In SRC civil suit, Umno insists RM16m from Jendela Pinggiran was bona fide donation, used funds for CSR
Umno's counsel, Mohamed Shahrul Fazli Kamarulzaman, submitted that the party received the said sum as donations and contributions.
'No evidence that the plaintiffs only knew of the RM16 million sum was disbursed due to breach of duty or trust by their former directors sometime in 2019.
'Umno at all times was a bona fide recipient of the RM16 million sum and the said sum has been spent and utilised by Umno in activities and programmes that were corporate social responsibility (CSR) in nature,' he said.
The counsel made the submission during the hearing of a lawsuit filed by SRC International Sdn Bhd and its two subsidiaries – Gandingan Mentari Sdn Bhd (GMSB) and Jendela Pinggiran Sdn Bhd (JPSB) – against Umno and Selangor Umno.
Mohamed Shahrul Fazli also submitted that there is no evidence to show that former Prime Minister Datuk Seri Najib Tun Razak, as the Advisor Emeritus of SRC at that time, had instructed the Board of SRC, GMSB or JPSB to disburse the RM16 million sum to Umno.
'The evidence only shows that the Board of SRC hold the ultimate decision-making authority for the management of business to fulfil SRC's objectives.
'It is clear that Datuk Seri Najib cannot, in essence or substance, be construed as a shadow director of the plaintiffs or their directing mind and will. At all times, Datuk Seri Najib's roles in the plaintiffs were due to his official capacity and subject to SRC's Articles of Association,' he added.
Meanwhile, SRC's counsel Razlan Hadri Zulkifli submitted that there are no contemporaneous documents from JPSB or SRC to explain the transfer of RM16 million to Umno.
He said there was also no reason whatsoever for the plaintiff to transfer, donate or gift the said sum to Umno and for the latter to receive these monies, to which Umno do not even have any relationship or knowledge of the plaintiffs, in the first place.
'Umno is harping on the fact that these monies were received by way of political donation. That is simply untenable given that Umno did not even verify or account for the RM16 million received at all times.
'Umno merely assumes the monies to be a political donation. To date, there have been no records shown whatsoever of the purpose for the transfer of RM16 million to Umno or reasons why JPSB's cheques were in the hands of Datuk Seri Najib at that material time,' he said.
In the lawsuit against Umno, the plaintiffs are seeking RM16 million, which they allege was wrongfully transferred to the political party, asserting that Umno had no basis to receive the funds.
The second lawsuit involves a claim of RM3.5 million against the Selangor Umno, which is also accused of receiving the funds.
The hearing before Judge Datuk Raja Ahmad Mohzanuddin Shah Raja Mohzan continues on Wednesday. — Bernama

In a bourse filing, Zetrix AI said it received a letter from the home ministry today clarifying that the company could continue to offer immigration-related services within the scope of any other agreement with the government. It said it had a teaming agreement with Heitech Padu Bhd, which was awarded the National Integrated Immigration System (NIISe) project, under which immigration-related services, including foreign worker permits, were within the NIISe project scope. 'The suite of immigration-related services provided by the company continues to be accessible to customers through its platform,' it said. The company also said it expected minimal disruption and no material impact on its financial performance following this development. On July 15, it was reported that Bursa Malaysia Securities Bhd fined seven of Zetrix AI's directors RM150,000 each for failing to ensure three company announcements in 2023 were factual and accurate. Bursa said Zetrix AI announced on July 7, 2023, among other things, that a notification letter dated July 4, 2023 from the home ministry confirmed the finance ministry's approval of the company's appointment as the government revenue collection agent and extended its role as the provider of online services for the immigration department. It said the July 7 announcement was inaccurate, false and misleading as it was inconsistent with the contents of the July 4 letter. It said Zetrix AI and the directors also failed to make an immediate announcement to clarify the inconsistency, but maintained its misrepresentation of matters in the company's subsequent announcements on Sept 13 and Sept 14 that year. On July 15, it was reported that Zetrix AI would seek a judicial review against Bursa over the penalty imposed on its directors.

