TD Gary Gannon files legal proceedings against Central Bank over Israeli bonds
Social Democrat TD Gary Gannon has filed legal proceedings against the Central Bank over its role in facilitating the sale of Israeli bonds on the European market. McGarr Solicitors lodged papers with the High Court on behalf of the Dublin Central TD on Thursday. Mr Gannon is seeking a court order requiring the Central Bank to exercise its powers under European regulations to prohibit the marketing, distribution or sale of bonds issued by the state of Israel. Court papers show he is also seeking an order requiring the bank to 'properly consult' with the 'competent authorities in other member states that may be significantly affected by the action'. The bank is the designated authority in relation to the sale of Israeli bonds in the EU. The Central Bank's governor, Gabriel Makhlouf, told the Oireachtas Finance Committee last month that Israel has raised between €100 million and €130 million from the bonds. He said the Israeli government website marketing its 'war bonds' had stated it had sold bonds worth €5 billion. He said the EU accounted for only a fraction of that, with the US accounting for the bulk of it. On what the bank can and can't do, he said: 'The Central Bank cannot decide to impose sanctions for breaches or alleged breaches of international law. It is for international bodies such as the UN or the EU to determine how to respond to breaches or alleged breaches of international law.' Mr Gannon issued letters to the bank about investor protection concerns relating to the bonds, as well as the use of the bonds to finance the war in Gaza at the end of last month. In response, the Central Bank, through its solicitors, said in a letter that there is 'no valid legal basis' to support Mr Gannon's purported judicial review proceedings. It claimed that Mr Gannon lacked the 'necessary locus standi' or right to bring the proceedings, and said the bank was satisfied it did not meet the relevant criteria to exercise its powers under EU law. The letter also stated that judicial review proceedings would lead to court time being 'expended unnecessarily and substantial costs being incurred'. They are a funding pipeline for a military campaign that includes the bombardment and starvation of thousands of civilians. 'While this is a technical case grounded in EU investor protection law, the issues at stake are deeply moral and ask whether our laws, Irish, European, and international, have the capacity to respond to that reality.' He added: 'If financing a regime accused of genocide doesn't meet that threshold, what does?'

Arsenal have broken their silence after former midfielder Thomas Partey was charged with five counts of rape and one count of sexual assault, just days after his contract at the Emirates expired. In a brief statement issued to the BBC, the club said: 'The player's contract ended on June 30. Due to ongoing legal proceedings the club is unable to comment on the case.' The 32-year-old Ghana international, who spent five seasons in north London, is accused of attacking three women between 2021 and 2022 following a three-year investigation by Scotland Yard. He is now due to appear at Westminster Magistrates' Court on August 5. Partey, who was signed by Arsenal for £45million from Atletico Madrid in 2020, denies all the charges against him. In a statement released through his lawyer Jenny Wiltshire of Hickman and Rose, Partey said he 'welcomes the opportunity to finally clear his name' and has 'fully cooperated with the police and CPS throughout their investigation'. The Crown Prosecution Service confirmed that the charges were authorised after it 'carefully reviewed a comprehensive file of evidence'. According to the Metropolitan Police, two counts of rape relate to one woman, three counts of rape relate to a second woman, and the sexual assault charge relates to a third woman. None of the alleged victims can be named for legal reasons. The investigation began in February 2022, with Partey first arrested in July of that year, though he was not publicly named at the time and continued to play for Arsenal while on bail. It has since emerged that he made over 50 appearances for the club during the period in which the investigation was ongoing. Detective Superintendent Andy Furphy, who is leading the investigation, said: 'Our priority remains providing support to the women who have come forward. We would ask anyone who has been impacted by this case, or anyone who has information, to speak with our team.' Partey left Arsenal last month following the expiry of his contract, with reports suggesting negotiations over a new deal had stalled weeks earlier. The midfielder has been training in Ghana as he looks for a new club and recently won the Ghana Footballer of the Year award. He made 167 appearances for Arsenal, scoring nine goals, and was part of the side that won the Community Shield in 2023. Despite injury setbacks, Partey returned to feature regularly last season as Mikel Arteta's side finished second in the Premier League and reached the Champions League semi-finals. In a recent interview discussing his future, Partey said his family would play a decisive role in where he plays next, explaining: 'I think the first thing is where are you happy and where do you feel at home… there are a lot of things where you have to look now with a family, where you want them to be happy.'

