
Convicted for pointing gun at SDM, BJP MLA disqualified
The Assembly has issued an official notification confirming the termination.
Rajasthan Assembly Speaker Vasudev Devnani announced on Friday that MLA from Anta constituency, Kanwarlal, has been disqualified from the Rajasthan Legislative Assembly following his conviction in a court of law. The disqualification is in accordance with Article 191(1)(e) of the Indian Constitution and Section 8(3) of the Representation of the People Act, 1951. Devnani stated that the disqualification took effect from the date of conviction, and consequently, the Anta (193) Assembly seat in District Baran has been declared vacant. The Speaker clarified that the decision was made after receiving legal advice from the Advocate General of Rajasthan.
'I do not work under any kind of pressure,' he emphasised. 'All decisions are made strictly in accordance with the law and only after a thorough examination of all aspects.' He further stated that precedent exists for such matters, noting that previous Speakers have also taken time to study and act on similar cases. Devnani cautioned against politicising the issue, underlining that the matter is purely legal in nature.
He explained that the Advocate General was asked to provide legal counsel on the day of the court's verdict regarding MLA Kanwarlal. According to established legal provisions, an MLA stands disqualified from the date of conviction, and the notification of the seat's vacancy is formally issued by the Legislative Assembly. He also referenced Article 177 of the Constitution, stating that the Advocate General has the constitutional authority to participate in the proceedings of the Legislative Assembly and offer legal opinions when required. Earlier, the Assembly Secretariat had issued a notice to Kanwarlal, requiring him to respond by May 7.
He was asked to clarify whether he had received any relief from the Supreme Court to stay his sentence. As the Supreme Court did not suspend the conviction or sentence, the Speaker was left with no option but to revoke his membership.

'Under the pretext of targeting 'Bangladeshis' and 'Rohingyas', Muslims are being pushed into increasingly desperate situations. Disturbing media reports have even suggested that some were forced into the sea in attempts to expel them from India. As you rightly highlighted during your visit to Assam, the large-scale demolition of thousands of Muslim homes is deeply troubling. The latest development the SIR being conducted in Bihar appears to be yet another systematic effort to dispossess, disempower, and ultimately disenfranchise Muslims, effectively erasing their presence both symbolically and literally,' she said in the letter. The former CM said while India rightly expresses rage over the treatment of Hindu minority in Pakistan and Bangladesh, there is 'complete silence' when Muslims are targeted in our country. 'There is an unsettling silence, a fear that prevents many from speaking up. As a politician from one of the only Muslim-majority regions that chose to join the Indian Union largely due to the vision and secular character of your great-grandfather, I feel extremely helpless at times. Placing great hope in your leadership I urge you to continue speaking up for a minority that is being steadily marginalised and pushed to the fringes of Indian society,' she said.

Samajwadi Party misused power to occupy office space for ₹115: SC
The Supreme Court on Monday rapped the Samajwadi Party for "fraudulently occupying" office space for a paltry Rs 115 in Uttar Pradesh's Pilibhit, underlining a "clear misuse of political power". A bench of Justices Surya Kant and Joymalya Bagchi told senior advocate Siddharth Dave, appearing for the political party, that it was not a case of fraudulent allotment but a case of "fraudulent occupation using muscle power and misusing power". The top court was acting on the party's plea against Nagarpalika Parishad of Pilibhit's eviction order. Dave argued despite paying rent for the office space, the municipal authorities were adamant to evict his client. He said a suit seeking injunction on the eviction order had been filed. "You are a political party. You misused official position and political power to occupy the space. When action comes, you start remembering everything. Have you ever heard of office space in a municipal area for Rs 115 rent. This is a clear case of abuse of power," the bench noted. When Dave pressed for protection from eviction for six weeks, the bench said, "Right now, you are an unauthorised occupant. These are not fraudulent allotments but fraudulent occupations." Dave claimed the party was being singled out by the authorities. "It will be better if you file a writ petition before the high court and bring to the court's notice any such fraudulent allotment or occupation. We will be welcoming this step," the bench said. Refusing to examine the plea, the bench did not express any opinion on the petitioner's suit in the civil court which it said should be decided at the earliest. The party was challenging the July 2 order of the Allahabad High Court refusing to hear the plea. On June 16, the top court dismissed a similar plea moved by the party's Pilibhit district president against the high court order restraining him from filing a fresh petition on the issue of eviction order for local party office. The top court granted liberty to the party to move the high court against the decision of the civic body. The apex court pointed out a 998-day delay in filing the appeal against the December 1, 2020 order of the high court on the plea of one Anand Singh Yadav who claimed to be the party's district president. The party had claimed that the civic body ordered it to vacate the premises on November 12, 2020 without offering it the opportunity to be heard.
