SC to decide validity of Madras HC stay on Tamil Nadu law on University VC appointments

on Friday entertained Tamil Nadu's petition questioning reasonableness of Madras HC's order staying its legislation, which gave the state government, instead of the governor, the power to appoint University vice-chancellors, but refused M K Stalin government's plea for suspending the HC order to re-operationalize the law.

TN fielded a team of senior advocates – A M Singhvi, Rakesh Dwivedi and P Wilson – to argue that the HC had without considering the urgency to appoint vice-chancellors to universities, recommendations to which effect has been put in cold-storage by the Governor, stayed the legislation.
The law giving state govt the power to appoint VCs to universities was stayed along with nine other laws, Bills for which were reserved for the President's consideration by the governor but were regarded as deemed to have been approved by President in a controversial unprecedented ruling by a two-judge SC bench on Apr 8.
Three days after the 'deemed to have been approved' ruling by the SC, which now is subject to a Constitution bench's opinion on a Presidential Reference questioning the use of Article 142 power of the SC to virtually obliterate roles assigned by the Constitution to President and Governors on Bills passed by Assemblies, the TN govt had notified the nine bills as laws.
The bench refused to stay the HC order but asked the UGC and the public interest litigation petitioner before the HC to respond to TN's petition in four weeks.
For UGC, solicitor general Tushar Mehta said the law is palpably contrary to the UGC Regulations which empower only governors to appoint VCs to the universities.
When the senior advocates pleaded that they would argue before the HC for vacation of the stay, Mehta said that in that case the TN must withdraw its petition seeking transfer of the PIL from Madras HC to the SC. 'The state cannot have both options open at the same time and be permitted to argue before the HC that the SC is considering transfer of the PIL to itself,' he said.

Wilson sought expunging of certain 'harsh remarks' against him by the HC merely because he was pointing out the SC's 2-J bench order. Justices Narasimha and Mahadevan said this request would be considered by the SC during the final hearing on the TN's petition.
One of the Acts, notified on Apr 11 by the state related to vesting in the state govt the powers of the Governor, as Chancellor, to appoint vice-chancellors of universities in the state.
A vacation bench of the HC on May 21 granted stay on this amending provision, holding that UGC Regulations, 2018, would prevail over the state legislation by virtue of doctrine of repugnancy.
The state said it had raised the objection to the delay in filing of the PIL but the division bench of the HC 'did not even call for an explanation from the Registry of the HC or the Petitioner but proceeded to hear the case in a tearing hurry.' The HC 'showed undue haste', did not even give a week's time to the state to file its counter affidavit, and passed the stay order 'for extraneous reasons', it said, adding that the impugned order is replete with personal attacks on the senior counsel who appeared for the state.

The SIR in Bihar is being carried out ahead of the state elections, slated for October-November, 2025. According to ECI, all individuals whose names weren't included in the 2003 electoral rolls need to prove that they are actual citizens of India, by submitting any one out of 11 documents, such as a birth certificate or ID card issued by the government. ECI says this revision is necessary due to rapid urbanisation and migration in Bihar, non-reported deaths, and concerns about illegal foreign immigrants. The list of documents asked for has been criticised on the basis that it doesn't include commonly available documents such as Aadhaar card or a voter card, although ECI has clarified that the list is supposed to be 'indicative, not exhaustive.' Taking to X, Kharge said that public opposition has forced ECI and the BJP to backtrack. Referring to an ad posted by ECI, which asked voters to fill out the necessary form and submit to their Booth Level Officer (BLO) even if they didn't have the required supporting documents, he said – 'This is part of the BJP's tactic to mislead and confuse the public… Bihar is the birthplace of democracy. The people of Bihar will surely respond to this BJP attack on democracy and the Constitution in the upcoming elections.' ECI has denied the claims that there have been any modifications to the procedure of the SIR. 'SIR is being conducted as per instructions dated 24.06.2025 only as there is no change in the instructions', it said. The poll body also warned the public about 'incorrect and misleading statements' being made by unnamed persons to confuse people.

'Mookerjee was a visionary statesman, educationist and fearless parliamentarian whose ideals continue to shape the destiny of India. Asserting that he was contesting the upcoming assembly elections in Bihar, Union minister Chirag Paswan on Sunday voiced his support for the introduction of domicile policy in government jobs in the state. Paswan, who heads the Lok Janshakti Party (Ram Vilas), made the announcement while addressing a rally in Saran district that borders his Hajipur Lok Sabha constituency. "People have been asking me whether Chirag Paswan will contest the assembly elections. I want to announce from Saran that yes, Chirag Paswan will contest the elections for the sake of a better future of Bihar," he said, evoking thunderous applause. "I will contest the election for the people of Bihar, for my brothers, mothers, for my sisters. We will build a system in Bihar that will truly take the state forward on the path of development. I will realise the dreams of my father and work for 'Bihar first, Bihari first'. I will live and die for Bihar and its people," he added. Paswan also supported the demand for introducing a domicile policy for government jobs in the state, becoming the only NDA leader to do so. Live Events Leader of the Opposition Tejashwi Yadav has promised implementation of "100 per cent domicile" if the Mahagathbandhan, helmed by his RJD, came to power in the state after the elections. "For the sake of the youth of Bihar, I am in support of the introduction of a domicile policy in government jobs. This has been a long-standing demand of job seekers," Paswan said. "I must inform you that the domicile policy was introduced in 2006, but it was withdrawn by the opposition parties when they came to power. The RJD and Congress never think about the betterment of the youth of the state. They always mislead people. If they come to power, they will snatch over half of your wealth via inheritance tax," he claimed. The Nitish Kumar government has already ruled out the possibility of the introduction of a domicile policy, stating that any such move would be against the Constitution. Attacking the RJD, Paswan alleged that the people talking about Bihar's development now are the ones who had ruined the state in the '90s. PTI
