PECA bill gets Senate's nod amid protest

Journalists on Tuesday erupted in protest across the country after the Pakistan Muslim League-Nawaz (PML-N)-led ruling coalition managed to bulldoze the controversial Prevention of Electronic Crimes (PECA) Amendment Bill, 2025 also through the upper house.
The National Assembly has already passed the bill which, if enacted, can effectively muzzle the media.
On Tuesday, PML-N Senator Rana Tanveer Hussain presented the bill in a Senate sitting, chaired by Deputy Chairman Syedaal Khan amid a protest by opposition lawmakers.
Addressing the house, Hussain said no law or amendment is immutable and can be changed. "The PECA bill is for social media platforms, not for electronic media or newspapers, aiming to regulate civil society in a manner that prevents the misuse of social media," he said.
Opposition members, however, tore copies of the bill amid chaos in the house.
Leader of the Opposition Senator Shibli Faraz said his party, the PTI, does not support the bill. He said no one supports spreading fake news but criticized the flawed procedure adopted to pass the bill. There is a lack of necessary institutions, judges, and lawyers to handle cases related to fake news, he said.
Jamiat Ulema-e-Islam-Fazl (JUI-F) Senator Kamran Murtaza complained that his amendments to the PECA bill were neither approved nor rejected by the relevant committee. He called the standing committee's report incomplete.
The house later approved the bill amid a protest by opposition members.
During passage of the bill, journalists also walked out of the Senate press gallery in protest, joined by PPP Senator Sherry Rehman, who listened to their grievances.
The journalists later organized a protest march from Islamabad's National Press Club to D-Chowk. Lawyers and civil society representatives also actively participated in the protest.
To prevent the journalists' rally from reaching parliament, a heavy contingent of police was deployed, and barbed wire barriers were erected. However, the journalists managed to cross the barriers and reached the gates of D-Chowk, where they staged a sit-in.
Addressing the gathering, Pakistan Federal Union of Journalists (PFUJ) President Afzal Butt termed the bill a 'black law'. He said the government passed the bill without consulting the media, the most significant stakeholder.
"This law is an attempt to suppress the voice of the media. Our movement against this draconian law has begun and will continue until its repeal," he said.
The joint action committee of media bodies staged a protest demonstration also in front of the Karachi Press Club in response to an appeal from the PFUJ against the PECA amendment bill.
Representatives from various media organizations, civil society groups, trade unions, lawyers' groups and teachers joined and supported the protest.
Prominent figures, including journalists, media owners, editors, and workers from organizations such as PFUJ, the Karachi Union of Journalists (KUJ), the Pakistan Broadcasters Association (PBA), the Council of Pakistan Newspaper Editors (CPNE), and others addressed the protesters.
"The government has to learn the lessons as it was earlier used against the same party, which had passed the law in a haste," said Mazhar Abbas, a senior member of PFUJ.
Mazhar Abbas characterized the situation as a 'civilian martial law'. He urged the joint action committee to advocate for the repeal of PECA, stating that they would not compromise on their rights.
Azhar Abbas called for unity among media organisations to demonstrate collective strength to the government. PBA representative Qazi Ather reaffirmed the commitment to safeguarding press freedom, stating that they would not allow their voices to be suppressed.
The Karachi Bar Council also issued a statement condemning the bill, describing it as comprising regressive amendments that constitute an assault on fundamental freedoms.
PECA, a law enacted in 2016 during the rule of the PML-N, was aimed at addressing cybercrime and regulating electronic communication in Pakistan. It was meant to combat online offences such as hacking, data theft, and cyberbullying. The law was continually amended by subsequent governments.
However, this time around, the PML-N government has attempted to make some drastic changes in the law which seeks to criminalize fake news which may land a person in jail for up to three years while also making liable for a fine of up to Rs2 million.
It stipulates penalties for sharing content expunged from the records of the National Assembly, Senate, and provincial assemblies on social media. The amended bill expands the definition of illegal content, including matters related to religion, national security, public order, and contempt of court.
It also criminalizes activities such as inciting crime or terrorism, spreading defamatory reports against constitutional institutions, blackmailing, and defamation. Illegal content also includes pornography, copyright violations, and material that undermines peace and morality or promotes criminal activity.
The bill broadens the definition of social media platforms to include tools, software, websites, applications, and communication channels used for social media access.
One of the key provisions of the new amendments is the establishment of the Digital Rights Protection Authority (DRPA), which will have the authority to remove prohibited content and take action against individuals who share such material.
The authority will also oversee the regulation of social media platforms and has been given the power to enforce compliance through directives and penalties.
The bill also proposes the dissolution of the Federal Investigation Agency's (FIA) Cyber Crime Wing, with its responsibilities transferring to the newly established National Cyber Crime Investigation Agency.

