caught stealing mangoes from his orchard. The children were taken to a farmhouse, where they were allegedly subjected to physical abuse and later stripped before being sent back home. A video of the naked children was shared on social media, prompting District Police Officer Syed Ali to take immediate action. The police registered a case and arrested one suspect, with raids under way to capture the remaining fugitives. According to the sources, the incident was reported from Kot Chutta police area, where the two children allegedly went to steal mangoes from the orchard of Nazar alias Nadir Luddi. They were caught by Muhammad Asif and Amir, who took them to Nazar's farmhouse, and allegedly tortured and later stripped them. A video of the incident was recorded, which was then shared on social media. When the video went viral, the district police officer instructed the Kot Chutta police to take prompt action. The police registered a case against three accused, Nazar, Muhammad Asif, and Muhammad Amir, under PPC sections 377B, 365, 355, 342 and 292. One of the accused, Muhammad Amir, was arrested, and efforts are under way to arrest the remaining suspects.

ISLAMABAD: A local court has acquitted Pakistan Tehreek-e-Insaf (PTI) leaders, including party chairman Barrister Gohar Ali Khan and Opposition Leader in the National Assembly Omar Ayub Khan, citing insufficient evidence and vague allegations in the two cases filed against them. Judicial Magistrate Shahzad Khan issued a detailed judgment regarding the acquittal of PTI leaders, Aamir Mughal, Ali Bukhari, Shoaib Shaheen, Malik Rafique, and others from two cases registered under sections, 159, 188, 186,353 under PPC and another case under Sections 506II,290,341, 188,159,353,186 under PPC at Karachi Company police station, stating that the prosecution failed to present 'cogent, strong, and hard evidence' necessary for conviction. The court dismissed the charges, calling the continuation of the trial a 'sheer waste of court['s] time.' The judgment highlighted that it is evident that the case against the petitioners and other accused individuals is fraught with serious legal and factual deficiencies. The allegations are vague and lack specificity, the prosecution has failed to establish individual roles or a common objective, and no incriminating evidence has been recovered from the accused persons/petitioners, it says. It says these shortcomings collectively weaken the prosecution's case and raise significant doubts about the validity of the charges. 'Without further evidence or clarification, the case appears to be built on shaky foundations, and the accused cannot be held liable for the alleged offenses based on the current record', it says, adding that as such, the charges against the petitioners and other accused individuals may well be dismissed for lack of merit. It says that the record reflects that general allegations are levelled in the first information report (FIR) and no specific role has been attributed to the present accused persons/petitioners. The record further shows that accused persons/petitioners, along with approximately 150 people, made a procession in which they made slogans against the state and also violated the lawful order of the authority; resultantly a case was registered, it says. The judgment says a critical issue is that the allegations are entirely general, targeting a large group of around 150 individuals without attributing any specific role, act, or overt criminal intent to the accused petitioners. This violates a fundamental principle of criminal law that accusations must be clear, specific, and individually attributable to sustain a prosecution, it says. It says that shockingly, despite the alleged involvement of 150 people, only two witnesses were cited in the challan, and there is no CCTV footage, NADRA facial recognition data, or other forensic evidence to connect the petitioners to the offence. Additionally, the absence of modern investigative techniques (CCTV, biometric verification) violates the right to a fair trial under Article 10A of the Constitution, it says. ISLAMABAD: The Anti-Terrorism Court (ATC) on Wednesday wrote another letter to the Ministry of Law for granting approval to hold jail trial of incarcerated Pakistan Tehreek-e-Insaf (PTI) founding chairman Imran Khan within jail premises in two different cases. ATC judge, Tahir Abbas Sipra, while hearing the cases involving Khan and other leaders, due to non-availability of Khan, adjourned the hearing without proceeding. The judge remarked that the court has so far not received a reply of the previous letter written by him to the Ministry of Law for the jail trial of Khan. The judge again wrote a letter to the ministry regarding the two cases. During the previous hearing, the judge remarked that he will ask for the accused to be either produced in court, allowed to appear online, or be tried within the jail premises. The other leaders nominated in the cases including Senator Shibli Faraz, Tahir Sadiq, Raja Basharat and others, appeared before the court. PTI lawyer, Sardar Misroof Khan and Zahid Bashir Dar appeared before the court. The court adjourned the hearing of cases till July 13. Police had registered the case at CTD police station under sections 148 (rioting, armed with a deadly weapon), 149 (every member of unlawful assembly guilty of the offence committed in prosecution of common object), 186 (obstructing public servant in discharge of public functions), 353 (assault or criminal force to deter public servant from discharge of his duty), 380 (theft in dwelling house, etc), 395 (punishment for dacoity), 427 (mischief causing damage to the amount of fifty rupees), 435 (mischief by fire or explosive substance with intent to cause damage to amount of one hundred rupees), 440 (mischief committed after preparation made for causing death or hurt) and 506 (punishment for criminal intimidation) of the Pakistan Penal Code (PPC) and Section 7ATA of Anti-Terrorism Act. Meanwhile, the same court indicted three accused in a case registered at Karachi Company police station, also involving Pakistan Tehreek-e-Insaf (PTI) founding chairman Imran Khan's wife Bushra Bibi, Chief Minister Khyber Pakhtunkhwa Ali Amin Gandapur and others registered in connection with the November 26 protest. ATC judge Tahir Abbas Sipra, hearing the case, framed a charge against three workers and summoned prosecution witnesses during the next hearing to be held on July 13.
