Parolee accused of Fose's murder granted bail, but to remain in custody until parole board decides his fate
Mduduzi Mnisi was released on parole in December 2018 after he was sentenced to 18 years' imprisonment for attempted murder and robbery with aggravating circumstances. He served nine years in prison and was paroled until 2027.
On Wednesday, magistrate Delize Smith granted him bail of R5,000 after a witness, who told police Mnisi had been seen with the 14-year-old in Durban Deep, Roodepoort, shortly before her murder, declined to consult with the state's legal team.
'This court is not the trial court, and the testimony of that witness has not been tested. But the behaviour of this witness now at this stage, when she has to come for the consultation with the prosecutor or assisting investigating officer further, seems to be ducking and diving, and [the witness] even goes to stay in another address,' Smith said.
'A person is deemed to be innocent until proven guilty at the trial. And as there is no evidence, prima facie, at this stage, the court finds this to be an exceptional circumstance [grounds for bail to be granted],' she ruled.
During the bail application, the investigating officer in the Fose murder, Moses Semosa, testified that the witness told him she had seen Mnisi walking to his home with the teenager at about 4pm on May 31, the day before she was found dead.
Mnisi said he did not know her, denied any involvement in her murder and asked the state to check his cellphone records as he was in Daveyton with two friends at that time. This alibi was investigated, and his phone was linked to a tower in Daveyton.
Mnisi also called his girlfriend to testify that they were together at her home in Kagiso after 7pm on May 31, that they had spent the night together and he had never left her sight. The court heard that Mnisi's cellphone was linked to a tower in Kagiso at about 8pm.
On hearing about the cellphone locations, Mnisi's parole officer, Neo Lakaje, said he had violated his parole conditions as he had not obtained prior permission to be in another jurisdiction.
Smith instructed the court order be sent to the correctional supervision or parole officers, saying bail would only become effective if the parole board decided Mnisi's parole should be reinstated.
The court heard during the bail proceedings that he had violated his parole conditions, which required him to notify authorities if he left his home district. Part of his alibi was that he had travelled to two other locations during the time that Fose went missing.

R7 million transformer theft 5th suspect remains in custody as co-accused gets bail
JOHANNESBURG - One of the men accused of stealing a R7 million transformer at the Laudium sub-station north of Pretoria has been denied bail by the Atteridgeville Magistrates Court. Katlego Molepo appeared before the court on Friday and will be back behind bars this evening after his bail bid failed as a result of an undisclosed previous conviction. Molepo is the only one who was denied bail out of five accused suspects in the matter. The transformer was stolen last November, causing a strain on the electricity supply in the area. Three of the suspects, who are municipal workers, were granted bail last week they also appeared in court today for Katlego Molepo's bail outcome. Last week, Siphiwe Mahlangu received R35,000 bail while Thomas Baloyi and Daniel Kubayi got R30,000 bail each. The state did not oppose their bail applications, stating they were all first-time offenders. Molepo was, however, not so lucky owing to a previous conviction. He will remain behind bars at the Kgosi Mampuru prison until his next court appearance, while his other co-accused will return on 5th August.

