Landlord Marc Godart seeks court go-ahead to take over Dublin pub licence

Landlord Marc Godart is aiming to take over a Dublin pub's licence and has a tenant "lined up", but needs consent from the city council's fire officer, a court has heard.
The Luxembourg businessman, now based in Latvia, brought an application before Judge Máire Conneely at Dublin District Court, which was adjourned for two weeks pending the council official's findings.

In past unrelated proceedings at the District Court, firms linked to the businessman have faced multiple legal issues over property lettings in Dublin.

In Wednesday's licensing case, he sought a certificate of transfer of the licence for Cleary's Pub, Sarsfield Road in Inchicore.
Inchicore Parkview Residence Limited made the application, and Mr Godart gave evidence in his capacity as a director.
His firm's barrister, Dorothy Collins, asked Judge Conneely to hear the evidence and then to defer ruling on the basis that the fire officer had "requested that there are certain works to be done" and needed to provide a report.

The judge heard that Godart had travelled from abroad and would only be here for a day.
Counsel said there had been "a lot of negotiation with the fire officer who has inspected the premises and required certain works to be done".
She added that paperwork had to be completed and the proceedings ought to be postponed to satisfy the council official.
Inchicore Parkview Residence Limited's barrister presented the judge with a booklet of documents, including the previous licensee's certificate, an advertisement published in a national newspaper, a certificate of incorporation, and the deed of transfer.

The judge heard that the pub licence had expired last year, but an application could still be made for a late certificate of transfer.
In evidence, Mr Godart agreed with Ms Collins that he had been negotiating with the fire officer. He had engaged a consultant to do whatever was necessary to satisfy the official.
Asked if he had any experience running a public house, he said he had managed the building for six months.

He clarified "that's correct" when put to him that he did not intend to run the pub, the application was to preserve the licence, and concurred that he had "a tenant lined up, but they won't take it over unless there is a licence."
Mr Godart said it had been vacant since closing at the beginning of this year.
Judge Conneely noted from the company's report that he resided in Latvia and that he did not intend to live in the pub itself, which he confirmed while in the witness box.
She said the application was in order, subject to the fire officer's consent and report. The case resumes on July 30th.

A historic west Highland pub that provides a focal point for traditional music is to be bought by the local community after a funding award. The Glenuig Inn in Lochaber contains stonework dating back to a building burned down in 1746 by soldiers pursuing Bonne Prince Charlie after the Jacobite the years the inn, about 30 miles (48km) from Fort William, has become known as a traditional "ceilidh house" where trad and folk musicians gather to play.A grant of nearly £353,000 from the Scottish Land Fund will allow the community to buy the site and associated buildings. Glenuig Community Inn Ltd plans to continue operating the inn as a pub, restaurant and accommodation. Chairman Peter Langhorne said the funding award was "wonderful news". "We will now be able to buy the inn which we have been leasing and operating for the last four months," he said. "The Glenuig community has a long history of developing and managing community assets but this really is the cherry on the cake." The Scottish Land Fund is a Scottish government funded initiative, delivered in partnership with the National Lottery Community Fund and Highlands and Islands grant is one of 10 that have been made, totalling about £1.45m. Mairi Gougeon, cabinet secretary for rural affairs, land reform and islands, said: "Vibrant community spaces are the lifeblood of our towns and villages- places where people can meet, access services, and simply enjoy being together. Minister defends plans to cut VAT for hospitality sector 'to keep it sustainable'

Minister for Enterprise, Tourism and Employment Peter Burke has been defending plans to cut VAT for the hospitality sector. 'The tourism sector is a very important part of the economy. At this point in time, over 200,000 people are employed in it. It's a €9 billion sector. And it's so important to try and keep that sector sustainable,' he told RTÉ radio's Today show. Advertisement 'We've seen over the last number of years a very significant number of independent small food outlets and coffee shops come under pressure, many restaurants closing their doors. But this is a jobs measure to sustain the employment in that sector, which is critically important to me as Minister for Tourism and critically to get that regional balance because many of these jobs are located in regional parts of Ireland and it's so important that we have that growth in those key sectors.' Mr Burke said that the cut in VAT would be a stimulus measure. 'It is a viability measure, they are under significant pressure. We've had a lot of additionality from government, part of it over the last three years, in terms of regulatory requirements in the trajectory to a living wage and sick pay in so many areas that have put significant pressure on the sector and have reduced their margins. 'I've been in coffee shops and indeed restaurants where I've seen their margins diminish and some making a very significant loss that they weren't the prior year, considering in many cases their trade and turnover has sustained. 'So critically it's very difficult to ask everyone to pass it on but we need to ensure that we keep the jobs in the first place and that's the prism I look through when I have a sustainability piece like this. This is to protect all of those over 200,000 jobs. To try and grow the sector because there's a very exciting new tourism plan which we'll be bringing out in September and part of that will be an all-island food strategy and also giving Failte Ireland the power to develop the restaurant sector as well.' Advertisement The Minister said that the best value for money would be to sustain jobs. 'We've learned one thing in this economy and we've proven it. And we have been almost Teflon as a government on this. We've pushed 90,000 jobs into the economy over the last 12 months. And considering when we're at or about full employment, to put 90,00 extra households with additional income into them with more jobs is very significant. 'We have a huge amount of jobs, almost 600,000 put in since the pandemic. And that's been the premium of this government, because for any household, the route to give you a chance and opportunity to realise your ambition in life is a job. And the more good quality jobs we get into the economy as well, that's what I'm focused on with many of the different sectors we're working on, trying to ensure that we have the building blocks to sustain the high-level of high-quality jobs we have in our economy.'
