Telangana High Court dismisses SC/ST Atrocity case against CM Revanth Reddy
In a significant legal development, the High Court has dismissed the SC and ST atrocity case filed against Telangana Chief Minister Revanth Reddy. The case was opened at the Gachibowli police station following a complaint lodged in 2016 by a man named Peddiraju, who alleged that Reddy and his relatives attempted to encroach on society land. The case, which also included charges against Reddy's brother, Kondal Reddy, and another individual named Lakshmaiah, was initiated under the SC and ST (Prevention of Atrocities) Act. Revanth Reddy filed a petition in the High Court in 2020, seeking to have the case dismissed. Following a comprehensive hearing on the matter, the court reserved its judgment after concluding arguments from both parties on 20 June. The final ruling was delivered on Thursday, 17 July. In his remarks, the presiding judge stated that investigations revealed Reddy was not present at the scene of the alleged incident and noted a lack of substantial evidence to corroborate the complainant's allegations. Consequently, the court dismissed the case against the Chief Minister.

Discrimination against SC community remains: Kerala High Court
KOCHI: The Kerala High Court has observed that despite protective provisions for Scheduled Caste communities in the Constitution and laws like the SC and ST (Prevention of Atrocities) Act, discrimination and ostracisation against them have not been fully eradicated. Justice V G Arun said the Scheduled Castes in India have faced systemic ignominy like exclusion, untouchability and violence rooted in centuries-old caste hierarchy. They had restricted access to resources, land and quality education. Still, the discrimination continues. 'One cannot be oblivious of the fact that the tolerance level of persons from vulnerable sections will not be the same as that of those who have not suffered any such ignominy. To put it pithily, only the wearer knows where the shoe pinches,' the court said. The HC made the remarks while dismissing a petition filed by C K Kusuman, former principal of DB College in Kottayam's Keezhoor, seeking to quash the case against him for allegedly making casteist remarks against an assistant professor in 2022. Advocate Thomas J Anakkallunkal, the assistant professor's counsel, said the principal made the comments with the deliberate intention of insulting him by reason of his parentage. The remarks were made during the staff meeting of the college, the counsel said. The court said the question of whether the insulting remark made inside the hall can be perceived as something done within public view can only be decided based on evidence, and the HC cannot conduct a mini-trial or microscopic scrutiny of documents.

Telangana: BJP accepts T Raja Singh's resignation
The Bharatiya Janata Party (BJP) on Friday accepted the resignation of Telangana MLA T Raja Singh from the party's primary membership, nearly 10 days after he announced his exit. In an official letter, BJP national general secretary Arun Singh informed the Goshamahal MLA that his resignation had been approved by party president JP Nadda. Telangana MLA T Raja Singh. (PTI) However, the party distanced itself from Singh's remarks criticising the appointment of N Ramchander Rao as the new Telangana BJP president. 'The contents mentioned by you are irrelevant and do not match the functioning, ideology and principles of the party,' the letter stated. Raja Singh submitted his resignation on June 30, citing dissatisfaction over reported internal decisions regarding the BJP's Telangana leadership. His resignation was soon followed by Rao's appointment. While quitting, Singh had spoken out against the new leadership. 'This decision has come as a shock and disappointment, not just to me, but to lakhs of karyakartas (party workers), leaders, and voters who have stood by the party through every high and low,' Singh had said in his resignation letter, addressed to then state BJP president G Kishan Reddy. Known for his firebrand image and controversial remarks, Raja Singh has often drawn criticism from across political lines. In April this year, two FIRs were lodged against him for allegedly using abusive language and issuing threats to police officials during a Ram Navami procession. Meanwhile, the Congress too criticised the appointment of Rao, claiming that he had escaped accountability for his role in the death of PhD student Rohith Vemula. The Congress' salvo comes at a time when their governments in Telangana and Karnataka have expressed interest in passing the Rohith Vemula Act against discrimination against students from marginalised communities in higher education institutions. 'Earlier, governments would punish those who indulged in atrocities against SC, ST, OBC and minority students. But the BJP in many cases has stood behind and rewarded those guilty of crimes against the marginalised communities. Look at the Rohith Vemula case – Dattatreya was made governor of Haryana, Sushil Kumar appointed an Assistant Professor in DU, and now Ramchander Rao has been appointed the BJP's party president in Telangana!,' said Rajendra Gautam, the national president of the Congress' Scheduled Caste Department. Bandaru Dattatreya was the Lok Sabha MP from Secunderabad constituency and Union minister at the time of Vemula's death in 2016. Susheel Kumar was the president of the university of Hyderabad's ABVP unit, and N Ramachander Rao was the local MLC. After Vemula's death, an FIR was filed against all three under the SC and ST (Prevention of Atrocities) Act for abetment of suicide. The three were accused of orchestrating Vemula's expulsion from the Hyderabad University hostel and the cancellation of his stipend. Apart from demanding justice for Vemula, who killed himself following the incidents, the Congress also emphasised the need for a legal and institutional framework to prevent future atrocities against students from SC and ST backgrounds. 'Rahul Gandhi has always advocated for the passage of the Rohith Vemula Act. In Telangana, chief minister Revanth Reddy has indicated his desire to bring about such an act. In Karnataka, our government has drafted the bill and will bring it to cabinet,' Gautam said.

