'Nuclear option': Mistrial in Edmonton sexual abuse case stemmed from concerns about defence lawyer
Millsap weighed the possibility of recalling witnesses, including the complainant, to allow for additional questioning, but he did not believe it would fix the problem. 'I am left with considerable doubt at this point whether defence counsel has a good enough working knowledge of the rule (in Browne and Dunn) such that it would be complied with, even if witnesses were recalled,' he said. 'And I say this with all due respect.' Iguisi also 'purposefully or inadvertently' introduced character evidence about her client, which is rarely done in sexual assault trials because it opens the door for the Crown to call evidence undermining the accused's character, Millsap said. 'While Mr. NB has the right to his choice of counsel, and his counsel has the right to the conduct of the defence of choice and in the manner they so choose, when the conduct of that defence brings into question or raises a reasonable possibility of a miscarriage of justice, the court must intervene.' Millsap also made note of the fact NB is a person of colour, which he said the court must consider, given the 'serious overrepresentation of persons of colour in Canadian jails.' While that does not change the legal test for declaring a mistrial, 'I must be conscious of it,' he said. Millsap did not believe either recalling witnesses or a special jury instruction could salvage the trial. He said a mistrial — which is considered a 'nuclear option' — was the only path forward. 'I cannot be convinced in any way that a fair trial has been conducted this week,' he said. Millsap added, 'This trial has been fatally wounded by a thousand cuts, and I personally take responsibility for my role in allowing those cuts to be incurred. For that, I apologize.' After dismissing the jury, Millsap addressed Iguisi personally, telling her she has a 'very difficult' job which he believed she did 'to the very best' of her ability. 'I mean no disrespect to you in my decision,' he said. 'I do hope you'll give consideration as to whether you should continue on this file or request a more experienced senior lawyer to take it over for your client's best interest.' Millsap said he hopes Iguisi will be able to put the case behind her 'and go on to become a good lawyer — a good, competent lawyer that I think you can go on to become.' 'I just want you to know I mean no disrespect, but I think I had to do what I had to do.' NB is next in court in October for a pre-trial conference, with jury selection set for Sept. 17, 2026. Edmonton Oilers announce coaching roster changes
Edmonton Oilers head coach Kris Knoblauch will have some new faces with him behind the bench next season. In a Monday morning release, the club named a trio of new coaches to the staff: Paul McFarland, Peter Aubry and Conor Allen. McFarland joins the Oilers after a season as the Calgary Hitmen's bench boss. This marks a return to the NHL after working as an assistant for three seasons with the Seattle Kraken, following stints with the Florida Panthers and Toronto Maple Leafs. Aubry is the new goaltending coach, taking over for Dustin Schwartz, whose contract was not extended. Most recently, he was an associate coach for Nebraska-Omaha in the NCAA, as well as a developmental goaltending coach for the Chicago Blackhawks. Paul Coffey, who has worked with the team's defence corps, will return to his prior role as a special advisor to ownership and hockey operations. 'In a really good spot': New blood, new team, new blueprint as Oilers build for another Cup run
'We're doing our job and talking to teams and agents but nothing out there really made any sense for us to move forward on. Where we are now makes the most sense for us.' With Mangiapane joining Connor McDavid, Leon Draisaitl, Zach Hyman and Ryan Nugent-Hopkins in the top six, there is still one opening on the first two lines. But that's not an item on Bowman's shopping list going froward. 'I would expect it to come from within,' he said. 'We have a number of guys who played in that role last year, Kapanen and Podkolzin did stretches. I expect Matt Savoie to be on our team and to play a role. We have David Tomasek.' He also sees Trent Frederic and even Adam Henrique as possible options. 'We don't just have just one person we're hoping to fill it. We're going to try some different looks. We have a number of internal candidates who deserve the opportunity to show us what they can do. I wouldn't be expecting to add anything else to that part of our team.' As for the Evan Bouchard signing, while some people are sad about the $10.5 million tag for just four years, a long-term deal was never going to happen. And playing hardball left the Oilers open to an offer sheet. Players and agents are well aware that the salary cap is about to skyrocket, so they don't want to lock in for eight years unless it is for a massive number that would destroy Edmonton's cap space in the short term 'We were going for an eight-year deal but that was never really in the cards,' said Bowman. 'The agent indicated that wasn't something they thought made sense for them. A number for an eight-year deal was so high it wouldn't have made sense for anybody.' Now that the team is set, Bowman and head coach Kris Knoblauch are now on the hunt for a replacement for Gulutzan. 'That's something we have to spend some time on now,' said Bowman. 'We haven't had a chance to focus on that, the full attention has been on free agency. Starting today the top priority is to round out our coaching staff.'
