Indore city planner removed as HC orders probe into caste certificate

Jabalpur: The MP high court has ordered the removal of
from his post as city planner of the Indore Municipal Corporation, pending an investigation into the validity of his Scheduled Tribe (ST) caste certificate.

A single bench of justice Vishal Mishra also ordered that a high-power committee should investigate the matter. The next hearing on the petition is scheduled for the last week of June.
The petition, filed by Bhopal resident Satish Nayak, stated that the caste certificate of Neeraj Likhar's elder brother, Ajay Likhar, was found to be fake during an investigation, leading to his termination.
Neeraj Likhar obtained his job based on an ST caste certificate.
Like his elder brother, he also has an ST caste certificate, casting doubt on its authenticity.
The state govt informed the HC that a letter was sent to the high-power committee last month to investigate the caste certificate.
The petitioner argued that an official with a questionable caste certificate should not be placed in an important position.
Accepting the plea, the court ordered a high-level probe and issued orders to remove the respondent from the position of city planner. Advocate Kapil Sharma represented the petitioner.

NEW DELHI: The Supreme Court on Thursday expressed displeasure over the Karnataka High Court's order granting bail to Kannada actor Darshan Thoogudeepa, an accused in the Renukaswamy murder case. 'This court is not at all convinced by the manner in which the high court (Karnataka), in its discretion, granted bail (to Darshan),' said a two-judge bench of Justice J B Pardiwala and Justice R Mahadevan. Challenging the order of the Karnataka HC, the state filed an appeal in the top court seeking cancellation of the actor's bail. Senior advocate Kapil Sibal, appearing for the actor, faced a tough time in the court, as the SC asked him to give 'good reasons' why it should not interfere with the HC's bail order. 'To be very honest with you, we are not convinced with the manner in which the HC has exercised discretion. We will hear you because your clients are on bail; they (state) have come for cancellation of bail and you must have seen the manner in which the high court had dictated the order,' Justice Pardiwala asked Sibal. Sibal responded that keeping aside the high court's decision, the court can look into the Section 161 and 164 statements and two to three key witnesses, including the police. The veteran lawyer wanted to know from the judges as to which part of the HC's order the bench found problematic. Justice Pardiwala replied, 'That part of the order where the high court was really saying how to release them on bail.' The court asked Sibal to come prepared next Tuesday. According to the prosecution, Darshan, a 47-year-old Kannada actor, was arrested on June 11, 2024, in connection with the murder of 33-year-old Renukaswamy, a native of Chitradurga. The victim's body was discovered near a stormwater drain in Bengaluru on June 9, 2024. After the investigation, the Bengaluru police filed a charge sheet and arrayed Pavithra as accused number 1 and Darshan as the accused number 2. Police claimed that Renukaswamy's act of sending offensive messages to Pavithra was the motive of the offence committed by Darshan and others. Initially, a Sessions Court had rejected the bail of Darshan forcing him to knock the doors of the top court.

Mumbai: The Central Board of Film Certification (CBFC) on Thursday told the Bombay High Court that it will decide in two days the applications filed by the makers of a movie purportedly based on Uttar Pradesh Chief Minister Yogi Adityanath's life, seeking certification. A bench of Justices Revati Mohite Dere and Neela Gokhale initially rapped the CBFC, commonly known as the censor board, for 'sitting on the application' and not passing the order within the timeline prescribed in the rules. Pursuant to this, the board told the high court that the applications would be decided within two days and the makers would be informed about the decision. The bench accepted the statement and disposed of the petition filed by the makers of the film. Samrat Cinematics, in its plea filed in the HC, questioned the CBFC's 'arbitrary, unreasonable, and unexplained' delay in processing the certification applications for its film -- Ajey: The Untold Story of a Yogi, including its teaser, trailer and promotional song. The plea claimed that the CBFC had also sought for a No Objection Certificate from the office of the Uttar Pradesh CM. Senior counsel Ravi Kadam and advocates Satatya Anand and Nikhil Aradhe told the court that as per the rules, the application seeking certification has to be decided within five days. "The petitioner has in fact sought priority clearance and has paid three times the amount," Kadam told the court. The bench then said that the censor board has to follow the timeline. "You cannot sit on an application especially when they have paid the priority charges. The application has to be decided," the HC said. The movie, inspired by the book The Monk Who Became Chief Minister, which is purportedly based on Yogi Adityanath's life, was scheduled for a theatrical release on August 1.
