Tulip Innovation Obtains Additional Battery Patent Injunction against Sunwoda Group

BUDAPEST, Hungary, July 23, 2025 /PRNewswire/ -- On 17 July 2025, Tulip Innovation won another injunction in German litigation concerning battery electrode and separator technology against the China based Sunwoda Group of companies. The decision issued by the Munich District Court's 7th division adds a third injunction against the Sunwoda Group to two previous injunctions in Germany that were awarded to Tulip by the court in separate cases on 22 May 2025. Tulip is the licensing agent for a portfolio of over 5,000 patents owned by LG Energy Solution and Panasonic Energy, and was represented by Hogan Lovells. The most recent decision arose from Tulip's action against Sunwoda Electronic, Sunwoda Mobility Energy Technology and their German affiliates Sunwoda Europe and Sunwoda Electric Vehicle Battery Germany based on the German part of the European Patent EP 2 378 595 B1. The oral hearing took place on 3 July 2025. The decision in favour of Tulip was handed down two weeks after the hearing, on 17 July 2025, granting Tulip the requested injunctive relief against the batteries at issue. Tulip's requests for additional relief were also granted, including obligations for Sunwoda to recall and destroy any remaining batteries in its direct or indirect possession, pay damages to Tulip in principle, and provide detailed accounting information to enable Tulip to calculate its damages claim. The new injunction underscores the strength and breadth of the battery patent portfolio licensed by Tulip, and confirms that battery manufacturers implementing technology covered by the portfolio will face substantial burdens in litigation if they choose to operate without a license. Giustino de Sanctis, CEO of Tulip, noted: "This decision reinforces the value of Tulip's program and demonstrates our commitment to upholding fair and competitive market conditions in the battery industry. Tulip looks forward to discussing broad licenses under the portfolio with all companies active in lithium-ion battery manufacturing." Andreas von Falck, Hogan Lovells Partner, added: "We are very pleased with this confirmation of the strength of Tulip's patent position by the Munich District Court. The patent in this case has a maximum term of 21 December 2029. The decision is well reasoned and we are confident that the decision will stand on appeal." The patent asserted relates to the combination of electrodes and a battery separator, an important element for the safety and performance of a car battery. The batteries at issue in the case are specific models used in the Dacia Spring but the patent is applicable to any battery model to the extent that it makes use of the patented technology. The decision is immediately enforceable against the provision of security but remains subject to appeal by Sunwoda, and Sunwoda has filed a separate nullity action relating to the patent that is pending. Sunwoda's board passed a resolution this week to aim for a Hong Kong listing. Under the resolution, valid for two years, the company would offer less than 15% of its total number of issued shares, including new shares. Already listed on the Shenzhen Stock Exchange, it would become a dual-listed company.

A slew of mainland-listed Chinese technology companies are speeding up fundraising plans in Hong Kong to capitalise on the upbeat market sentiment. Hong Kong's equity market has been buoyed by mainland investors' record buying of HK$731.2 billion (US$93.1 billion) of stocks in the first half of the year, according to Hong Kong Exchanges and Clearing (HKEX) data and Bloomberg on Monday. The buying spree, driven by attractive valuations and a re-rating of China's technology sector, has led to a growing number of A-share companies seeking dual listings in Hong Kong. From electric vehicle battery maker Sunwoda Electric Vehicle Battery to biopharmaceutical maker Changchun High-Tech Industry Group and smart-city solutions provider PCI Technology Group, companies are keen to take advantage of the city's deep liquidity pool, international investor base and favourable valuations to accelerate their global expansion, diversify their funding sources and enhance their international profiles. Li Auto LI has submitted its second fully electric SUV, the Li i6, for regulatory approval in China, with its official launch anticipated in about three months. The vehicle was listed in the latest catalog of new models released by China's Ministry of Industry and Information Technology, which is open for public feedback from June 21 to 27. Inclusion in this catalog represents the final major hurdle before a model is allowed to enter the Chinese Li i6 appears in three versions in the catalog with models designated as LXA6503BEVW01, LXA6503BEVW02 and LXA6503BEVW03. The first is a dual-motor variant featuring a 150 kW front motor and a 250 kW rear motor. The other two are single-motor variants with a peak output of 250 kW. All share similar dimensions: 4,950 mm in length, 1,935 mm in width, 1,655-1,670 mm in height and a 3,000 mm of Li i6 will take place at Li Auto's facilities in Beijing and Changzhou. The vehicle has a curb weight ranging from 2,380 kg to 2,515 kg and can reach speeds up to 180 km/h. It will be powered by lithium-iron phosphate batteries sourced from CATL and Li Xiang, founder, chairman and CEO of Li Auto, the Li i6 is a roomy two-row, five-seat electric SUV, positioned as an alternative for families considering premium models like the Mercedes-Benz GLC, BMW X3 or Audi Q5. It is slated to release in September. Xiang also posted images of the SUV's exterior on Auto is best known for its extended-range electric vehicles, such as the Li L6, L7, L8 and L9, all SUVs.