ISLAMABAD: The Inland Revenue officers of the Federal Board of Revenue (FBR) have been empowered to exercise the powers of civil court under the Code of Civil Procedure, 1908 to arrest persons involved in sales tax fraud. According to sales tax circular number 02 of 2025-26 issued by the Federal Board of Revenue (FBR), a new sub-section (4) in Section 37 has been inserted in the Sales Tax Act to empower the officer of Inland Revenue to exercise the powers of civil court under the Code of Civil Procedure, 1908. Power to inquire and investigate sales tax frauds and procedure for arrest: Through Finance Act, 2025, powers and procedure of inquiry and investigation in cases of sales tax fraud and other offences warranting prosecution under sales tax act have been streamlined. Under the new framework, the Officer of Inland Revenue can initiate inquiry only after obtaining approval of Commissioner on the basis of material evidence pointing to commission of tax fraud or other offence warranting prosecution. After completion of inquiry and after providing an opportunity of being heard to the accused, Officer shall present inquiry report to the Commissioner who shall then decide to either close the inquiry or allow further investigation. In the case of approval of investigation, officer shall be required to complete investigation within three months and submit report before Special Judge for prosecution. The subsections (8) and (9) of Section 37A regarding arrest shall only be applied when investigation under subsection (6) of this section has been initiated & warrant of arrest under subsection (8) of Section 37A may be issued only after approval by a committee comprising of three members of the FBR as may be notified by the Chairman and that too only in the cases where fraud involves amount exceeding Rs. 50 million and nature of the fraud falls within the ambit of any of the first six sub-clauses of the clause (37) of Section 2, which are reproduced as under: (a) Using or preparing false, forged, and fictitious documents, including returns, statements, annexure, and invoices. (b) False claim of input tax credit based on fictitious transactions. (c) Issuance of any tax invoice without supply of goods. (d) Tampering with or destroying of any material evidence or documents required to be maintained under this Act or the rules made there-under. (e) Generating fake input through manipulation of return filing system of the Board and making fake entries in the sales tax returns or in the annexure. (f) Making fictitious compliance of section 73, including routing of payments back to the registered person, or for the benefit of the registered person, through a bank account held by a supplier or a purported supplier; and when the fraud amount exceeds Rs. 50 Million. Additional pre-conditions which can compel the officer to seek approval for arrest are: (i) The accused may tamper with documents. (ii) The accused may abscond. (iii) The accused does not help investigations despite three served notices. Further, the power to compound an offence warranting prosecution has been provided where Commissioner can compound the offence if the person pays the amount of tax evaded along with default surcharge and penalty. The warrant of arrest from judge under subsection (9) of Section 37A may be obtained primarily in the sales tax frauds which are heinous or material including fake and flying invoices. Under this subsection, the following pre-conditions shall also apply as is the case of arrest under subsection (8) of section 37A. (i) The accused may tamper with documents. (ii) The accused may abscond. (iii) The accused does not help investigations despite three served notices. In addition to that, the board will separately notify the detailed procedure, preconditions and restrictions through an STGO for the smooth operation of subsections (8) and (9) of Section 37A. Through the substitution of Section 37A, sufficient safeguards have been introduced and multiple approvals are required at inquiry stage, as well as, investigations stage to prevent the misuse of the provisions of prosecution. The provisions of this section also state that the intent of the prosecution proceedings is not to recover the revenue but to create deterrence against the sales tax frauds. Section 378 has been substituted by further elaborating the procedure to be followed on arrest of a person and producing the accused person before the court of law for further proceedings in accordance with the provisions of this Act as well as the code of criminal procedure. Finance Act, 2025 - Explanation regarding important Amendments made in Sales Tax Act, 1990 and Federal Excise Act 2005. Prior to Finance Act, 2025 provisions of the STA did not include or define the role of an 'abettor' in a tax fraud, who facilitates or connives with the tax fraudsters to evade the sales tax. The term 'abettor' and his/ her role have now been defined to expand the scope of tax fraud, and punishment for the abetment of tax fraud has also been introduced, FBR added. The "Joint Sea-2025" exercises kicked off in waters near the Russian port of Vladivostok and would last for three days, China's defence ministry said in a statement on Sunday. The two sides will hold "submarine rescue, joint anti-submarine, air defence and anti-missile operations, and maritime combat". Four Chinese vessels, including guided-missile destroyers Shaoxing and Urumqi, are participating in the exercises alongside Russian ships, the ministry said. After the drills, the two countries will conduct naval patrols in "relevant waters of the Pacific". China and Russia have carried out annual drills for several years, with the "Joint Sea" exercises beginning in 2012. Last year's drills were held along China's southern coast. The Chinese defence ministry said Friday that this year's exercises were aimed at "further deepening the comprehensive strategic partnership" of the two countries. China has never denounced Russia's more than three-year war nor called for it to withdraw its troops, and many of Ukraine's allies, including the United States, believe that Beijing has provided support to Moscow. China insists it is a neutral party, regularly calling for an end to the fighting while also accusing Western countries of prolonging the conflict by arming Ukraine. AFP

Listen to article The ruling Pakistan Muslim League-Nawaz (PML-N) on Sunday increased its strength in the National Assembly with the addition of two reserved seats for women from Khyber-Pakhtunkhwa (K-P), according to a notification issued by the Election Commission of Pakistan (ECP). The ECP notified Samar Haroon Bilour, Saeeda Jamshed Khan as members of the National Assembly. Both the names were sent to the ECP last month. This addition makes the ruling party's strength in the 336-strong house to 124. The names of Bilour and Khan appeared at number 1 and 2 on its priority list for the reserved seats for women submitted to the provincial election commissioner, who is the returning officer for filling the two seats. The seats allocation came as the Pakistan Tehreek-e-Insaf was declared not entitled to the reserved seats for women and non-Muslims. Consequently, the ECP allotted five out of 10 reserved seats from K-P to the PML-N, three to Jamiat Ulema-e-Islam and two to Pakistan Peoples Party-Parliamentarians.
