Karnataka government moves high court against tribunal order
The petition was mentioned by advocate-general Shashikiran Shetty before a division bench headed by Justice SG Pandit for urgent hearing, and the bench indicated that it would take it up Thursday.
On Tuesday, the tribunal set aside Vikash's suspension order, pointing out that the govt mechanically passed it against police officers without sufficient material grounds. The tribunal even observed that it was RCB's social-media posts that led to a large congregation of people outside the stadium.

In their petition challenging the order, the govt claimed the tribunal failed to consider other aspects mentioned in the suspension order, which prima facie indicated substantial dereliction of duty on the part of the officers.
Apart from contents of the suspension order, relevant extracts of Karnataka Police Manual and analysis of the sequence of events that unfolded on June 3-4 were placed in a sealed cover in justification of the suspension order. The tribunal, without considering the same in the right perspective, quashed the suspension order, the govt contended.

Karnataka high court defers hearing on govt petition against IPS officer's suspension revocation
Bengaluru: The Karnataka High Court deferred the hearing until July 9 regarding the state govt's petition challenging the CAT's decision to nullify IPS officer Vikash Kumar Vikash's suspension. The understanding reached ensures Vikash would not file a contempt petition citing that he was not reinstated. On July 1, the CAT Bengaluru bench overturned Vikash's suspension dated June 5 related to the June 4 stampede at Chinnaswamy Stadium which resulted in 11 fatalities. Advocate General Shashikiran Shetty, representing the state govt, argued that Royal Challengers Bengaluru (RCB) should contest the tribunal's order as they were deemed responsible for the crowd gathering. He requested a stay on the tribunal's order and noted that other suspended officers did not challenge their suspensions and there was no interim order in favour of Vikash as well. Senior advocate Dhyan Chinnappa, representing Vikash, expressed readiness to present arguments and assured the officer would not pursue contempt proceedings regarding his reinstatement. The division bench, led by Justice SG Pandit, acknowledged the senior advocate's statement and scheduled the matter for final disposal, requiring the advocate general to submit all relevant materials. It suggested extending similar relief to other suspended officers and noted RCB's social media posts inviting people as the primary cause of the crowd gathering. The govt's petition argues that the tribunal overlooked crucial aspects of the suspension order indicating officers' duty dereliction. They contend the tribunal conducted proceedings akin to a departmental inquiry, contradicting established legal principles for suspension cases. The govt maintains that despite ordering magisterial and commission enquiries, sufficient evidence exists regarding the officer's dereliction of duties. They assert the tribunal misunderstood these enquiries' significance and seek the high court's intervention, having submitted relevant documentation, including Karnataka Police Manual excerpts and event chronology in a sealed cover.

Siddaramaiah's flashpoint, tribunal relief spark talk of political overreach in police ranks
Bengaluru: Two developments within a week — the reinstatement of four police officers suspended for the stampede during Royal Challengers Bengaluru's (RCB) IPL victory celebrations, and Dharwad additional SP NV Baramani's decision to quit nearly three months after a public spat in which chief minister Siddaramaiah appeared to raise his hand at him during a public event — have left the govt red-faced and reignited concern over mounting political intrusion into policing. Together, the twin episodes have deepened disquiet within the force and sparked debate over the erosion of operational independence. The broader concern being raised is whether the police force in Karnataka is buckling under sustained political overreach. "With a deterioration in standards of public life and public conduct, there is a corresponding fall in the conduct of political functionaries," said ST Ramesh, former DGP. "It is not uncommon for political functionaries to address officials rudely. This steady deterioration in standards of interaction between political functionaries and police officers has led to the emasculation of the police force." "Just as there is a separation of power among the judiciary, legislature, and executive, there exists such a line between powers of the political dispensation and the administrative executive. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Secure your family's future! Advocating police autonomy, he said: "Broad guidelines and policy statements are in order, but not interference in day-to-day functions. This is not the first incident, nor is it going to be the last." However, labour minister and Dharwad in-charge Santosh Lad defended Siddaramaiah while attempting to downplay the Baramani episode. "All of us, including politicians, have faced these public humiliations. The incident involving the CM was unintended," Lad said. He also denied any pattern linking CAT's ruling and Baramani's decision to opt for voluntary retirement. "CAT's decision is a procedural and legal matter," he said, while refusing to comment further. Another retired senior police officer flagged "politicisation of postings". "The department is facing serious concerns with more and more appointments being made based on political influence… If the CM appoints someone, then the district minister is unhappy. And if the district minister is happy, then local MLAs have to be pleased as well," the officer said. Serving officers observed that Siddaramaiah's current term is unlike his earlier stint in 2013. "The CM is under pressure," said an officer. "Baramani being persuaded by Siddaramaiah and home minister Parameshwara to return to work was aimed at damage control." Ramesh said such unsavoury incidents could lead to a drop in morale. "Once that happens, service delivery is bound to deteriorate, impacting citizens," Ramesh said.

Two Mumbai cops suspended for kidnapping, extorting pan stall owner
Two police constables have been suspended after an FIR was registered against them along with two others for allegedly kidnapping and extorting money from a shopkeeper in Andheri. The accused policemen have been identified as Hemant Kapse and Chandrashekhar Darade, both of whom are attached to the local arms division of the Mumbai police. Kapse has been in police service since 2008 while Darade was recruited into the force in 2014. Confirming the suspension of the two constables, an IPS officer told The Indian Express: 'Both the constables have been suspended and a departmental inquiry has been initiated against them.' Deputy Commissioner of Police (LA-1) Vinayak Dhakane has been assigned the task of conducting an inquiry in the matter. When contacted, Dhakane refused to speak. According to sources in the police, the two accused constable, along with another policeman Santosh Wagh posted with the Maharashtra State Security Corporation, and another person allegedly extorted Mohamed Arif Faizan Khan (35), a pan stall shopkeeper. According to the FIR, on the evening of June 24, the four accused visited Khan's pan stall in Andheri (west) in an Ertiga car. They posed as 'Food Department Police' and told him that he was illegally selling gutkha. They made him sit in their car and drove him towards south Mumbai. The accused allegedly abused and assaulted Khan and demanded Rs 3 lakh in lieu of not filing a case against him for selling gutkha. When Khan said he had only Rs 10,000 with him, the accused made him borrow money. Khan borrowed money from a friend and on their instructions, transferred Rs 40,000 via UPI to a bank account of a person known to the accused. They also snatched away Rs 3,500 from Khan's pocket and dropped him at the Kalachowki area. Khan noted down the vehicle's number and went back to Andheri. The next day, he contacted police and filed a complaint against the four persons. On Khan's complaint, the DN Nagar police registered an FIR against four unknown persons under Sections 137 (2)(kidnapping), 204(personating a public servant), 3(5)(common intention), 308(extortion), 351(2)(criminal intimidation), 352(intentional insult) of Bhartiya Nyay Sanhita (BNS). During investigation, police found that out of the four, three served in the Maharashtra Police. The four were arrested, but they secured bail from the court. Kapse was earlier suspended in 2021 for his alleged close proximity with a criminal.