Federal prosecutors tell judge they will deport Kilmar Abrego Garcia to a third country after detention
Federal prosecutors on Thursday told a judge that the Trump administration will begin removal proceedings against Kilmar Abrego Garcia to deport him a country other than his native El Salvador if he is released from a Tennessee jail. When U.S. Magistrate Judge Paula Xinis asked about the timing of the removal: "30 seconds or 30 days or 30 months…," a federal prosecutor answered that he could only say the removal was not "imminent." Xinis has scheduled a hearing on the matter for July 7. At issue is whether the judge has the jurisdiction to order Kilmar Abrego Garcia's return to Maryland. Abrego Garcia's attorneys want Xinis to order the government to return their client to Maryland and to bar U.S. Immigration and Customs Enforcement (ICE) officials from deporting him while his criminal case in Tennessee proceeds. Abrego Garcia is currently in federal custody and has been indicted on human smuggling charges, which he denies. The lawyers for Abrego Garcia filed an emergency motion on Thursday asking a judge to order his return to Maryland, and to block immigration officials from deporting him while his criminal case in Tennessee continues to play out. They told Judge Xinis that they have concerns "that the government may try to remove Mr. Gregor Garcia quickly over the weekend." Another federal judge in Nashville has ruled that Abrego Garcia has a right to be released while awaiting trial. However, on Wednesday, she decided to keep him in custody for at least a few more days over concerns that U.S. immigration officials would swiftly try to deport him again. "If this Court does not act swiftly, then the Government is likely to whisk Abrego Garcia away to some place far from Maryland," Abrego Garcia's attorneys wrote in their request to Xinis in Greenbelt, Md. Abrego Garcia was living in Maryland with his American wife and children when he was deported to El Slavador in what the Trump administration called an administrative error. He had been in the United States for over a decade. Meanwhile, the Trump administration maintains that Abrego Garcia was a member of the MS-13 gang, an accusation that he denies. In addition, his wife, Jennifer Vasquez Sura, filed a protective order against her husband in August 2020. The order said their shared son and stepchildren needed protection from Abrego Garcia, accusing him of verbal and physical abuse against her and mental abuse against her children. Earlier this month, Abrego Garcia pleaded not guilty to smuggling charges.

Facing 743 data-tampering charges, ex-pay TV staff collapses in court, sent for psychiatric assessment
KUALA LUMPUR, June 26 — The Sessions Court here today ordered a former employee of a pay television station who is facing 743 charges of tampering with clients' account data to undergo a month's observation at Hospital Bahagia Tanjong Rambutan, Ulu Kinta, Perak. Judge Norma Ismail ordered Nora Idayu Jaafar, 48, to be sent to the hospital after her lawyer, Daniel Annamalai, informed the court that he received a letter from a clinic, dated June 6, requesting that the accused be sent for psychiatric assessment as she is suspected of suffering from post-traumatic stress disorder (PTSD). 'The accused is hereby sent to Hospital Bahagia for observation for one month. Since the accused is on bail, the accused must go to the hospital on June 30,' said the judge, who then set July 29 for mention. Deputy Public Prosecutor Rohaiza Abd Rahman appeared for the prosecution. Meanwhile, in today's proceedings, the court took almost two hours to read out 132 of the 743 charges against Nora Idayu, who had fainted in court after the 30th of 743 charges was read out to her last June 4. She collapsed in the dock shortly after entering her non-guilty plea to the 30th charge. The proceedings had to be halted while the court's security personnel and medical assistants from the Kuala Lumpur Hospital were deployed to the courtroom. Nora Idayu, who was with the commercial support unit, is accused of converting the regular client's account to a corporate account without authorisation at Astro's office in Menara Icon at Jalan Tun Razak here in 2014. The charges are framed under Section 5(1) of the Computer Crimes Act 1997, which provides a maximum fine of RM100,000 or a jail term not exceeding seven years or both upon conviction. — Bernama

Lehrmann pushes to stop rape trial
Former Liberal Party staffer Bruce Lehrmann has taken a dramatic step to halt his upcoming rape trial, filing an application that alleges police unlawfully recorded conversations with his legal team. The 29-year-old former Liberal Party staffer was charged with two counts of rape over an alleged incident in Toowoomba in October 2021. Mr Lehrmann's Sydney-based lawyer, Zali Burrows, lodged a fresh application in the Toowoomba District Court on Monday, requesting a permanent stay of proceedings. It followed the Office of the Director of Public Prosecutions (ODPP) filing an affidavit last Friday that the defence argues failed to include all relevant material in the case. The matter was briefly mentioned in the Ipswich District Court on Wednesday, as the Toowoomba District Court was not sitting. Mr Lehrmann and Ms Burrows both appeared via phone. The permanent stay application stems from allegations that police unlawfully recorded phone calls with Mr Lehrmann's lawyer. According to the defence, an officer failed to initially disclose six items, including four audio recordings of conversations between her and Mr Lehrmann's former legal representative, two recordings involving the alleged victim, and one with a witness. Judge Dennis Lynch ordered all material the parties intend to rely on, including affidavits and written submissions, to be filed by July 14 for the applicant and July 21 for the respondent. He adjourned the case to the previously scheduled date of July 25 when the permanent stay application will be heard alongside a separate defence application for full disclosure of police material. While Queensland law permits individuals to record conversations they are a party to, NSW law, where all of Mr Lehrmann's legal representatives are based, requires consent from all parties or specific exemptions. In May, Ms Burrows lodged an application seeking full disclosure of all material in the Queensland Police Service's possession. The ODPP's affidavit filed last week was in response to that request. If the permanent stay application succeeds, the rape charges against Mr Lehrmann could be dropped. Mr Lehrmann's bail was formally extended, and the matter is scheduled to be heard on July 25 at the Toowoomba District Court. He has indicted that he will defend the charges but is yet to enter any pleas.
