RCB's senior official Nikhil Sosale granted interim bale by Karnataka High Court

New Delhi [India], June 13 (ANI): Royal Challengers Bengaluru's senior official, Nikhil Sosale, who was arrested over the June 4 stampede during the team's maiden IPL title triumph celebrations, has been granted interim bail by the Karnataka High Court, according to ESPNcricinfo. More than a week after the incident, Sosale and two officials from DNA Networks, the event management company associated with RCB, were released on specific conditions, the most notable of which was the surrender of their passports, according to ESPNcricinfo. ESPNCricinfo also reported that Sosale and all RCB officials who are part of the management team are likely to undergo an internal investigation by the parent company, Diageo. The incident occurred when thousands of fans gathered to catch a glimpse of their favourite players. Eleven people lost their lives and several were injured in a stampede outside Bengaluru's M Chinnaswamy stadium as a huge crowd of nearly 3 lakh people had gathered to witness the victory celebration of RCB. The Karnataka Police had filed an FIR against the Karnataka Cricket Board Administrative Committee, RCB, among others, concerning the stampede incident. Last Saturday, two top Karnataka State Cricket Association (KSCA) officials, secretary A. Shankar and treasurer ES Jairam, resigned, citing 'moral responsibility.' KSCA President Raghuram Bhat confirmed the development, saying that the resignations were discussed and accepted during an emergency meeting. He assured that the cricket body will cooperate with the investigation. 'When the inquiry takes place, we have already told the government and the High Court that we will never shy away from anything that is there. We are ready to cooperate with the investigation,' Bhat told reporters. The Bengaluru Police also filed the first information report (FIR) against the popular IPL franchise last Thursday, as per ESPNCricinfo. The police have said that RCB was not given permission to conduct the event at the stadium. RCB has been listed as the first accused in the FIR, along with DNA Entertainment, the franchise's event partners, and the KSCA, which controls the stadium. RCB expressed 'heartfelt condolences' to the families of the deceased in a statement, and since then has resorted to silence over the matter. (ANI)

PTI The Karnataka High Court granted interim bail to senior Royal Challengers Bengaluru official Nikhil Sosale on Thursday as well as three executives associated with event management company DNA Entertainment in connection with the Bengaluru stampede case. Sosale, marketing and revenue head of Royal Challengers Sports Private Limited, the company that owns RCB, had been arrested at Bengaluru's Kempegowda International Airport on Friday, 6 June – two days after a deadly stampede broke out at the M Chinnaswamy Stadium where franchise was celebrating its maiden IPL title, which had left 11 dead and up to 75 injured. STORY CONTINUES BELOW THIS AD Sunil Mathew and Kiran Kumar, Director and Event Manager of DNA Networks Private Limited, had also been taken into police custody for questioning along with Shamant NP Mavinakere, a freelancer associated with the organisation. Karnataka HC cites 'absence of material' while granting interim bail Justice SR Krishna Kumar of the Karnataka High Court, however, passed an order on Thursday in which he observed that Sosale and the others cannot remain in jail in the absence of material that could establish their involvement in events that led to the tragedy on 4 June. 'The petitioners herein who are officials / employees / directors of RCB and DNA cannot be equated with the said companies and in the absence of any material prior to their arrest to establish their involvement and participation in the event so as to cause the mishap, the petitioners cannot be held to be vicariously liable for the alleged offences especially when they are not even named as accused persons in the subject FIRs,' read an official statement from the Court on Bar and Bench. Sosale, who was catching a flight to Mumbai when he was nabbed by Bengaluru cops, had earlier described his arrest as 'arbitrary' and 'illegal' in his petition before the court. Before granting interim bail to Sosale and the DNA executives, the Karnataka HC had granted interim bail to senior officials belonging to the Karnataka State Cricket Association (KSCA), which owns the Chinnaswamy Stadium where RCB's title celebrations had turned tragic. KSCA secretary A Shankar and treasurer ES Jairam, however, had resigned on 7 June citing 'moral responsibility' over the incident. Karnataka HC grants bail to Sosale, three more in stampede case

The Karnataka high court on Thursday granted bail to Nikhil Sosale, head of marketing at Royal Challengers Bengaluru (RCB), and three others, observing that they were all arrested illegally, without any credible evidence or investigation linking them to the June 4 crush at the Chinnaswamy Stadium in Bengaluru that killed 11 people and injured over 50 others. Justice SR Krishna Kumar said the police 'had neither conducted any investigation nor produced any credible material' to show they had reason to believe that Sosale and the other petitioners were involved in the alleged offences at the time of their arrest. The judge further said that merely holding top positions in the organisations was not enough to justify the petitioners' arrest, especially when they were not named in the FIRs and no material was presented to establish their direct involvement in the incident. Besides Sosale, the court granted bail to Sunil Mathew, Kiran Kumar S, and Shamant NP Mavinakere, all employees of the event management company DNA Entertainment Networks, who were also arrested in the same case. The court directed that all four be released from judicial custody upon surrendering their passports. Justice Kumar observed that since the mandatory conditions under Section 35(1)(c) of the BNSS, 2023 that pertain to arresting someone without a warrant, were not met in the present case, the arrests made by the CCB following directions of the city police were prima facie illegal and arbitrary. 'The impugned arrest of the petitioners is clearly contrary to law and facts and prima facie illegal and arbitrary and the petitioners are entitled to interim bail in the present petitions,' the court said. Justice Krishna Kumar had reserved the verdict on the bail applications filed by Sosale and the others on June 11. At the time, senior advocate Sandesh Chouta, appearing for Sosale, had argued that his client was being unfairly held responsible. Sosale was not a decision maker, but only an employee and hence, there can be no vicarious liability, Chouta had argued. Opposing the bail plea, Advocate General (AG) Shashi Kiran Shetty had argued that RCB bore full responsibility for the stampede that killed 11 people and injured over 50 others. The AG had said the team's last-minute social media posts, including announcements about free passes and open invitations, had triggered the massive and unmanageable crowd outside the stadium that ultimately led to the deadly stampede. When asked by the court if the government's position was that RCB was entirely responsible, the AG had replied in the affirmative. He had then cited an agreement between RCB, BCCI, and DNA Entertainment to show that RCB and DNA were responsible for all arrangements inside the statement as well as crowd management. Sosale and the others have also challenged the legality of their arrest, alleging it was politically motivated and violated constitutional norms.
