Udaipur Files producers move SC challenging Delhi HC stay order on release

The makers of Udaipur Files: Kanhaiya Lal Tailor Murder have moved to the Supreme Court against the Delhi High Court's order that put a hold on its release. The film was set to release on Friday. A day before its release, the High Court blocked the film's release. The Supreme Court has agreed to hear a petition filed by the makers. Senior Advocate Gaurav Bhatia, representing the producers, told the court that the movie had already been approved by the Central Board of Film Certification (CBFC), and stopping its release is a violation of their fundamental rights. ANI quoted Advocate Pulkit Agarwal saying, "We have requested the Supreme Court to cancel the Delhi High Court's order and allow the movie to be released. The court said it will take up the matter in the next 2-3 days." Meanwhile, the stay on the film release will remain in place until the central government decides on a revision application filed by Jamiat Ulema-i-Hind, which challenges the CBFC's approval of the film. A Division Bench of Chief Justice Devendra Kumar Upadhyaya and Justice Anish Dayal passed the interim order while hearing two petitions, one by Jamiat Ulema-i-Hind and another by journalist Prashant Tandon. The petitioners argued that the release of the Udaipur Files could disturb communal harmony, posing a serious threat to public order, given the sensitive nature of the subject. Udaipur Files is based on the 2022 murder of Kanhaiya Lal, a tailor in Udaipur, Rajasthan, who was killed by two men allegedly angered by a social media post in support of former BJP spokesperson Nupur Sharma. The incident had triggered national outrage. The Court observed that since the petitioners had been relegated to invoke the revisional remedy under the Cinematograph Act, 1952, the release of the film must remain stayed until a decision is made on their application for interim relief. "We provide that till the grant of interim relief is decided, there shall be a stay on the release of the film," the bench said. The petitioners also claimed that the film sensationalises the incident and may further inflame tensions. They also raised questions over the timing of the film release, just ahead of upcoming elections in several states across India. The film stars Vijay Raaz, Rajneesh Duggal, and Preeti Jhangiani. The Supreme Court Monday agreed to hear 'in a day or two,' an appeal challenging the Delhi High Court order staying the release of the movie Udaipur Files: Kanhaiya Lal Tailor Murder based on the crime carried out by alleged Islamic fundamentalists in the city in Rajasthan. Senior Advocate Gaurav Bhatia, who appeared for the producers of the movie, mentioned the appeal against the Delhi High Court order before a bench of Justices Surya Kant and Joymalya Bagchi, seeking an urgent listing. The HC order came on July 10, a day ahead of its scheduled release on July 11. Bhatia said the Central Board of Film Certification (CBFC) had cleared Udaipur Files for release, and theatres were booked. 'I had the certificate. All theatres were booked…'. He pointed out that the SC had refused to give an urgent hearing to a plea by an accused in the case seeking a stay on the film's release. 'I must say with some responsibility that it's a case of violation of fundamental rights. SC refused to give a hearing, but Delhi HC interfered and stayed the release,' he said. Bhatia added that advance ticket bookings were accepted, and all arrangements were in place for the film's release, when the Delhi High Court issued the stay. The Delhi High Court order came on a plea by Maulana Arshad Madani, the principal of the Darul Uloom Deoband, and others. They contended that the movie, purportedly based on the murder of tailor Kanhaiya Lal by alleged Islamic fundamentalists in 2022, is 'replete with dialogues and instances that had led to communal disharmony in the very recent past and thus carry every potential to again stoke the same communal sentiments'. The Division Bench of Chief Justice D K Upadhyaya and Justice Anish Dayal relegated the petitioner to the Central government to seek a review of CBFC's decision to grant a certificate green-lighting the release of the film. The HC-directed stay shall be operational until the Centre decides on the application for interim relief that Madani may request, including suspension from the exhibition of the film. As per the court-directed timelines, the HC-directed stay can then range from July 14 until a maximum of July 21. CBFC informed the high court that the film had already undergone 55 cuts that it directed the makers to incorporate. The Centre, too, argued that the film is not community-specific but rather 'crime-specific'. Kanhaiya Lal was allegedly hacked to death by Mohammad Riyaz and Ghouse Mohammad at his shop in Udaipur on June 28, 2022, over a post shared by him on social media in support of suspended BJP spokesperson Nupur Sharma, who made some comments about the Prophet during a live television debate.

Jammu (Jammu and Kashmir) [India], July 13 (ANI): Senior advocate Vishnu Shankar Jain on Sunday said he disagreed with the Delhi High Court's decision to stay the release of the film 'Udaipur Files: Kanhaiya Lal Tailor Murder.' Jain said the stay order is a 'total violation of the set mandates of the law'. Speaking to ANI, Vishnu Shankar Jain said, '... I do not agree with the order of the Delhi HC. It is a total violation of the set mandates of the law so far. In a democratic setup, a pre-publication ban has been considered an extreme step. Putting a stay on the movie is absolutely wrong. The court refused to put a stay on many movies saying it would be a violation of the freedom of speech and expression.' He added that in a democracy, banning a film before its release is an extreme step and questioned how a film based on a real incident like Kanhaiya Lal's murder could harm social harmony. 'The HC has also said that if it bothers anyone, they should not watch the movie. Kanhaiya Lal, the the victim who was brutally murdered in Udaipur, has not been given justice, and if a film has been made on this incident, I don't understand how will it disturb the social harmony,' Jain said. The Delhi High Court on Thursday ordered a stay on the release of the film 'Udaipur Files: Kanhaiya Lal Tailor Murder', which was scheduled to hit theatres on July 11.
