MUMBAI: Bombay HC termed the 'torture' of accused number 1 in the train blasts case as 'barbaric and inhuman' and, saying that complaints of many other accused also raised doubts that torture was inflicted, discarded the confessions obtained by the state Anti-Terrorism Squad (ATS) as 'unreliable and inadmissible.

The HC in its judgment elaborated on the complaints of torture by police to extract confessional statements from the accused. The alleged methods included splitting legs 180 degrees wide, tying individuals to a chair all night, denying food from morning to evening, and putting cockroaches in vests and rats in underwear amid a lot of beating.
Justices Anil Kilor and Shyam Chandak, while acquitting all the dozen accused, invoked two-century-old history to invalidate confessions eked from threats, saying, 'We can get the evidence of police atrocities from 1817… the passing of Bengal Police Regulation, 1817, is the example.
This shows that for more than two centuries, the safeguards and checks are tried to be placed on malpractices of police officers.

Six minutes of terror
The defence argued that though the accused were in custody for over 60 days, police complained of non-cooperation. However, once MCOCA was invoked on Sept 24, 2006, 11 confessions poured in, showing they 'are not voluntary but the result of continuous torture in police custody.'
On Oct 9, 2006, when produced in court, all retracted the confessions and detailed the torture inflicted by ATS, defence counsel Yug Chaudhri argued.
They also stepped in as defence witnesses, and their evidence merits acceptance, the HC held, since the cross-examination failed to dislodge their claim, which was 'corroborated by medical and other evidence' to a 'very substantial degree.'
The HC said, 'Not allowing a person to sleep, making him stand the whole night with his arms tied above his head, or stretching his legs to 180 degrees, as has been repeatedly testified to by the accused, will not leave visible scars on the body, no matter how much this may bruise the mind or injure the psyche.'
While accused number 1, Kamal Ansari, who died in 2021 in prison, did not testify as a witness, HC noted his complaint in detail, alleging a DCP had said, 'I won't kill you, I have a pen, with this pen, I will make your life hell, your entire family will come on the road.' The high court said such detailed third-degree methods can't be an 'afterthought' as argued by the prosecution.
Medical and ocular evidence 'not only corroborates the complaint of A.1 of torture and its truthfulness but also the fact that police warned him not to disclose about the torture meted out to him by them to the doctor.'
'The torture was barbaric and inhuman, and it exposes the frustration the officers might have had at the relevant time for obvious reasons,' said the HC, holding his confession can't form the basis of convictions. The HC also came to a similar conclusion of torture being inflicted on many other accused.
For instance, in the case of accused number 5, the HC said 'evidence sufficiently hints at the possibility of torture being inflicted… to extort his confession.'
The HC also said, 'Detailed narration of torture with all the specific details creates doubt about torture to extort confession.'
The judgment devoted 350-odd pages to confessions and about 100 pages to complaints of torture. The HC also said the prior approval to invoke MCOCA by an additional police commissioner was vitiated on grounds of complete non-application of mind by the then additional police commissioner.
'The procedure(s) of sanction provided in the legislation are meant to be followed strictly, to the letter, more so to the spirit. Even the slightest of variation from the written word may render the proceedings arising therefrom to be cast in doubt,' the HC noted.