(AP pic) WASHINGTON : President Donald Trump said today the US will impose a 25% tariff on goods imported from India starting on Aug 1. He said India, which has the world's fifth largest economy, will also face an unspecified penalty on Aug 1, but did not elaborate on the amount or what it was for. 'While India is our friend, we have, over the years, done relatively little business with them because their Tariffs are far too high, among the highest in the World, and they have the most strenuous and obnoxious non-monetary Trade Barriers of any Country,' Trump wrote in a Truth Social post. 'They have always bought a vast majority of their military equipment from Russia, and are Russia's largest buyer of ENERGY, along with China, at a time when everyone wants Russia to STOP THE KILLING IN UKRAINE — ALL THINGS NOT GOOD!' India's commerce ministry, which is leading the trade negotiations with the US, did not immediately respond to a request for comment. Trump's decision dashes hopes of a limited trade agreement between the two countries, which had been under negotiation for several months. US and Indian trade negotiators had held multiple rounds of discussions to resolve contentious issues, particularly over market access for American agricultural and dairy products. Despite progress in some areas, Indian officials resisted opening the domestic market to imports of wheat, corn, rice and genetically modified soybeans, citing risks to the livelihood of millions of Indian farmers. The new tariffs are expected to impact New Delhi's goods exports to the US, estimated at around US$87 billion in 2024, including labour-intensive products such as garments, pharmaceuticals, gems and jewellery, and petrochemicals. The US currently has a US$45.7 billion trade deficit with India. Let those who don't need RM100 aid return it, says MCA
MCA president Wee Ka Siong said he would be the first to return the RM100 one-off cash aid announced this morning. PETALING JAYA : MCA has called on the government to introduce a mechanism that would allow Malaysians who do not need the RM100 one-off cash aid announced this morning to return the funds. In a Facebook post, MCA president Wee Ka Siong said the returned funds could be channelled to healthcare and education. Wee said the funds could be used to expedite elective treatments for 15,000 patients at government hospitals, some of whom face a waiting period of up to 21 months. The money could also be used to offer scholarships to straight-A Sijil Pelajaran Malaysia students as well as Sijil Tinggi Persekolahan Malaysia and matriculation graduates with excellent CGPAs, he said. 'Rather than spending public money that may benefit those who don't really need it, wouldn't it be better to support those who genuinely do, while also upgrading our healthcare and education systems? 'It will be a win-win solution. The people get to choose, and the government wins too!' he said. Earlier today, Prime Minister Anwar Ibrahim announced the one-off cash aid for all Malaysians aged 18 and above, under the Sumbangan Asas Rahmah initiative. The money, which will be channelled through recipients' MyKad, is in conjunction with the National Day celebration, he said. In a special televised announcement, Anwar said the aid could be used between Aug 31 and Dec 31 to purchase basic necessities from over 4,100 outlets, including hypermarkets such as Mydin, Lotus, Econsave, and 99 Speedmart. He said the government had set aside RM2 billion for the initiative, which is expected to benefit some 22 million citizens. Wee said he believed that Anwar, his ministers and elected representatives would be willing to forgo the RM100. 'I will be the first to contribute mine,' he said. In a separate statement, Parti Sosialis Malaysia (PSM) said it welcomed the reduction in RON95 prices and the RM100 one-off grocery aid but stressed that these measures would only provide temporary relief for low-income households. PSM deputy chairman S Arutchelvan said that instead of one-off handouts, a universal basic income and a pension scheme for the elderly would have a more lasting impact. He also proposed doubling the public healthcare budget and increasing the minimum wage, while supporting small businesses with transition subsidies. 'These structural reforms would provide more sustainable benefits than one-off handouts. We urge the government to implement policies that permanently reduce the cost of living and address wealth inequality at its roots,' said Arutchelvan.
