Given the firm has the technical and staff resources necessary to comply with the regulations its behaviour was negligent, said CNIL.
Shein had recently complied with the regulations, it added.
A final decision on fining the fast-fashion giant should come within weeks.
Shein called the proposed amount of the fine "disproportionate", in a statement sent to AFP.
"Since August 2023 we have actively worked with the CNIL to ensure our compliance and respond to their queries," the China-founded firm said.
This additional possible fine from the CNIL follows a record 40 million-euro penalty it received last week from France's competition and anti-fraud office over "deceptive commercial practices" by misleading customers on price deals and on its environmental impact.

A Vueling spokesperson said the passengers were removed after the minors repeatedly tampered with the plane's emergency equipment and interrupted the crew's safety demonstration. A Civil Guard spokesperson said the captain of the plane ordered the removal of the minors from the plane at Valencia's Manises Airport after they repeatedly ignored the crew's instructions. On Thursday, the Federation for Jewish Communities of Spain expressed concern about the incident. The group said that Vueling needed to provide documentary evidence of what happened on the plane.

Motor rally accident kills three spectators in France
The driver of the modified Peugeot 208 that hit the spectators and her 51-year-old woman co-driver were taken to hospital but without life-threatening injuries, prosecutors said. Two men died at the scene and prosecutors later announced that a third man, airlifted to hospital, succumbed to his injuries. The three killed were two brothers, aged 70 and 60, and a 44-year-old man, according to the public prosecutor's office, which opened an investigation. Several people who witnessed the accident near the town of Ambert in central France were in shock, a local official told AFP. In total, a dozen people were taken to a psychological support unit set up in the nearby village of Saint-Just. The accident occurred around 11 am (0900 GMT) on Saturday. "This is a tragedy for the world of racing," said Joel Mathurin, the local prefect, or top government official for the area. Regional prosecutor Laure Moisset said the accident was "very violent".
