Judge Mbenenge: 'She called me cute — I appreciated it'
During her evidence-in-chief in January, Mengo alleged that during a conversation in June 2021 between herself and the judge he sent her a series of messages which he later deleted.
'My version is those were mere sensual chats, I did not send her any picture,' said Mbenenge.
When asked by his lawyer Muzi Sikhakhane if he sensed any discomfort from Mengo during their messages exchange, Mbenenge replied: 'Not at all.'
On Monday Mbenenge told the tribunal that since the complaint had been laid he had been vilified in the public eye and treated as though he was guilty before the complaint had been investigated.
The tribunal hearing continues.

On 20 June 2021, high court secretary, Mengo, suggested having a meeting with Mbenenge. It was at that point when the judge president proposed having sex with the junior staffer. She responded with scripture in the isiXhosa Bible, with the first word translating to "No". But what was the judge president's understanding of this? This was his submission before the Judicial Conduct Tribunal. "'You reckon we can be intimate this week because we are here in East London?' She has introduced herself as being in East London. 'You reckon we can be intimate?' Remember, we have been this flirtatious about sensual things previously from either party. This is contextual, and this is my understanding that she was saying let us not be intimate this week. Let's just meet face to face." Mbenenge added that he respected this and did not pursue being intimate any further.

Mbenenge tells tribunal Mengo used endearing terms towards him
JOHANNESBURG - Eastern Cape Judge President Selby Mbenenge has told the Judicial Conduct Tribunal investigating allegations of sexual harassment against him that high court secretary, Andiswa Mengo, used endearing terms towards him. On 20 June 2021, Mengo sent a text to the judge president on WhatsApp wishing him a Happy Father's Day. In this message, she referred to the senior judge by his clan name, which Mbenenge said made him feel warm. The senior judge has accused Mengo of having selective amnesia for failing to disclose this in her official complaint. Being called by clan name within the culture, and I'm not at all blowing culture out of proportion here, as some may think, the point of substance is that when somebody calls you by your clan name, it's an endearment." Mbenenge rejects assertion that peeled banana emoji he sent to Mengo was meant to be his penis

JOHANNESBURG - Eastern Cape Judge President Selby Mbenenge has rejected the assertion that the peeled banana he sent to high court secretary, Andiswa Mengo was meant to depict a male private part. The judge president on Tuesday was reading the WhatsApp texts between himself and Mengo before the Judicial Conduct Tribunal probing allegations of misconduct against him. Mengo accuses the senior judge of making unwanted sexual advances towards her between 2021 and 2022. But, Mbenenge denies this and has also rubbished the testimony of some expert witnesses. In May this year, forensic and legal linguist Dr Zakeera Docrat told the tribunal that the emoji of a peeled banana sent by Mbenenge to Mengo represented a circumcised male private part. When the judge president sent the emoji in June 2021, the pair was exchanging texts with sexual connotations on messaging service, WhatsApp. But, Mbenenge denied that the banana was meant to signify what was testified by Docrat. "In other words, I was saying, I was going to give you something nice. I could've sent a chocolate. I could've sent anything that people, when they meet, would love to share. But clearly, it has got nothing to do with any penis." Mbenenge claimed ignorance when probed on Docrat's evidence, saying he would have had to study a degree in emojis to understand the sexual connotation attached to it.
