India Has Stayed Strong In Crisis Due To Constitution, Says CJI Gavai

Speaking at an event in Allahabad High Court, the CJI praised the Constitution for guiding India's journey of development after independence.
Chief Justice of India (CJI) B R Gavai on Saturday said that whenever the country has faced a crisis, it has remained united and strong, and that the Constitution should be credited for this.
The CJI was addressing a function after the inauguration of advocate chambers and a multi-level parking at the Allahabad High Court here.
'When the Constitution was being made and its final draft was presented before the Constituent Assembly, at that time some people used to say that the Constitution is too federal while some used to say that it is too unitary.
'Baba Saheb Bhimrao Ambedkar had replied that the Constitution is neither wholly federal nor wholly unitary. But one thing I can tell you is that we have given a Constitution which will keep India united and strong both in times of peace and war," CJI Gavai said.
He said India has been on the path of development after independence due to the Constitution.
'Today we see what is the condition of our neighbouring countries. And India is making a journey towards development after independence. Whenever there has been a crisis in the country, it has remained united and strong. The credit for this should be given to the Constitution," he said.
'It is our fundamental duty to reach out to the last citizen of this country who needs justice. Be it the legislature, the executive or the judiciary, everyone has to reach out to that citizen," the CJI told the gathering.

NEW DELHI: The Maharashtra government has filed an appeal in the Supreme Court challenging yesterday's Bombay High Court's decision to acquit twelve persons who were accused in the 2006 Mumbai train blasts. The plea was mentioned on Tuesday before a bench led by Chief Justice of India (CJI) BR Gavai by Solicitor General of India (SGI) Tushar Mehta, who requested that the plea be taken up urgently by the top court. The Court listed the matter for hearing on Thursday, July 24. The High Court had on Monday acquitted the twelve accused persons by noting that the Maharashtra Anti-Terrorism Squad (ATS) failed to prove the offences beyond a reasonable doubt. In doing so, the High Court set aside a September 2015 judgment of the Maharashtra Control of Organised Crimes Act (MCOCA) court that had imposed the death penalty on 5 of the 12 accused persons and had sentenced the remaining 7 to life. Following the Bombay High Courts' decision, Maharashtra CM Devendra Fadnavis expressed shock and said that the Maharashtra government will challenge it in the Supreme Court. The case is listed for hearing before the CJI's bench on Thursday. On the evening of July 11, 2006, bomb blasts took place at seven different places in the Mumbai local trains within just 11 minutes. In this incident, 189 people died, while more than 827 passengers were injured. The bombs were placed in first-class compartments of trains from Churchgate. They exploded near the stations of Matunga Road, Mahim Junction, Bandra, Khar, Jogeshwari, Bhayandar, and Borivali. A trial court in 2015 convicted 12 people in the blasts' case.

GUWAHATI: The Congress in Manipur on Tuesday petitioned Governor Ajay Kumar Bhalla, urging him to clarify the status of the 12th state Assembly since the imposition of President's rule on February 13. The ethnic violence-hit state was placed under President's rule days after the Chief Minister N Biren Singh had stepped down. In a memorandum submitted to the governor, the Congress asked if the Assembly is alive, dead or 'constitutionally deemed to be dissolved' from the midnight of February 11. '…the Hon'ble Governor fixed the date of the 7th Assembly session for 10.02.2025 in order to comply with the 6-month timeline prescribed under Article 174 (1) of the Constitution of India between two sittings of the House,' the Congress said in the memorandum. 'Since the last sitting of the House was held on 12.08.2024, therefore, as per Article 174 (1) of the Constitution, the next sitting ought to have been mandatorily held on or before 11.02.2025,' the party further stated. However, the Congress added, there were two events on February 9 – Singh resigned as the chief minister and the governor declared his January 24, 2025 order summoning a sitting of the Assembly on February 11 as 'null and void.'

New Delhi: The controversial electoral roll revision in Bihar has weeded out 52 lakh voters who are dead or migrated, the Election Commission said today, assuring that "all eligible electors are included in the draft electoral roll to be published on August 1". Of the 52 lakh names removed, 18 lakh are reported dead, 26 lakh voters have shifted to different constituencies, and 7 lakh are enrolled at two places, the Commission said two days before the draft lists are expected. Amid Opposition concerns about a chunk of voters being left out -- that led to a massive row and a court case -- the poll body has assured that there will be time to tweak the lists to include anyone who need to be included. "As per the SIR order dated 24.06.2025, from August 1 to September 1, 2025, a full one-month will be available to any member of the public to file objections for any additions, deletions and rectification in Draft Electoral Rolls," the Commission said in a statement today. The Commission has said each voter who submitted the enumeration form with or without documents will be included in the draft roll that would be published on August 1. If any voter has been unable to submit his enumeration forms, they can be included in the final rolls once they submit a claim in the prescribed form along with the declaration. After the completion of the entire process, the final roll will be published on September 30, it added. And even after the publication, new voters can be enrolled up to the last date of nominations, the Commission has said. "The entire election machinery, including nearly 1 lakh BLOs, 4 lakh volunteers and 1.5 lakh BLAs appointed by the District Presidents of all the 12 major political parties in Bihar are working together to search those electors who are yet to submit their Enumeration Forms (EFs) or have not been found at their addresses," read a statement from the poll body today. The poll body has claimed that the Special Intensive Revision or SIR being conducted ahead of the assembly elections in Bihar, is its constitutional duty. In court, where the matter is pending, the Commission has argued that the entire process is being conducted in a consistent and jurisdictional manner, citing the powers conferred under Article 324 of the Constitution.
