
India, UK trade pact does not mandate patent term extensions or data exclusivity
The move would protect the interests of the domestic generic drugs industry.

'The FTA does not mandate patent term extensions or data exclusivity — two common tools of evergreening. India's patent law provisions on patentability criteria under Section 3(d) (of Indian Patent Act) remain fully protected," the ministry said.
Section 3(d) of the Indian Patents Act, 1970, restricts patents for already-known drugs unless the new claims are superior in terms of efficacy, while Section 3(b) bars patents for products that are against public interest and do not demonstrate enhanced efficacy over existing products.
Certain multinational firms have asked India to amend these laws, which were strongly opposed.
The agreement, signed on July 24, may take about a year to come into force.
Data exclusivity provides protection to the technical data generated by innovator companies to prove the usefulness of their products. In the pharmaceutical sector, drug companies generate data through expensive global clinical trials to prove the efficacy and safety of their new medicine.
By gaining exclusive rights over this data, innovator companies can prevent their competitors from obtaining a marketing licence for low-cost versions during the tenure of this exclusivity.
Earlier, India had also rejected a similar demand from the four-nation EFTA bloc in their free trade agreement negotiations.
The European Free Trade Association (EFTA) members are Iceland, Liechtenstein, Norway, and Switzerland. The pact was signed in March 2023 and will be implemented later this year.
The UK (AstraZeneca and GSK) and Switzerland (Novartis and Roche) have some of the major pharma firms of the world.
India's generic drug industry is estimated about USD 25 billion, and the country exports 50 per cent of its produce.
An expert said data exclusivity is beyond the provisions of the Trade Related Aspects of Intellectual Property Rights (TRIPS) agreement under the World Trade Organization (WTO).
Evergreening of patent rights is a strategy allegedly adopted by the innovators having patent rights over products to renew them by bringing in some minor changes, such as adding new mixtures or formulations. It is done when their patent is about to expire. A patent on the new form gives the innovator company a 20-year monopoly on the drug.
'The FTA does not require India to provide patent term extensions for regulatory delays and data exclusivity for pharmaceuticals or agrochemicals," it said, adding that this ensures that generic manufacturers can enter the market without unnecessary delay, once the patent has expired or is challenged.
The agreement, it said, does not alter or dilute India's ability to refuse patents for minor modifications of known substances; and prevent frivolous or repetitive patent filings that block generics.
'There is no obligation for patent linkage or automatic injunctions either-key tools used to delay generics in other jurisdictions," the ministry said. PTI RR TRB

According to data from India's Ministry of External Affairs (MEA), 1,703 Indians have been sent back in just six and a half months — averaging around eight deportations a day, news agency PTI reported. This is almost three times the daily average seen during the Joe Biden administration, when about three Indians were deported daily between January 2020 and December 2024. 'We will revoke their visas and deport them if they don't,' it said on June 26. Earlier that week, a separate message was issued targeting undocumented migrants. 'The US has increased enforcement of immigration laws and removal of illegal aliens,' it stated. 'Illegal entry will lead to detention, deportation, and permanent consequences for future visa eligibility.' Deportees returning in staggered batches Of the 1,703 Indians deported so far this year, 747 flew back from the US individually or in small groups via commercial flights. Another 72 came through Panama using a similar process. India does not keep its own official figures on how many of its citizens live illegally in the US. For deportations and consular matters, it relies on information provided by US authorities. The MEA said it is 'engaged with US counterparts to ensure deportations are carried out humanely.' It has raised concerns about the use of shackles, especially on women and children, and has also highlighted issues around cultural and religious sensitivities. If talks with the BJP do not succeed, we will form a separate front and contest elections. We are actively working on 156 seats," he added. Criticising Congress leader Rahul Gandhi, he said, "When Rahul Gandhi travels abroad, he questions India's credibility and attacks the Election Commission. But when his party wins elections, he never raises such concerns. If he believes elections were rigged and victory came through manipulation, he should say so openly and provide evidence." He further alleged that Rahul Gandhi has already sensed defeat in Bihar, which is why "he has started making baseless statements, similar to those made by former PM VP Singh."

NAPA demands Punjab govt to withdraw Land Pooling scheme
Chandigarh, Aug 2 (PTI) The North American Punjabi Association (NAPA) on Saturday issued a warning to the Punjab government over the 'controversial" Land Pooling Scheme. NAPA Executive Director Satnam Singh Chahal said that if the government fails to withdraw this 'anti-farmer" scheme, it will become extremely difficult to control the rightful landowners, whose livelihoods and ancestral lands are under direct threat. Chahal emphasised that the Punjab Government must act responsibly and immediately revoke this policy, which has sparked widespread resentment among farmers and landowners across the state. He urged Punjab Chief Minister Bhagwant Mann not to blindly follow Arvind Kejriwal and his team, who are consistently pushing policies that are detrimental to Punjab's interests. 'Punjab's unique socio-economic fabric cannot withstand such experimental schemes designed by people who do not understand the ground realities of our state," Chahal said. 'It is high time that the Punjab Government starts taking independent decisions in the larger interest of its people rather than becoming a laboratory for Delhi's political agendas," he added. NAPA reminded the Punjab government that the farmers of the state have already made countless sacrifices for the nation's food security and deserve respect and fair treatment—not policies that threaten their existence. The association warned that any attempt to implement the Land Pooling Scheme forcibly would lead to a massive statewide agitation, which could spiral out of control if the genuine concerns of the people are ignored.
