Commission extends application deadline to July 21 ‘after tech issues'
1 2 Kolkata: The West Bengal School Service Commission on Sunday extended the application deadline for the fresh selection test to July 21. Candidates from the 2016 recruitment panel have begun applying for the fresh test and the number of applicants has started increasing following the court order barring tainted candidates from appearing for the exam. A notice by the commission stated that due to some technical issues, the date has been extended. Earlier, it was supposed to close on Monday. An official confirmed that around 500 applications have come from eligible teachers from the 2016 recruitment panel so far, which saw a sharp surge from Sunday morning. "Initially, very few applications had been received from candidates on the 2016 recruitment panel. However, the numbers started rising today. Many who were earlier reluctant to appear for the exam have changed their minds after the HC order," said a WBSSC official. Calcutta HC dismisses plea of govt, SSC against debarring ‘tainted' candidates from fresh recruitment
A Division Bench of the Calcutta High Court on Thursday dismissed the petitions of the West Bengal School Service Commission (WBSSC) and the state government, challenging the single bench order of debarring 'tainted' candidates from appearing in the fresh recruitment examination. Upholding the order of Justice Saugata Bhattacharya debarring identified tainted candidates from taking part in the fresh recruitment process, the Division Bench of Justice Soumen Sen and Justice Smita Das De dismissed the appeals of the WBSSC and the state government. Appearing for the SSC, senior counsel Kalyan Banerjee argued that denying 'tainted candidates' from taking part in the fresh hiring would tantamount to 'double punishment'. Stating that the Supreme Court, while cancelling the appointment of nearly 26,000 teaching and non-teaching staff, 'was careful enough not to debar them from future employment'. 'A penalty was imposed on them (tainted candidates) for committing the offence. They were asked to return their salary, and their jobs were taken away. Now, the question arises, will they get double punishment and be punished for life? Doesn't it violate the Constitution? No criminal charges have been proved against these 'tainted' candidates, but stringent punishment has been imposed on them. If they are not allowed to participate, it will be double punishment,' Banerjee submitted Advocate General Kishore Dutta, representing the state government, said: 'The Supreme Court has given harsh punishment to the tainted candidates, but was careful enough not to debar them from future employment. Fundamental rights cannot be curtailed.' However, senior counsel Bikash Ranjan Bhattacharya, appearing for the unsuccessful candidates, claimed that the Supreme Court in its order had not said that candidates can be appointed whose exam and results were declared void. 'The participation is confined to untainted and not specifically tainted. Tainted candidates cannot participate in the recruitment process. The state government and the SSC knew that tainted candidates were debarred from everything… The May 30th recruitment notice completely destroys the Supreme Court's order. Where in the Supreme Court order does the State get 'further vacancies'? This incorporation is directly misleading. With the introduction of new vacancies, the State wants to upset the Supreme Court's judgment. The argument of double punishment has no bearing,' Bhattacharya told the High Court. Senior counsel Aninda Mitra, representing the untainted candidates, claimed 'circumstances were created by the tainted candidates in collusion with the officers of the Commission'. 'Prosecution cannot be two times, but for one prosecution, there can be multiple punishments. The Supreme Court had terminated their jobs and ordered them to refund money. So, two punishments were given by the Supreme Court. Thus, there is no question of double jeopardy,' Mitra said. On April 3, the Supreme Court had upheld the Calcutta High Court order, which invalidated the appointment of over 25,000 teachers and non-teaching staff, recruited through the 2016 WBSSC examinations, terming the entire selection process 'tainted beyond resolution' and calling for a fresh selection process to fill the vacancies. Later, the Supreme Court extended the services of 'untainted' candidates employed as assistant teachers for Classes 9-12 until December 31, asking the state government to complete fresh recruitments by then. A month later, the WBSSC issued a notification for the recruitment of over 35,000 school staff. Last Monday, the single judge HC bench debarred tainted candidates from the fresh recruitment.

Kolkata: A division bench of the Calcutta high court on Thursday upheld the July 7 order of a single bench to bar identifiable tainted recruits from the 2016 panel — whose appointments were cancelled by the Supreme Court in April in the bribe-for-job case — from appearing for the fresh selection test for Bengal government school teachers, lawyers who attended the hearing said. The Supreme Court on April 3 cancelled the appointment of 25,752 school teachers and non-teaching staff (Group C and D) from the 2016 recruitment panel. On an appeal by the state, the top court on April 17 allowed non-tainted teachers to continue in service until December 31 but required them to appear for the fresh selection test. The notification for the test was published by WBSSC on May 30. However, it did not specify that only non-tainted teachers could appear for it. According to the WBSSC, 1,801 teachers recruited from the 2016 panel were identified as tainted during the investigation in the bribe-for-job case, and 188 of them figure among the 2,60,000 applicants for the upcoming selection test. The division bench said applications filed by the tainted teachers for the fresh test should be scrapped as ordered by the single bench. Trinamool Congress Lok Sabha member and senior lawyer Kalyan Banerjee, who appeared for WBSSC, argued that it was a violation of Article 20(2) of the Constitution, which protects citizens from being punished twice for the same offence. Banerjee said the alleged tainted teachers were being penalised a second time, as they had already lost their jobs following a Supreme Court order, and that the April 17 order did not specifically state that the tainted teachers could not appear for a fresh test. 'We have to obey the order. I cannot say anything against it right now. We repeatedly told the court that of the 0.26 million applicants for the fresh test, only 188 are identified as tainted,' Banerjee said. Senior advocate Bikash Ranjan Bhattacharya, who represented the untainted teachers, said, 'The division bench dismissed the petitions the Trinamool Congress (TMC) government and the West Bengal School Service Commission (WBSSC) filed challenging the single bench order.' Some shortlisted candidates from 2016, who also filed petitions before the bench of justice Bhattacharyya, alleged that WBSSC violated the 2016 recruitment rules by altering the weightage criteria for different components in the ongoing selection process. The commission has earmarked 10 marks each for 'prior teaching experience' and 'classroom demonstration'. This is a major deviation from the rules under which the 2016 tests were held, the petitioners said. The petitioners moved the bench of justice Bhattacharyya alleging that tainted teachers were being given an opportunity to get their jobs back. 'It is unfortunate that we had to put up arguments in court despite the Supreme Court specifically saying that only the untainted recruits can sit for the examination. The sole intention of TMC was to derail the Supreme Court's direction because it wants to shield corruption,' Bikash Ranjan Bhattacharya, who is also a CPI(M) Rajya Sabha member, said. No TMC leader commented on Thursday's order till evening. Targeting the ruling party, Bengal BJP president Samik Bhattacharya, 'TMC has time and again used taxpayers' money on court cases so that it can protect the corrupt. It has lost each and every case.' The alleged corruption hit the headlines in May 2022 when the High Court ordered the Central Bureau of Investigation to probe the appointment of non-teaching staff (Group C and D) and teaching staff by WBSSC and the West Bengal Board of Secondary Education between 2014 and 2021, when TMC's Partha Chatterjee was education minister. The Enforcement Directorate, which started a parallel probe, arrested Chatterjee in July 2022. The ED filed charges against him, ex-primary education board president and legislator Manik Bhattacharya, and 52 others in January this year.