Magistrate casts doubt on evidence against SANDF members accused of murdering Hawks investigator
Twelve SANDF members accused of triple murder – including the killing of Hawks detective Frans Mathipa – were granted bail by the Randburg Magistrates' Court on Friday, 11 July. Magistrate Hleziphi Mkhasibe has described the case against 12 SANDF special forces members accused of murdering Hawks detective Frans Mathipa as circumstantial and weak. The 12 were granted R10,000 bail in the Randburg Magistrates' Court on Friday, 11 July. The names of the accused, which the court had previously barred the media from reporting, are: Sunnybooi Pinny Wambi, Edward Albert van Deventer, David Mogaditswe, Kgosietsile Letsatsi, Samkelo Ngwenya, Jonathan Nteleza, Paulos Matlou, Herbert Mashego, Solomon Lechoenyo, Jacob Mokoena, Richard Mpoetsi and Olyn Lenardus. Mathipa was shot on 6 August 2023, while driving on the N1 highway in Gauteng near the Hammanskraal off-ramp. He was on his way to a meeting, believed to be connected to his investigation into the special forces unit alleged to have conducted a kidnapping in 2022. The 12 soldiers also face two murder charges related to that case. They are accused of kidnapping and killing alleged Isis associate Abdella Abadiga and his bodyguard Kadir Abotese on 22 December 2022. The two have not been since they were allegedly kidnapped from the Mall of Africa and taken to Swartkop Military Base. They are presumed dead. 'At the time of the kidnapping, some of the applicants were not present during the crime,' Mkhasibe said. She said the State possessed no evidence of the kidnappings of Abadiga and Abotese. 'Mr Abadiga's vehicle was seen leaving the Mall of Africa, but none of the applicants were seen driving the vehicle,' Mkhasibe said. 'There is no evidence that the applicants killed Mr Abadiga and Mr Abotese,' she said. The court had heard that the 12 soldiers allegedly hired a hitman to eliminate the Hawks detective tasked with investigating Mathipa's murder, but the magistrate questioned the claim. 'The State advocate told the court that the applicants hired a hitman from KwaZulu-Natal to eliminate the detective, but there is no evidence,' Mkhasibe said. Mathipa was killed soon after requesting information from the SANDF regarding his investigation into the kidnapping. The matter ended up in court, and the SANDF was required to hand over the information, but it refused. Shortly thereafter, Mathipa was murdered. The court heard that the SANDF still hasn't handed over the information. It is alleged that members of the special forces unit faked a hijacking to get rid of the BMW they allegedly used to carry out Mathipa's murder. They lodged an insurance claim while the vehicle was, according to prosecutors, left at a scrapyard. The court heard that a burner phone used to allegedly lure Mathipa to his death was found inside the BMW. Some of the accused acknowledged their presence at the Mall of Africa during the alleged kidnapping, but they claimed they were on a training exercise. NPA 'disappointed' Gauteng National Prosecuting Authority (NPA) spokesperson Phindi Mjonondwane said the State was disappointed that the accused were granted bail. 'It's a disappointing outcome. As the NPA, we had opposed the release of the applicants, but the court deemed them suitable candidates to be released on bail for a fixed bail amount of R10,000,' Mjinondwane said. She said the magistrate gave the NPA the green light to appeal against the decision, and that the State had put its best foot forward in this case. 'We are confident that we presented a comprehensive affidavit in court of how the accused are linked.' The appeal against the bail decision will be heard on 17 July. DM

Creecy approaches banks to seek easier debt repayment deals for taxi industry
The transport department says it has approached banks and Toyota to request easier repayment options for taxi owners on their vehicle loans to curb violence over routes. This was revealed by minister Barbara Creecy on Thursday, who said the root cause of taxi violence was indebted taxi operators who wanted to pocket more money by taking over routes illegally. She said the taxi industry was struggling to be profitable. 'An operator will make R15,000 to R16,000 a month on an average route. Of course there are more profitable routes. You are earning R16,000 but you have a liability of R28,000, so the question is how do you fill the hole. And that is where the problem begins because you would want to operate on what you regard as a more profitable route,' she said. Creecy said some operators have resorted to moonlighting as scholar transport operators to close the financial gap. Her department was working with Toyota and the banks to find a way to de-risk the loans, she said. 'I am not saying these financial practices justify irregular practices — they don't. But I am saying that what we have undertaken is to look at de-risking the loans.' The industry has been marred by violence recently, with shootings and killings in Katlehong, Soweto and Mpumalanga where even buses have been torched. In the latest incident, Sowetan sister publication TimesLIVE reported that Western Cape detectives were investigating four murders and three attempted murders after a shooting at a taxi rank in Mfuleni last month.
