
Territorial Army soldier jailed, fined for drink driving
TAWAU: A Territorial Army soldier was sentenced to 30 days in jail and fined RM10,000 by the magistrate's court here today after pleading guilty to a drink driving offence committed last year.
Davyson Nyanggau Lawai, 36, was initially charged under Section 44(1A)(b) of the Road Transport Act 1987 (Amendment 2020) for driving under the influence, with a blood alcohol level above the permitted limit.
The original charge carries a sentence of seven to 10 years' imprisonment, a fine ranging from RM50,000 to RM100,000, and a 10-year driving licence suspension upon conviction.
However, his lawyer submitted a representation to the Attorney-General's Chambers requesting a plea bargain.
The prosecution accepted the proposal and reduced the charge to Section 45A(1) of the same act.
Davyson then pleaded guilty before magistrate Don Stiwin Malanjum.
The amended charge carries a maximum penalty of two years' imprisonment and a fine of between RM10,000 and RM30,000.
According to court documents, the accused, a corporal with the Territorial Army stationed at the Kukusan Camp was driving a Perodua Bezza when he was found to have a blood alcohol concentration of 372mg per 100ml, far exceeding the legal limit of 50mg per 100ml.
The incident occurred about 10.45pm on April 25, last year, along Jalan Utara Simpang.
The offence also led to a road accident that injured a 27-year-old male motorcyclist.
The prosecution was led by deputy public prosecutor Shearil Aizad Murnizam, while the accused was represented by Jhesseny P. Kang.

'We believe we can clear our names through the court process. 'I want to stress that I am not guilty. I will go through all court procedures while upholding the rule of law. Yusof, Andi and whistleblower claim trial

Kota Kinabalu: Two Sabah assemblymen and a businessman pleaded not guilty in the Sessions Court here Monday to corruption charges involving mineral mining licensing in the State in 2023. The accused - Sindumin Assemblyman Datuk Dr Yusof @ Josree Yacob, Tanjung Batu Assemblyman Datuk Andi Muhammad Suryady Bandy and businessman Datuk Tei Jiann Cheing - made their pleas after separate charges were read before Judge Jason Juga. Yusof, 69, who is Qhazanah Sabah Berhad Chairman, was charged with one count of receiving a RM200,000 bribe from Tei as an inducement to facilitate a prospecting licence application for mineral exploration in Sabah. The alleged offence took place at 2pm at a hotel here on March 6, 2023. Andi, 44, who is State Industrial Development and Entrepreneurship Minister and Kalabakan Member of Parliament, was charged with receiving a RM150,000 bribe from Tei as an inducement to facilitate a prospecting licence application for mineral exploration in Sabah. The alleged offence took place at the assemblyman's residence here at 11pm on May 12, 2023. Tei, 36, was charged with two counts of giving bribes to Yusof and Andi Muhammad Suryady, respectively, at the same locations, dates and times. The two assemblymen were charged under Section 16(a)(A) of the Malaysian Anti-Corruption Commission (MACC) Act 2009, while Tei was charged under Section 16(b)(A) of the same law. If convicted, they face up to 20 years' jail and a fine of not less than five times the amount of the bribe or RM10,000, whichever is higher. Deputy public prosecutors Nurul Izzati Sapifee and Rustam Sanip appeared for the prosecution. Yusof and Andi Muhammad Suryady were represented by lawyers Datuk Ram Singh, Shahlan Jufri and Ridzwandean Borhan, while Tei was represented by Edward Paul. Yusof and Andi Muhammad Suryady were each granted bail of RM50,000 in one surety, while Tei was allowed RM60,000 bail in one surety. Former Investment Banker Fined RM1 Million And 2 Years Jail
The Kuala Lumpur Sessions Court today sentenced a former investment banker to two years imprisonment and a fine of RM1 million, in default six months imprisonment, for securities fraud offences involving RM201,000. Ruwan Amaresh Shaun Ponniah, a former associate director of Debt Capital Markets at CIMB Investment Bank, was sentenced by Sessions Court judge Puan Norma Binti Ismail after he pleaded guilty earlier today to one charge under section 179(b) of the Capital Markets and Services Act 2007 (CMSA). The court also took into consideration nine other similar charges under section 171A of the Criminal Procedure Code (CPC). Ruwan had falsely represented to seven investors that he would invest their monies in shares listed on the Malaysian and foreign stock exchanges. The monies were instead utilised for other purposes without the investors' knowledge. Ruwan also pleaded guilty to one charge under section 58(1) of the CMSA for holding himself out as carrying on a business in fund management without being licensed or a registered person for fund management. The court sentenced him to two years imprisonment and ordered for the jail term to run concurrently with the first offence. Ruwan was first arrested and charged by the SC on 18 September 2024. He claimed trial to all the charges and was granted bail at RM210,000 with one surety. On 5 February 2025, upon Ruwan's application to the High Court for a reduction of the bail sum, the amount was reduced to RM105,000. However, Ruwan was unable to post bail and was remanded at the Sungai Buloh prison to date. The court ordered Ruwan's jail term to take effect from his date of arrest. Related
