Indiana tolls on I-65? I don't like it, but our crumbling roads need the cash.

When I head to Chicago or Nashville, I know I'll be receiving a tolling invoice in the mail soon after. It's a minor inconvenience because I don't use those routes very often.
But the prospect of Indiana tolling interstates within state lines is an entirely different discussion. I take Interstate 65 to and from work almost every day and I would no doubt rack up a ridiculous bill — at the same time that I'm paying high gas taxes every time I fill up.
My immediate reaction is: no way. But I'm trying to see all sides of the debate.
The fact is Hoosiers love to complain about our roads, but no one wants to pay to improve them.
And our roads aren't that bad depending on who you ask.
The Indiana Department of Transportation compared Indiana to neighboring states on 12 criteria, including road and bridge conditions, fatality rates, travel reliability and more: 'INDOT ranked in the top 3rd in 5 areas and in the middle 3rd in the others,' the 2024 report said.
The federal Bureau of Transportation Statistics also rates 97% of Indiana's roads as 'good' or 'fair.'
But a Reason Foundation analysis found Indiana ranked 32nd in highway performance nationally.
And the money raised from Indiana's fuel-related taxes simply isn't keeping up with demand. That's partially because people are purchasing less gasoline. Newer cars are more efficient, and some cars don't need it at all.
Inflation has also spiked the cost of repairing or replacing roads and bridges.
So, Indiana — and every other state — has a diminishing revenue stream but more roads than ever to maintain.
And when I say Indiana, I don't just mean state-owned roads. Most of the roads in the state are cared for by counties, cities and towns — about 89%. Their needs are immense.
One analysis said local governments would require an additional $2.4 billion annually to eliminate poorly rated local roads and bridges across the state over the next 10 years. The annual price tag for simply maintaining roads at the current condition is $1 billion.
So, would any of the additional revenue raised from tolls go to local infrastructure?

Lawmakers recently tried to think outside the box and offer other options. One was a surcharge on deliveries, such as Amazon and DoorDash. That language was removed pretty quickly. The state is also trying to force local units into implementing wheel taxes to take some ownership of the problem and raise fees and taxes at the local level.
But those are honestly just nibbling around the edges of the problem.
Tolling is where the money is at. And it's a lot of money.
One 2017 feasibility study produced for INDOT estimated that a statewide interstate highway tolling program would have an 85% chance of generating upwards of $39 billion between 2021 and 2050.
It further reported a 50% chance that revenue could exceed $53 billion over that timeframe. The estimates didn't include the costs to install and maintain tolling gantries, process payments, provide customer service, enforce collections and more.
Former Gov. Eric Holcomb chose not to go down that route, but Gov. Mike Braun appears to be more interested. And lawmakers recently removed some final impediments to imposing tolling on state highways.
'It's going to have to be considered because, otherwise, I don't think we can maintain our main arteries,' Braun said earlier this year.
Tolling interstates isn't as clear-cut as it seems.
It's generally against federal law to collect tolls on existing federal highways. But Congress has allowed several exceptions. For instance, a state can toll an existing bridge after it is reconstructed and toll new lanes added to an interstate.

The option that is most expansive is the Interstate System Reconstruction and Rehabilitation Pilot Program, which allows tolling on existing interstate facilities to fund needed reconstruction or rehabilitation on corridors that could not otherwise be adequately maintained or functionally improved.
It has only three slots — awarded to Missouri, North Carolina and Virginia years ago. But those states never implemented the program, which has essentially been inactive.
INDOT said it has not filed a waiver request on tolling — yet.
I honestly don't see how tolling in some way can be avoided. Leaders want to capture the trucks and travelers passing through Indiana without stopping for gas. But it'll be tough to avoid hurting Hoosiers already paying their fair share.

