Mizoram boxing coach held on charges of raping women pugilists

Aizawl: Boxing coach Lalthlengliana was arrested on Tuesday and booked under relevant sections of the Protection of Children from Sexual Offences Act (POCSO), 2012, at the women police station in Aizawl for allegedly sexually abusing four sub-junior women boxers who represented Mizoram in the 6th Junior (U-17) Boys and Girls National Boxing Championships recently held in Haryana's Rohtak, reports HC Vanlalruata.
Police said the four girls lodged a complaint to the Child Welfare Committee (CWC) in Aizawl after which an FIR was lodged at the police station on Tuesday, resulting in the arrest of Lalthlengliana on the same day. The women boxers complained that the boxing coach sexually abused them even while they were undergoing training at the Mizoram Boxing Association (MIZBA) boxing hall at the Ramhlun Sports Complex in Aizawl.
It is not yet known if another complaint will be submitted against the MIZBA leaders for sending a male coach to look after under-aged women boxers.

New Delhi: Denying bail to a man in a POCSO case, Delhi High Court on Friday observed that mere public outcry and media coverage of the incident cannot diminish the gravity of the offence. A single judge bench of Justice Girish Kathpalia observed that the court cannot minutely examine the evidence on record and that the broad picture showed the gruesome manner in which an eight-year-old girl was raped and killed, that too by her cousin. He said, "Merely because there was public outcry and media coverage of the incident, the gravity of the offence does not diminish." According to the prosecution, the accused committed rape upon an eight-year-old girl, strangled her, and hid the dead body in a plastic bag in a pit. He said that there was doubt regarding the time of death of the girl. The FIR was registered in 2016 for offences under Section 302 (murder), 363 (kidnapping), and 201 (causing disappearance of evidence) of IPC, and Section 6 (aggravated penetrative sexual assault) of the POCSO Act. The bench noted that while prolonged incarceration is certainly a ground for releasing the accused on bail, it is not the solitary one. One also cannot ignore that a relationship of trust between the cousins was exploited by the accused/applicant in such a brutal manner." The counsel of the accused, referring to the post-mortem report of the girl, submitted that the entire autopsy was carried out within one hour, which raisesdoubt over its correctness. Raipur: The Chhattisgarh High Court upheld the conviction of two youths in a gang rape case under the Protection of Children from Sexual Offences (POCSO) Act. The two were sentenced to 20 years of rigorous imprisonment by a special judge ( POCSO Act ) in Bilaspur on Feb 19, 2021. The special judge convicted the accused and sentenced them to 20 years of RI under Section 376D of IPC, one year of RI under Section 323 with Section 34 of the IPC, and two years of RI under Section 506 of the IPC. All sentences were directed to run concurrently. A division bench comprising Chief Justice Ramesh Sinha and Justice Bibhu Datta Guru noted, "In evaluating the testimony of a survivor of a sexual offence, the court's approach is nuanced, recognising the inherent trauma and potential inconsistencies in the survivor's account. The court does not require an exacting or flawless recounting of the incident. Rather, it focuses on permitting the survivor to share her narrative to the best of her ability, based on her recollection of events, within the bounds of reasonable possibility. The survivor told the court that when she went to the toilet in courtyard, the accused—who were 19 and 20 years old at the time—gagged her, tied her hands and legs, and took turns raping her. They also beat her and threatened her with a knife. Hearing noises from the toilet, the survivor's elder sister and brother raised an alarm, prompting the accused to flee. The survivor immediately informed her siblings and a neighbour about the incident & a report was lodged at Malhar police post. The case was later transferred to Masturi police station, where a chargesheet was filed. In its judgment, the High Court noted that the survivor's age at the time of the incident—16 years, 7 months, and 15 days—fell within the definition of a "child" under the POCSO Act. The court stated that the survivor's testimony was corroborated by her siblings, who were present at the scene, and a medical report that confirmed forceful sexual intercourse and related injuries. Dismissing the appeal, the court held that the prosecution successfully proved its case beyond reasonable doubt. It also observed that in cases of sexual assault, the survivor's testimony carries substantial weight and does not necessarily require corroboration. The court remarked that a rapist degrades the very soul of the survivor and emphasised that such cases must be handled with utmost sensitivity. The sentences for the other offences under Sections 323/34 (voluntarily causing hurt) and 506(b) (criminal intimidation) of the IPC were also upheld. Korba: Four prisoners facing trial in rape and POCSO Act cases escaped from a district jail in Chhattisgarh's Korba district on Saturday, a police official said. He identified the four as Dashrath Sidar (19), Chandrashekhar Rathia (20), Raja Kanwar (22) and Sarna Sinku (26). "Between 3pm and 4pm, they fled after climbing a cowshed wall inside the prison using a rope. They were undertrials in cases filed for rape and provisions of Protection of Children from Sexual Offences (POCSO) Act. Rathia was from Raigarh, while the other three are from Korba," he said. Efforts are on to nab them, while a probe has begun on how they managed to escape, the official added.
