Lotaburger employee allegedly guns down man during argument

Jun. 27—A Blake's Lotaburger employee walked out of the restaurant and killed a man in the parking lot during a dispute over an unpaid debt, according to the Albuquerque Police Department. Christian Elycio, 21, is charged with an open count of murder in the death of 46-year-old Edward Nicholas. APD spokesman Gilbert Gallegos said officers arrested Elycio on Friday afternoon. It is unclear if Elycio has an attorney. Officers responded around 10 p.m. to the Lotaburger on Rio Grande, just south of Interstate 40 in the Old Town area, and found Nicholas dead in the parking lot, according to a criminal complaint filed in Metropolitan Court. Nicholas had been shot 10 times, and his friend told police an employee shot him after telling the pair to leave. Police said another employee told them that Elycio, whose uncle also worked at the restaurant, shot Nicholas and fled afterward in a truck. The employee said Elycio had been in an argument with Nicholas beforehand. Elycio's uncle told police he and Nicholas were arguing because he owed Nicholas money from a bicycle purchase, according to the complaint. The uncle said Elycio came outside and shot Nicholas multiple times. Police said the uncle told them Elycio then stood over Nicholas and continued to shoot him. Surveillance cameras caught the shooting on tape and, according to police, showed that Nicholas was walking away when Elycio started firing.

Fugitive who fired at US Marshals agents is fatally shot in Mesa

A man identified by authorities as a known gang member was shot and killed in Mesa after opening fire on federal agents who were attempting to arrest him on multiple fugitive warrants. The U.S. Marshals Service confirmed that law enforcement officers were involved in the shooting on June 27 near 32nd Street and Baseline Road. The East Valley Critical Incident Response Team was investigating the incident. Hours after the afternoon shooting, the agency had not released the man's identity. According to the U.S. Marshals Service, the man was wanted on multiple warrants — including aggravated assault, aggravated assault involving domestic violence, disorderly conduct with a weapon, misconduct involving weapons, threats, and assault—when Marshals and Mesa police officers attempted to take him into custody. Authorities had the man under surveillance, and when he drove from a residence, they attempted to stop him, the Marshals said. That's when he fired 'multiple' rounds at the authorities, who shot him dead. No police were injured in the incident, and the agency didn't say whether anyone else was involved. Authorities were searching for the man as part of a 22-agency task force focused on apprehending fugitives across Arizona. According to the U.S. Marshals Service, the task force has captured more than 2,100 individuals over the past year, prioritizing the most violent offenders and sexual predators. Spokane police officers who shot and killed man following an arson determined justified

Jun. 27—Two Spokane police officers who shot and killed a man after an arson in 2024 were found justified in their actions Friday by the Spokane County Prosecutor's Office. Alan Jenks, 38, was seen leaving a house fire at 1820 W. Dean Ave. in West Central in March 2024. First responders had pulled multiple people from the home and were investigating the blaze as an arson. Officers Brandon Roy and Andrew Willis went to speak to Jenks as he stood on the sidewalk near the home. Officers were in the process of detaining him to further investigate an outstanding warrant when he fired a gun from inside his sweatshirt pocket, a news release from the prosecutor's office said. Officers pushed themselves away from Jenks and returned gunfire, the release said. He died at the scene. Toxicology testing showed Jenks had multiple controlled substances in his system at the time of his death, according to the release. Because the officers were found justified in their use of deadly force, they will not face criminal charges.
