
Delhi HC issues notice to Railway, DUSIB on PIL against notice for demolition of settlement colony on track
The division bench of Justices Tejas Karia and Rajneesh Kumar Gupta on Monday issued notice to Northern Railways and the Delhi Urban Shelter Improvement Board (DUSIB).
The High Court has granted them one week to file their affidavits. Delhi Development Authority (DDA) has also been impleaded as a respondent at the oral request of the counsel for the petitioner.
After issuing notices, the matter was listed for a hearing on July 3, 2025. NGO Shine Women Welfare Association has moved a public interest litigation (PIL) seeking quashing of demolition notices of May 19, 2025 and June 05, 2025.
It has also sought an order to provide rehabilitation to the affected parties before taking any coercive action against Chander Shekhar Azad Colony residents.
During the earlier hearing, the counsel for Northern Railways showed certain photographs supporting the submission that the illegal encroachments along the railway tracks are so dangerous.
A number of those constructions obstruct visibility and traffic signals, which can cause a serious risk of train accidents, the counsel said.
Almost all structures across the railway track are built up to the first floor, and there is not sufficient distance between those structures and the railway track, the council added. It was also submitted that the demolition action is being carried out under the directions passed by a Division Bench of this Court in another petition.
Counsel for DUSIB submitted that even according to the policy sought to be invoked by the petitioner, no protection can be granted where the demolition action is being carried out on the basis of a judicial order.
A PIL has been moved through advocates Anuradha Singh and Rishi Nandy. The petitioner has stated that this notice calls for the eviction of residents of Chander Shekhar Azad Colony, Wazirpur Industrial Area, citing safety hazards to railway operations.
The demolition drive began on June 2, 2025. Counsel Anuradha Singh contended that these demolitions are being carried out arbitrarily, without any form of rehabilitation, in violation of Article 21 of the Constitution, and contrary to established legal and policy safeguards.
The plea said the settlement, comprising more than 3000 houses, is officially listed at Serial No 100 in the Delhi Urban Shelter Improvement Board (DUSIB) list of 675 JJ Bastis.
It added that most residents are engaged in low-income occupations such as domestic work, vending, and daily wage labour.
A joint survey was conducted in 2015 by the Respondents, during which the residents submitted necessary documents to establish their eligibility for rehabilitation under the Delhi Slum and JJ Rehabilitation and Relocation Policy, 2015, the plea stated. (ANI)

Chandigarh launches inclusive education policy for kids with disabilities
The Chandigarh Administration on Friday rolled out its first comprehensive Education Policy for Children with Special Needs – 2025, aimed at ensuring barrier-free, dignified, and quality education for children with benchmark disabilities. The policy was launched at Punjab Raj Bhavan by Punjab Governor and UT Administrator Gulab Chand Kataria, who called it 'a strong initiative towards inclusiveness and the spirit of equality guaranteed by the Constitution'. Kataria underlined the social significance of the step, stating, 'the measure of the true progress of any society is how it empowers its weakest sections. This policy is not just limited to opening the doors of schools, it is also a means to bring out the inherent talent and potential of the children. Chandigarh is proud that we are strengthening the spirit of equal opportunity and inclusion in the field of education'. Framed in line with the Rights of Persons with Disabilities Act, 2016, the policy guarantees free and compulsory education in government and aided schools for children with disabilities up to the age of 18. For those unable to attend regular classes, home-based education will be provided, supported by a transport allowance and auxiliary services. Admissions have been made entirely non-discriminatory, with all inclusive neighbourhood schools required to admit disabled children. A three per cent reservation has also been set aside for them within the 25 per cent quota for economically weaker sections under the Right to Education Act. Private schools will now be obliged to admit students with special needs and provide tailored educational support. The framework mandates the appointment of trained special educators for inclusive classrooms, adapted curricula, Braille and large-print textbooks, sign language resources, and modified evaluation systems. Collaboration with special schools and integrated education centres will support children with severe disabilities, while vocational and skill training from Class 9 onwards will prepare them for independent livelihoods. To foster a sensitive learning environment, the policy calls for regular training and awareness programmes for teachers, parents and classmates. A grievance redressal committee in every school and a state-level monitoring body will oversee its implementation. Senior officials, including Chief Secretary Rajiv Verma, Principal Secretary to the Governor Vivek Pratap Singh, Education Secretary Prerna Puri and Director of School Education Harsuhinder Pal Singh Brar, were present at the launch. Officials said the new policy represents 'an inspirational effort to strengthen the values of social justice, inclusion and compassion' and carries the message that 'disability is not a limitation; with the right environment and opportunities, every child can make society proud with their talent'.

NEW DELHI: BJP on Friday rejected Rahul Gandhi 's statement regretting that he could not get the UPA regime to conduct a caste census in its 10 year-tenure at the Centre. "He makes it look like a confession but it actually is a camouflage, because the real problem is Congress leadership's DNA. Relief for 6,000 residents of Indira Colony as HC halts demolition drive
The Hindu Bureau New Delhi Over 6,000 residents of Indira Colony in north-west Delhi have received a temporary reprieve as the Delhi High Court ordered a stay on a demolition drive scheduled for Saturday and directed that no coercive action be taken until the next hearing on July 31. The court passed the interim order on a petition filed by the Indira Colony Resident Welfare Association, which challenged an eviction notice issued by the Northern Railway on July 4, citing 'unauthorised occupation' of railway land. The court observed that the issue 'requires further examination'. Broken promise Amid legal proceedings, the issue drew sharp political reactions. At a press conference, Leader of the Opposition Atishi said: 'Before elections, the Prime Minister promised every slum dweller a pucca house under the slogan 'Jahan Jhuggi, Wahan Makaan'. But ever since the BJP came to power, bulldozers have arrived at poor people's homes.' Former Shalimar Bagh AAP MLA Bandana Kumari said panic spread in the area on July 4 when the notice was pasted. 'This is CM Rekha Gupta's constituency. Despite her assurances, bulldozers razed one jhuggi earlier. Now, Indira Camp faces the same threat,' she said. While there was no immediate response from the BJP, the CM had previously assured residents that no demolition would occur without legal process or rehabilitation, and that any demolitions under way were court-directed. Policy breach The petitioners argued that the eviction violated Article 21 of the Constitution, which guarantees the right to life and dignity, including shelter, and that authorities had not followed due process under the Delhi Slum and JJ Rehabilitation and Relocation Policy, 2015, and the 2016 Draft Protocols. 'None of the required steps were taken,' it said, pointing out that the colony appears as Serial No. 74 on the Delhi Urban Shelter Improvement Board's (DUSIB) list of 675 eligible jhuggi jhopri (JJ) bastis. The protocol mandates that the land-owning agency must send a request to DUSIB, which must examine the eligibility of the basti for rehabilitation. Only if found ineligible, can demolition proceedings begin, the plea said. Appearing for the Northern Railway, the Central government's counsel submitted that the land belongs to the railway and that the occupants were in 'illegal possession'. The eviction notice, the counsel argued, was issued in accordance with the law.