An inter-State human trafficking racket allegedly involving a suspended police constable has surfaced in Kumram Bheem Asifabad district with the arrest of six accused, including four women and the suspended constable, in two separate cases of human trafficking by the Asifabad police on Wednesday evening. The incident has once again brought into sharp focus the clandestine operation of inter-State gangs targeting poor tribal women in the district. A villager of Asifabad mandal lodged a complaint with the Asifabad police over a week ago seeking to trace his missing daughter. A detailed investigation into the missing person case led to busting of the human trafficking racket. It was another complaint filed by a victim of human trafficking racket who escaped from the clutches of traffickers in Madhya Pradesh and returned to Asifabad recently that uncovered the gang involved in the nefarious crime. Preliminary investigation into the two cases revealed that the accused had sold two women for ₹1.30 lakh and ₹1.10 lakh to some persons in Madhya Pradesh on the pretext of marriage a couple of months ago, sources said. The Asifabad police on Wednesday arrested six of the total nine members of the gang under the SC and ST (Prevention of Atrocities) Act and the provisions of the Immoral Traffic (Prevention) Act. HC directs DGP to make SOP for security in edu institutes
Ranchi: The director general of police, Anurag Gupta, Birla Institute of Technology (BIT), vice chancellor, Indranil Manna, dean and registrar of the technical university appeared before the Jharkhand high court on Friday in connection with the death of a student on the campus in 2024. Tired of too many ads? go ad free now The officers were directed to appear in the court of Justice Sanjay Prasad to explain reasons behind the death of a polytechnic student belonging to the Scheduled Caste category on the university campus last year. The HC, while hearing criminal appeal petitions of two convicts convicted for the murder of the victim, directed the DGP to formulate a standard operating procedure for providing security to students in educational institutions. The two convicts — Irfan Ansari and Abhishek Kumar — have been convicted for the murder of the student on the campus. Hitting at the management of Birla Institute of Technology, the high court judge observed that the death of a student belonging to SC category speaks of serious lapse in security on the campus. The death was the result of a clash between two groups where the deceased suffered 10 injuries causing his death. In course of arguments, the court was also informed that investigation of the case has been done by a police sub-inspector rather than an officer of the rank of deputy superintendent of police, which is the mandate of the SC and ST (Prevention of Atrocities) Act 1989. The court directed the BIT management to produce details of investigation done in the matter before the court on the next date of hearing on June 24. The incident had occurred on Nov 14, 2024 when the victim, a second year polytechnic student at BIT Mesra died in a clash. The dispute had risen over a selfie being taken by a girl student and ended up in a brawl with the victim and some senior students who beat him to death.
