HC sets aside govt rejection of professor's VRS

1 2 Cuttack: Orissa high court has set aside the state govt's rejection of voluntary retirement sought by Dr Snigdha Prava Mishra, a 56-year-old professor of physiology, citing her deteriorating health. The high court on Tuesday held that the denial was not legally tenable under the existing pension rules. Mishra, who was serving at MKCG Medical College, Berhampur, was transferred to SRM Medical College, Bhawanipatna, on February 28, 2024. She had requested the cancellation of her transfer and sought a posting at Shri Jagannath Medical College, Puri. When her request was turned down, she applied for leave on medical grounds. Soon after, she submitted her voluntary retirement (VRS) application on June 24, 2024, citing progressive vision loss and cardiac issues that she said made it impossible for her to continue working. However, the health and family welfare department rejected her application on Sept 17, 2024, stating that accepting her VRS was not possible in the "larger public interest" due to an acute faculty shortage in govt medical colleges. Challenging the decision in the high court, Mishra argued that the denial of retirement on administrative grounds violated her fundamental right to health and well-being. A single judge bench dismissed her petition on Feb 14, 2025, while directing the state govt to amend the Odisha Civil Services (Pension) Rules, 1992, to clearly define the scope for rejecting such applications. Mishra appealed against the verdict. On July 8, a division bench comprising Chief Justice Harish Tandon and Justice MS Raman ruled in her favour. "The element of public interest is conspicuously absent in Rule 42 of the Odisha Civil Services (Pension) Rules, 1992," the bench observed, adding that the rejection of her VRS application was beyond the scope of the rule and therefore legally flawed. The court further said, "The single judge, having admitted the absence of such a provision in the rules, erred in affirming the govt's decision. The conclusion suffers from infirmity." The court quashed both the govt's rejection letter dated Sept 17, 2024, and the single judge's earlier ruling, and directed the appointing authority to reconsider Mishra's application within two weeks, keeping her health condition in mind.

Two MBBS Students Drown Off Gokarna Coast, Negligence Alleged Against Tour Operator

Karwar (Uttara Kannada district): In a tragic incident off the coast of Gokarna in Uttara Kannada district, two final-year MBBS students from Tamil Nadu drowned after being swept away by strong waves near Jatayu Teertha on Wednesday evening. The victims, Kanimozhi and Hinduja, both aged 23, were students of SRM Medical College, Tiruchirappalli. The duo was part of a group of 23 students who had recently completed their final exams and were on a vacation tour to Dandeli, Gokarna, and Murudeshwar, organised by Vetrie Tours and Travels, a Chennai-based agency. The students had reached Gokarna from Vibhuti Falls on April 24, Superintendent of Police Uttara Kannada district Narayana M said. According to police, the group's tour guide, identified as Gandhi Sivakumaran (23) from Dharmapuri district in Tamil Nadu, took the students to the seaside near Jatayu Teertha to watch the sunset around 6:20 PM. It was here that Kanimozhi and Hinduja were caught in strong currents and pulled into the sea. Local resident Maniraju attempted to rescue the girls but was himself endangered by the waves. The rescue team from Kudle Beach, using an adventure boat, managed to pull all three ashore and rushed them to the government hospital in Gokarna. However, the two students were declared dead on arrival. Maniraju survived. The incident left the rest of the group traumatised, and they were brought to the hospital for initial care. Arrangements have been made for their accommodation. With no cold storage facility at the Gokarna hospital and delays in the arrival of the victims' families from Tamil Nadu, the bodies have been moved to the district hospital in Karwar. Gokarna police have booked a case under Section 106(1) of the Bharatiya Nyaya Sanhita against the tour guide Gandhi and the travel agency owner Vetrie Selvan for alleged negligence and failure to ensure safety measures during the trip. Both are residents of Tamil Nadu.

Two students of SRM Medical College at Tiruchirappali in Tamil Nadu, drowned in the Arabian Sea, at Gokarna in Uttara Kannada district of Karnataka, on April 24, according to police. Police gave the names of the deceased as Kanimozhi and Hinduja, both aged 23 years. They were final-year MBBS students. They drowned around 5.30 p.m. The deceased were part of a 23-member group of students who were on a tour of Dandeli-Gokarna and Murdeshwara in Uttara Kannada after completing their final examination. The tour was arranged by Vetri Tours and Travels, Chennai. The students had arrived in Gokarna after visiting Dandeli and Vibhuti Falls, near Yana. The two students were washed away while watching the sunset at Jatayu Tirtha, near the Kudle beach in Gokarna. A local person, Maniraju, who went to rescue the students was also caught in the waves. Immediately, local people on a boat brought the trio to the shore and shifted them to the government hospital in Gokarna. While Maniraju survived, Kanimozhi and Hinduja could not be saved. Their bodies were shifted to the mortuary in the district hospital at Karwar. Police have registered a case against the tour guide Gandhi (23) of Iramattur, Dharmapuri district, Tamil Nadu, and Vetri Selvan (29), owner of the tour agency for negligence. They were booked under Section 106(1) (causing death by negligence) of the BNS.