The woman, identified as Gul Jan Bibi, was arrested after a video surfaced on social media in which she justified the killings, citing adherence to Baloch tribal customs. She was presented before the Anti-Terrorism Court (ATC) in Quetta, which sent her on a two-day police remand. In the video, Gul is seen holding the Holy Quran and stating that the act was not a crime but aligned with traditional values. 'My daughter who was married with five children was killed because of her relations with a Baloch youngster who used to post objectionable videos on Tik Tok despite several warnings given to him by our family. 'In Balochi culture, having illicit relations is a crime and punishable by death. The decision to shoot them was taken by a Jirga (tribal council)," she said in the video message. According to the Human Rights Commission of Pakistan, there were at least 405 victims of honour killings in 2024 across various parts of the country. Last Updated: Peshawar, Jul 24 (PTI) A coach of a Quetta-bound passenger train was partially damaged in an explosion on Thursday in Balochistan province of Pakistan, the third such attack since March. No passenger was harmed due to the explosion, railway officials said. 'Railway track between Bakhtiarabad and Damboli areas in Sibi district of the province was blown up with explosives, resulting in the Bolan Mail heading from Karachi to Quetta being hit," station master Murtaza Khan told reporters in Sibi and termed it as an act of terrorism. Coach No 7 of the train was 'partially damaged" in the incident, he said, adding, the train reached the Sibi railway station safely. Train operations have been suspended in the area in the aftermath of the blast even as the security forces have cordoned off the site, and a railway technical team has been dispatched to the scene. Train services will be resumed once the track has been cleared and declared safe, railway officials added. Following the incident, the Jaffer Express that had started from Punjab was halted at Dera Murad Jamali, while an earlier day Jaffer Express nearer to Quetta was stopped at Sibi station, officials confirmed. Over the past few years, Balochistan has seen a series of terror incidents where train tracks are blown up, targetting the province's transport infrastructure. Earlier, the Peshawar-bound Jaffar Express, travelling from Quetta to Peshawar and carrying 440 passengers, was hijacked near Balochistan's Sibi area on March 11, resulting in the deaths of 21 passengers and four security personnel. 'All 33 terrorists" were neutralised during the two-day clearance operation. Train services between Quetta and the rest of the country were restored on March 27. Agency: PTI Last Updated: Lucknow (UP), Jul 24 (PTI) The Special Task Force (STF) of Uttar Pradesh Police is investigating suspected hawala dealings of a self-proclaimed diplomat, who ran a fake 'embassy' of a fictitious nation 'West Arctica' that was busted in Ghaziabad's Kavinagar area, a senior official said in Thursday. Officials believe the lavish rented bungalow (KB-35) served as the central hub for all illegal financial operations. Harshvardhan Jain (47), the mastermind arrested by the STF on Tuesday, is now investigated for his international financial dealings. STF Senior Superintendent of Police Sushil Ghule stated on Thursday that Jain had established over a dozen firms in various European countries, often with partners. Senior STF officials strongly suspect that Jain exploited these companies to operate an extensive hawala network. The STF's initial investigation revealed that Jain, who holds a BBA degree from Ghaziabad and an MBA degree from London, cultivated connections with prominent figures in the international underworld. He reportedly came into contact with controversial godman Chandraswami in 2000, who allegedly introduced him to notorious arms dealer Adnan Khashoggi and Ehsan Ali Syed, sources said. This suggests a sophisticated money laundering network operating under the facade of legitimate business, it said. Jain's international movements further highlight a complex financial web, the STF said. After relocating to Dubai in 2006, he formed several companies with Shafiq (from Hyderabad) and Ibrahim (from Dubai). He returned to India in 2011 and, since 2012, began styling himself as an advisor or ambassador to various non-existent or unrecognised 'micronations' such as 'Saborga", 'Lodonia", 'Poulvia.' It was under the guise of these fictitious diplomatic identities that he allegedly defrauded individuals with promises of overseas jobs and visas, often using vehicles equipped with fake diplomatic licence plates. The STF's Tuesday raid on his Kavinagar residence unearthed a cache of incriminating evidence, including 44.7 lakh in cash, foreign currencies, multiple forged diplomatic passports, 18 fake diplomatic number plates, forged seals of the Ministry of External Affairs, and seals of companies from 34 countries. While the STF focuses on the international hawala links, local police are also scrutinizing how Jain managed to run such an elaborate con job so openly for an extended period. 'We are looking into how Jain ran his operations and for how many years was he active," a senior Ghaziabad police official told PTI. Jain was previously arrested in 2011 after central agencies traced an unauthorized satellite phone he had brought from South Africa.