The deal still needs regulatory approval and will serve as a major test for the Trump administration's antitrust regulators, who have appeared more willing than the Biden administration to approve mergers in certain industries, even if they reduce significant market competitors. US freight railroads are crucial to America's economy, carrying about 30% of the nation's freight in terms of weight, according to the Bureau of Transportation Statistics. Trains transport autos, retail goods, food and energy products, as well as raw materials and parts needed to run America's factories. 'Railroads have been an integral part of building America since the Industrial Revolution, and this transaction is the next step in advancing the industry,' said Union Pacific CEO Jim Vena in a statement Tuesday. The companies confirmed they were in advanced talks last week. Union Pacific (UNP) serves the western United States, while Norfolk Southern (NS) serves the eastern parts of the country. The coast-to-coast combination could force the other two major freight railroads, Burlington Northen Sante Fe, a unit of Berkshire Hathaway, and CSX Corp., to also merge to stay competitive, leaving the nation with two major freight railroads moving goods east-to-west. 'We are confident that the power of Norfolk Southern's franchise, diversified solutions, high-quality customers and partners, as well as skilled employees, will contribute meaningfully to America's first transcontinental railroad, and to igniting rail's ability to deliver for the whole American economy today and into the future,' said Mark George, CEO of Norfolk Southern, in a statement. Rail customers, many of whom have been complaining about the quality of rail service for years, are concerned that any merger could result in service problems and supply chain disruptions. 'The experience in the rail industry has been that mergers have resulted in no improvement in, or worse, service, and higher rates,' said Ann Warner, a logistics consultant to numerous rail customers and trade associations of rail shippers, many of whom have only one railroad serving their property. 'Shippers won't know until an (merger) application is filed what this all means.' Service has suffered following every rail merger, said Peter Swan, emeritus professor of logistics and operations management at Penn State Harrisburg. But the railroads promised Tuesday that the deal would benefit their customers. 'Imagine seamlessly hauling steel from Pittsburgh, Pennsylvania to Colton, California and moving tomato paste from Heron, California to Fremont, Ohio. Lumber from the Pacific Northwest, plastics from the Gulf Coast, copper from Arizona and Utah, and soda ash from Wyoming,' said Vena's statement. Still, it could take months, if not years, for the deal to close, according to experts. The deal will need the approval not just of antitrust regulators but also such bodies as the Surface Transportation Board. However, in 2023, the Surface Transportation Board approved the first major railroad merger in more than two decades when Canadian Pacific purchased Kansas City Southern, creating a direct freight line from Canada through the United States to Mexico. The deal was approved, in part, because the combined company had little to no overlapping routes, which is the case with Union Pacific and Norfolk Southern. Transcontinental rail service has been available since 1869, just four years after the end of the Civil War, when the famous 'Golden Spike' linked Union Pacific with the Central Pacific railroads in Promontory Summit, Utah. But moving goods cross-country has always required they be handed off from one railroad to another. While Amtrak trains provide coast-to-coast passenger service, they depend primarily on tracks owned and maintained by the nation's freight railroads. Most freight rail mergers combine railways that share a similar service area to build density and market share rather than seek an end-to-end merger like this one, Swan said. But doing that once again is likely to be a regulatory non-starter. With only two eastern freight railroads, CSX and Norfolk, and two western freight railroads, BNSF and Union Pacific, remaining after years of mergers, an end-to-end merger is the only combination still available. Swan said the while there could be some increased efficiency moving traffic cross-country, such as from the Port of Los Angeles to customers on the East Coast, trains will still need to stop and remove the cargo for different destinations. U.S. EPA Administrator Lee Zeldin is expected to announce a major policy proposal during a visit to Indianapolis on July 28 Zeldin has focused his tenure at the EPA rolling back environmental rules, slashing staff and advancing President Donald Trump's Unleashing America's Energy agenda. Zeldin will announce the repeal of what is known as the "endangerment finding," according to a report in E&E News, a publication of Politico. The EPA's ability to regulate greenhouse gas emissions hinges on the endangerment finding — and rolling it back could exacerbate the threats posed by climate change to human health. Governor Mike Braun, Attorney General Todd Rokita and U.S. Rep. Jim Baird, are expected join Zeldin for the announcement at Kenworth of Indianapolis off East 30th Street. Greenhouse gases weren't always classified as air pollutants under the Clean Air Act. Concerns about motor vehicles emissions rising throughout the early 2000s led to a petition where 19 organizations called upon the EPA to regulate greenhouse gas emissions. The EPA rejected the petition, arguing that the gases weren't considered air pollutants subject to the Clean Air Act. Litigation ensued. And in 2007, the Supreme Court categorized greenhouse gases as 'without a doubt' air pollutants. In 2009, the endangerment finding gave the EPA authority to regulate six greenhouse gases — including carbon dioxide, methane and nitrous oxide — as threats to human health. That move contributed to regulations on emissions from cars, trucks, power plants and the oil and gas industry. Repealing the endangerment finding would be a step backward and is not supported by science, said Gabe Filippelli, a biogeochemist and professor of Earth sciences at Indiana University. 'One could argue that it is just another attempt to prop up the dirtiest of businesses we still have in the U.S., which includes coal burning power plants,' Filippelli said. Climate changes poses a real danger for Hoosiers, and revoking these rules is a case of businesses winning and communities losing, he said. The EPA balances economic needs with environmental protection, but the two issues are not at odds. 'We need business and electricity,' Filippelli said, 'but not at the expense of people's health.'
